AN ORDINANCE relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of
curbing and guttering Arthur Avenue from the north line of North Street to the
south line of Lincoln Avenue; Charles Street from the west line of Twelfth Street
to the east line of Phillips Street; Charles Street from the west line of
Phillips Street to the east line of Montrose Avenue; Eighth Street from the
north line of Hamilton Street to the south line of Antrim Street; Garfield
Avenue from the north line of North Street to the south line of Lincoln Avenue;
Grant Avenue from the north line of North Street to the south line of Lincoln
Avenue; Lincoln Avenue from the east line of Grant Avenue to the west line of
Arthur Avenue; North73treet from the east line of Front Street to the west line
of Arthur Avenue; Seventh Street from the north line of Lincoln Avenue to the
south line of Decatur Street; Seventh Street froze the south line of Hamilton
Avenue to the north line of Otis Avenue; and relating to and providing for the
collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for that part of the cost of improve-
ments of certain portions of certain streets as hereinafter set forth in the following
sections of this ordinance which is chargeable to the private property in the assessment
district for each of such improvements respectively, as set forth in the following
sections of this ordinance with respect to each of such improvements there are hereby
levied and assessed on the property liable therefor, being all of the lots and pieces
of ground lying on either side of said streets so improved, respectively, to the middle
of the block for the distance improved, with respect to the improvements mentioned in
Sections 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 of this ordinance, according to the appraised
value of such lots and pieces of c -round with respect to each such improvement, without
regard to the buildings or improvements thereon, special assessments covering the cost
of such work and improvements, said special assessments being based on tiie special
valuation and appraisement of said lots and pieces of ground heretofore made by three
disinterested appraisers appointed by the Board of Commissiners of the City of Salina,
Kansas, with respect to each such improvement, which said appraisements are hereby re-
ferred to and made parts of this ordi~iance, and the several amounts levied, apportioned
and assessed against the lots and pieces of ground for each of such improvements
respectively for the purpose aforesaid are hereby found and determined to be the
amounts set forth in the following sections of this ordinance with respect to each
of such improvements .
Section 2. For that part of the cost of the curbing and guttering Arthur Avenue
fro -i1 the north line of North Street to the south line of Lincoln Avenue, which is
chargeable against the private property within the district chargeable therefor, and
which cost is hereby determined to be $912.64 there is hereby levied, apportioned and
assessed against the following described lots and pieces of land as provided for in
Section 1 of this ordinance, the following amounts:

be due and collectible in ten equal installments, the first becoming due with the
taxes levied for the year 1946 and one of said installments falling due each and
every year thereafter until all are paid, and all to be collected with interest
as in this ordinance provided, PROVIDED, HOWEVER, that the owner of any piece of
property liable for any such assessment may redeer, his property from such liability
by paying into the City Treasury the entire amount chargeable against the same, as
in this ordinance designated, at any time within thirty days after the publication
of this ordinance and before the issuance of the bonds of said city in payment of
the balance of the cost of said improvements, and the property so paid on shall not
thereafter be liable for any further assessments for the cost of said improvements
nor for any part of said bonds.

Section 13. There is hereby further levied and assessed against each lot and
piece of ground described in this ordinance, interest at such rate per annum as shall
be borne by the bonds hereafter to be issued for the payment of the remaining unpaid
cost of such improvements, to be hereafter determined and fixed by ordinance when such
bonds are issued, on all of said installments mentioned and provided for in this ordin-
ance, from the date of the bonds which may be issued at the end of thirty days as
specified in the preceding sections hereof, as by law provided, to the time of the
collection of the last ins11-allment as provided by law, which said interest shall be
collected annually at the same time and in the same manner as said installments are
collected, and after the taking effect of this ordinance and the fixing of said in-
terest rate when such bonds are authorized and issued, it shall be the duty of the
City Clerk of said city to annually at the same time other taxes are certified and
until all of said assessments so apportioned and levied herein have been certified, to
the County Clerk of Saline County, Kansas, a full list of all property liable to
assessment and taxation for such work and improvement, except such property on
which the special assessments aforesaid have :leen paid in full as hereinbefore pro-
vided, together with the respective amounts due on each of such lots and pieces of
ground, Mnich amounts shall include the annual installments of such special assessments
together with the interest for one year at the rate to be fixed as provided for in this
ordinance, on all unpaid balances of such assessments, and such amounts so certified
as herein provided for shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas and collected as other taxes are collected.
Section 14. This ordinance shall take effect and be in force from and after its
publication in the official city paper.

ORDINANCE NO. 5193
AN ORDINANCE relating to and apportioning and levying special assessments
on certain lots and pieces of ground in the City of Salina, Kansas,
to pay the cost of curbing and guttering Arthur Avenue from the
north line of North Street to ,the south line of Lincoln Avenue;
Charles Street from the w$st`line of Twelfth Street to the east
line of Phillips Street; Charles Street from the west line of
Phillips Street tothe east line of Montrose Avenue; Eighth Street
from the north line of Hamilton Street tothe south line of Antrim
Street; Garfield Avenue from the north line of North Street to
the south line of Lincoln Avenue; Grant avenue from the north line
of North Street to the south line of Lincoln venue; Lincoln Avenue
from the east line of Grant Avenue to the west line of Arthur venue;
North Street from the east line of Front Street to the west line of
Arthur venue; Seventh Street from the north line of Lincoln Avenue
tot he south line of Decatur Street; Seventh Street from the south
line of Hamilton Avenue to the north line of Otis Avenue; and relating
to and providing for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1.
That for the purpose of paying for that part of the cost
of improvements of certain portions of certain streets as hereinafter set
forth in the following sections of this ordinance which is chargeable to
{
the private property --the assessmentdistr cts 401 each of such improve-
ments respectively, as set forth in the following sectione of this ordinance
with respect to each of such improvements there are hereby levied and assessed
on the property liable therefor, being all of the lots and pieces of ground
ling on either side of said streets so improved, respectively, to the middle
of the block for the distance improved, with respect to the improvements
mentioned in Sections 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 of this ordinance,
according to the appraised value of such lots and pieces of ground with respect
to each such improvement, without regard to the buildings or improvements
thereon, special assessments covering the cost of suck work and improvements,
said special assessments being based on the special valuation and appraisement
of said lots and pieces of ground heretofore made by three disinterested appraisers
appointed by the Board of Commissioners of the City of Salina, Kansas, with
respect to each such improvement, which said appraisements are hereby referred
to and made parts of this ordinance, and the several amounts levied, apportioned
and assessed against the lots and pieces of ground for each of such improvements
respectivelym for the purpose aforesaid are hereby found and determined to be the
amounts set forth in the following sections of this ordinance with respect to
each of such improvements.
Section 2. For that part of the cost of the curbing and guttering
Arthur Avenue from the north line of North Street to the south line of
Lincoln Avenue, which is chargeable against the private property within
the district chargeable therefor, and which cost is hereby determined to
be $912.64 there is hereby levied, apportioned and assessed against the

Section 12.
Said amounts levied, apportioned and assessed aforesaid
shall b e due and collectible in Mery equal installments, the first becoming
due with the taxes levied for the year 1946 and one of said irs tallments
falling due each and every year thereafter until all. --re paid, and all to
be collected with interest as in this ordinance provided, PROVIDED, HOWEVER,
that the owner of any piece of property liable for any such assessment may
redeem his property from such liability by paying into the City Treasury
the entire amount chargeable against the same, as in -this ordinance desig-
nated, at any time within thirty days after the publication of this ordinance
and before the issuance of the bonds of said city in payment of the balance
of the cost of said improvements, and the property so paid on shall not
tt.ereafter be liable for any further assessments for the cost of said improve-
ments nor for any part of said bonds.
Section 13. There is hereby further levied and assessed against each
lot and piece of ground described in this ordinance, interest at such rate
per annum as shallbe borne by the bonds hereafter to be issued for the payment
of the remaining unpaid cost of such improvements, to be hereafter determined
and fixed by ordinance when such bonds are issued, on all of said installments
mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified in the preceding sections
hereof, as by law provided, to the time of the collection of the last install-
ment as provded by law, which s aid interest shall be collected annually at the
same time and in the same manner as said installments are collected, and after
the taking effect of this ordinance and the fixing of said interest rate when
such bonds are authorized and issued, it shallbe the duty of the City Clerk of
said city to annually at the same time other taxes are certified and until all
of said assessments so apportioned and levied herein have been certified, to
the County Clerk of Saline County, Kansas, a full list of all property liable
to assessment and taxation for such work and improvement, except such property
on which the special assessments aforesaid have been paid in full as hereinbefore
provided, together with the respective amounts due on each of such lots and
pieces of ground, which amounts shall include the annual installments of such
special assessments together with the interest for one year at the rate to be
fixed as provided for in this ordinance, on all unpaid balances of such assess-
ments, and such amounts so certified as herein provided for shall be placed
upon the tax roll by the County Clerk of Saline County, Kansas an collected
as other taxes are collected.
Section 14- This ordinance shall take effect and be in force from
and after its publication in the official city paper.
