All ORDINANCE providing for the organixation of a Firemen's Relief Associations Providing
for the use and disbursement of the funds created by 40-1701 @eneral
Statues of Kansas, 1935, and by 40-1702 to 1707, Inc., 1945 supplement,
General Statutes of Kansas 1935, and all amendments thereto, and re-
pealing ordinances numbers 4816 and 4599.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas;
Section 1. OFFICERS, BY*LAWS. The Firemen's Relief Association of Salina shall
be composed of all regularly paid members of the fire department of said City. The
Chief of the Fire Department and Assistant Chief of the Fire Department shall be ex -
officio president, and vice-president, respectively, of said Firemen's Relief Association.
The officers of said association shall consist of a president, vice-president,
and secretary and a Board of Directors which shall consist of the president, vice-
president, sec etary and two members, all to be selected as provided by the by-laws
of said Firemen's Relief Associations
Said association shall adopt such by-laws, rules and regulations as it may deem
advisable in carrying out and promoting the objects of said association, not inconsist-
ent with this ordinance, or the laws of the State of Kansas. The secretary shall keep
a complete record of the transactions of the association, which shall at all times be
subject to inspection by the Board of Commissioners of the City of Salina.
Section 2. FUNDS, HOW HANDLED. The treasurer of the City of Salina shall at all
times be the custodian of all funds belonging to the Firemen's Relief Association of
Salina, and he shall be liable on his official bond for the security of this fund, and
he shall keep said funds separate and apart from all other funds.
Section 3. BOARD OF COMMISSIONERS, DISBURSEMENTS. The Firemen's Relief Association
shall, through the president, vice-president and secretary of said association, present
to the Board of Commissioners of said city, in writing, a statement of any disbursements
that the association through its Board of Directors desires to make, and if the same is
approved by the Board of Commissioners, the amount so approved shall be allowed and
appropriated by ordinance for the use and purposes of said Relief Fund, in the same manner
that other funds of said city are disbursed and appropriated.
Section 4. FUNDS, LIMITATION OF USE. X11 moneys received by the City Treasurer
of the City of Salina for said Firemen's Relief shall be set apart and used by the City
of Salina solely and entirely for the objects and purposes set forth in this article and
as set forth in Chapter 257, Laws of Kansas 1941, and any amendments thereto, and shall be
paid to and distributed by the Firemen's Relief Association under such provisions that shall
be made by the Board of Commissioners of the City of Salina. The officers of such Fire-
men's Relief Association may invest any amount not to exceed ninety per centum of all
such moneys, in purchasing bonds of the City of Salina, Kansas, provided that if said
bonds of the City of Salina, Kansas, are not obtainable, United States govermmnt bonds
may be purchased or any municipal bonds of this State may be purchased, provided that such
relief funds are used to purchase bonds where the bonded indebtedness of said municipality
does not exceed fifteen per cent of its total assessed valuation as shown by the last
assessment preceding such investment. Such purchase must be approved by the Board of

Commissioners of the City of Salina, Kansas. Provided, further that it shall be the
duty of the City Attorney of the City of Salina, Kansas, to examine all such bonds

as to their validity and report thereon in writing to the Board of Cormmissioners of
the City of Salina, Kansas, and the Firemen's Relief Association of the City of Salina,
Kansas, and that no bonds shall be purchased by said Firemen's Relief Association of
the City of Salina, Kansas, until they have been approved and found valid by the City
Attorney.
Section 5. FUNDS HELD IN TRUST. All moneys collected and received by the
Firemen's Relief Association of the City of Salina shall be held in trust and used
i as a fund for relief of any member of the Fire Department of the City of Salina,
when injured or physically disabled in or by reason of the discharge of his duties
as such and for the relief of or in payment of gratuities to the widow or those de-

pendent on any member of such fire department who may be killed in the discharge of
his duties as fireman or who may die from the effects of injuries so received or from
disease contracted by reason of his duties as such, and for the payment of the necessary
funeral expenses of any member of such fire department when killed in the discharge
of his duties as fireman, or in the case of death resulting from injuries W received

or diseases contracted by reason of such duties as such, or for the further purpose of
paying a pension to members who are unfit for service after having served for a period
of not less than twenty years on the department, such pension not to exceed in amount
one-half of the monthly salary at the date of retirement; or for the purchase of in
surance which would provide for any and all of the foregoing purposes for which such
fund is authorized; that the Firemen's Relief Association of the City of Salina, Kansas,
is hereby authorized to loan part or all of such funds to the City of Salina, Kansas,
to be used by the City of Salina, Kansas, in the improvement cf its fire departiaent
and equipment thereof and the City of Salina, Kansas, is hereby authorized to borrow
the same and issue to the Treasurer of the Firemen's Relief Association of the City
of Salina, Kansas, its warrant therefor, being interest payable semi-annually at a
rate of not to exceed six per centum per annum.
Section 6. INSURANCE POLICIES. The Firemen's Relief Association of Salina,
may provide insurance as provided in Section 5 hereof, subject to the following
limitations: (a) Policies must be purchased, owned and held by the Firemen's Relief
Association of Salina; (b) Policies must name the said Firemen's Relief Association
j as bdneficiary and must not contain a provision which would permit the assured to
change the beneficiary; (c) Life Insurance must be for term insurance only; and (d)
Policies must be limited to cover only accidental injuries or disease suffered or
contracted, or death resulting therefrom, by reason of duties as a member of the fire
department, PROVIDED, HOWET;ER, it will be permissable for this said Association to
purchase policies giving twenty-four (24) hour coverage by requiring individual
memijers to pay the additional cost over the limited coverage, which a dditional cost
is hereby determined to be 15% of the total premium on the policy.
Section 7. Zhat no person having been a regularly paid member of the
fire department of the City of Salina shall be entitled to receive benefits in
the form of relief and pensions at the same tune and such double benefits are
hereby prohibited.
Section 8. That ordinances numbered 4816 and 4.599 be and they are hereby
repealed.
Section 9. This ordinance shall take effect and be in force from and
after its publication once in the official city paper.
