AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction
Company for the construction of certain curbing, guttering and grading im-
provements on certain streets in the City of Salina, and providing for the
issuance of temporary notes to pay the cost thereof pending the issuance
and sale of ponds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina of the proposal
of the H. J. Taylor Construction Corapany, hereinafter referred to as the "con-
tractor" as submitted to the Board of Commissioners on September 16, 1946, which
is hereby found to be the lowest and best bid for such work, and the contract
awarded by the Board of Commissioners of said city to said contractor and signed
on behalf of the city by its Mayor on September 16, 1946, for the construction
of certain public improvements in the City of Salina, to -wit:
(1) Curbing, guttering and grading of Frost Street from
the west line of Ninth Street to the east line of
Tenth Street, as provided by Ordinance No. 5175.

(2) Curbing, guttering and grading of Seventh Street
from the north line of Grand Avenue to the sout#
line of Woodland Avenue, as provided by Ordinance
No. 5175.
(3) Curbing, guttering and grading of Franklin Street
from the west line of Merrill Street to the west
line of Hancock Street, as provided by Ordinance
No, 5175.
(4) Curbing, guttering and grading of Woodlawn Avenue
from the west line of Ninth Street thence west to
the city limits, as provided by Ordinance No. 5175*
(5) Curbing, guttering and grading of Eleventh Street
from the south line of Claflin Avenue to the north
line of Cloud Street, as provided by Ordinance No.
5175.
(6) Curbing, guttering and gfading of the north side of
Cloud Street from the west line of Ninth Street thence
west to the city limits, as provided by Ordinance No.
5175.
(7) Curbing, guttering and grading of the west side of
South Court Place from the south line of Ellsworth
Avenue thence southeasterly to the north line of
Jewell Avenue, as provided by Ordinance No. 5175.
(8) Curbing, guttering and grading of Wilson Street
from the west line of Tenth Street to the east line
of Eleventh Street, as provided by Ordinance No. 5175.
(9) Curbing, guttering and grading of Penn Avenue from
the north line of Smoky Hill Drive to the south line
of Gypsum Avenue, as provided by Ordinance No. 5175.
(10) Curbing, guttering and grading of the north side of
Fraz:klin Avenue from the west line of Eleventh Street
to the east line of hena= Street, as provided by
Qrdinance No. 5175.
at and for the unit prices for said work contained in said proposal, which
proposal and contract are hereby are referred to and made parts of this
ordinance, be and the same is hereby ratified and confirmed, said proposal
being within the estimated cost of said improvements as shown by the sworn
estimates of the City hngineer on file in the office of the City Clerk, which
estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance
with the plans and specifications therefor prepared by the City Engineer on file
in the office of the City Clerk and in accordance with the proposal of said con-
tractor and under the terms of said contract, all of which are hereby referred to
and made parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City
Olerk be issued from time to ti...e as the work progresses in the manner and form as
required by law, the total amount thereof not to exceed the contract price for such
work, such notes to bear interest not to exceed 4 1/2 per cent per annum and to mature
not later than January 15, 1948 and to be issued in such amounts and at such time as
money for the payment of the cost of such notes to be issued to said contractor and
to be redeemed and cancelled at the time that permanent bonds are issued in lieu
thereof.
Section 4. This ordinance shall take effect and be in force from and after its
publication in the official city paper.
