AN ORDINANCE providing for the condemnation of certain land for public use in
the extension of the storm sewer system of the City of Salina, Kansas.
WHEREAS, in accordance with Resolution No. 952, adopted by the Board of Cormissioners
of the City of Salina, Kansas, at the regular meeting held on September 30, 1946,
H. F. Harper, Surveyor and City Engineer, has made a survey, description and plat
of the lands referred to and described in said resolution, and has filed the same
with the City Clerk of said city on the 30th day of September, 1946; and
WHEREAS, it is necessary to appropriate certainprivate property, so surveyed, as
aforesaid, for public use as a site of the construction of a sluice gate and other
appurtenances as a part of and incident to the construction, maintenance, re-
placement and operation of the Antrim Avenue Storm Sewer of the City of Salina,
said private property being described as follows, to -wit:

The West Eighty (W 801) feet of Lot Twelve (12) in
Block Two (2) in Tucker Park Addition to the City
of Salina.
WHEREAS, the owner of said premises will not donate or sell said desc_•ibed property
for the purpose aforesaid:
NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. The following described land is hereby condemned and appropriated
for the use of the City of Salina as a site for the construction,maintenance, re-
placement and operation of a part of the .Antrim Avenue Storm Sewer of said city,
to -wit:
The West Eighty (W 801) feet of Lot Twelve (12) in
Block Two (2) in Tucker Park Addition to the City of
Salina;
j all in accordance with the projected plans and specifications thereof now on file

in the office of the City Clerk of Salina and which plans and specifications are
incorporated herein by reference*

Section 2. The City Attorney of said city is hereby ordered and directed
to forthwith prepare, file and present, in the name of the 'board of Commissioners
a written application to the Judge of the District Court of Saline County, Kansas
praying for appointment of Commissioners to make appraisernent and assessment of
damages arising from the appropriation of said real estate and to do and perform
all things in and about the procuring and recording of said order of appointment
required by law.
Section 3. This ordinance shall take effect and be in force from and after
its passage and publication in the official city paper.

TO THE HONORABLE, THE BOARD OF Col.,1ISSIONERS OF
THE CITY OF SALINA, SALINE COUNTY, KANSAS:
Pursuant to directions contained in Resolution No. 952, adopted by your
honorable body on the 30th day of September, 1946, I beg to report that I
have made a survey, description and plat of the land referred to in said
resolution, to -wit:
The West Eighty (W 80s) feet of Lot Twelve (12)
in Block Two (2) in Tucker Park Addition to the
City of Salina;
and adjacent territory attached thereto for municipal purposes, being, lying
and situate in Saline County, Kansas. Said plat snowing the lines of the survey
and made in accordance with said survey, and containing the description of
the property, identical with that hereinbefore set out, is now filed with
the City Clerk of said city.
