AN ORDINANCE ratifying and confirming a contract with Brown and Brown Construction
Company, Inc., for the construction and installation of certain paving and
grading improvements on certain public alleys in the City of Salina, and pro-
viding for the issuance of temporary notes to pay the cost thereof pending
the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas -
Section 1. That the acceptance by the City of Salina, of the proposal of
Brown and Brown Construction Company, Inc., herenafter referred to as the "con-
tractor" as submitted to the Board of Commissioners on September 30, 1946, which
is hereby found to be the lowest and best bid for such work, and the contract
awarded by the Board of Commiss'oners of said city to said contractor and signed
on behalf of the city by its Ma,Yo r on October 8, 1946, for the construction of
certain public improvements in the City of Salina, to -writ:
(1) Paving and grading of a certain north and south public
alley between Santa Fe Avenue and Fifth Street from the
south line of Iron Avenue, thence south to the north line
of Walnut Street, as provided by Ordinance No. 5184.
(2) Paving and grading of a certain north and south public
alley between Santa Fe Avenue and Fifth Street from the
north line of Ash Street, thence north to the south
line of a certain east and west public alley connecting
said Santa Fe Avenue and Fifth Street, as provided by
Ordinance No. 5184.
(3) Paving and grading of a certain north and south public
alley between Fourth Street and Fifth Street from the
north line of Walnut Street, thence north to the lout#
line of Iron Avenue, as provided by Ordinance No. 5184.
at and for the unit prices for said work contained in said proposal, which pro-
oosal and contract are hereby referred to and made parts of this ordinance, be
and the same is hereby ratified and confirmed, said proposal being within the

estimated cost of said improvements as shown by the sworn estimates of the
City Engineer on file in the office of the City Clerk, which estizates are
hereby referred to and made a part of this ordinance.
Section 2 Said improvements shall be built and constructed in accordance
with the plans and specifications therefor prepared by the City "'ngineer on file
in the office of the City Clerk and in accordance with the proposal of said
contractor and under the terms of said contract, all of which are hereby referred
to and made parts of this ordinance.
Section 3. That temporary notes signed by the 14ayor and attested by the
City Clerk be issued from time to tir..e as the work progresses in the manner and
form as required by law, the total amount thereof not to exceed the contract
price for such work, such notes to bear interest not to exceed 4 1/2 per cent
per annum and to mature not later than September 1, 1947, and to be issued in
such amounts and at such time as money for the payment of the cost of such notes
to be issued to said contractor and to be redeemed and cancelled at the time that
permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and
after its ?publication in the official city paper.

AN ORDINANCE ratifying and confirming a contract with Brown and Broom
Construction Company, Inc., for the construction and installation of cer-
tain paving and grading improvements on certain public alleys in the
City of Salina, and providing for the issuance of temporary notes to pay
the cost thereof pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
SECTION 1. That the acceptance by the City of Salina, of the proposal
of Brown and Brown Construction Company, Inc., hereinafter referred to as
the "contractor" as submitted to the Board of Commissioners on September 30,

Ordinance No. 5184,
