AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction
Company for the construction of certain curbing, guttering, patting and grading
improvements on certain streets inthe City of Salina, and providing for the
issuance of temporary notes to pay the cost thereof pending the issuance and
sale of bonds.
BE IT ORDAINED by the board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, of the proposal of the
H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as
submitted to the Board of Coivaissioners on September 16, 1946, which is hereby found
to be the lowest and best bid for such work, and the contract awarded by the Board
of Commissioners of said city to said contractor and signed on behalf of the city
by its Mayor on September 16, 1946, for the construction of certain public improve-
ments in the City of Salina, to -wit:
(1) Paving and grading of Woodland Avenue from the west line of
Santa Fe Avenue to the east line of Seventh Street, as pro-
vided by Ordinance No. 5173.
(2) Paving and grading of Oakdale Avenue from the south line of
Johnstomn Avenue to the south line of Ash Street, as pro-
vided by Ordinance No. 5173.
(3) Paving and grading of Kirwin Avenue from the east line of
Ninth Street to the west line of Santa Fe Avenue, as provided
by Ordinance No. 5173.
(4) Paving and grading of Clark Street from the south line of
State Street to the north line of Walnut Street, as provided
by Ordinance No, 5173.

(5) Paving and grading of Ash Street from the east line of the
right-of-way of the Missouri Pacific Railroad to the east
line of the right-of-way of U. S. Highway 81 by-pass, as
provided by Ordinance No. 5173.
at and for the unit prices for said work contained in said proposal, which proposal
and contract are hereby referred toand made parts of this ordinance, be and the
same is hereby ratified and confirmed, said proposal being within the estimated
cost of said improvements as shown by the sworn estimates of the City Engineer on
file in the office of the City Clerk, which estimates are hereby referred to and
made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordaned
with the plans and specifications therefor prepared by the City Dngineer on file

in the office of th6 City Clerk and in accordance with the proposal of said con-
tractor and under the terms of said contract, all of which are hereby referred to
and made parts of this ordinance.
Section 3. That temporary notes signed by the P+'Ia.yor and attested by the City
Clerk be issued from time to time as the work progresses in the manner and form
as required by law, the total amount thereof not to exceed the contract price for
such work, such notes to bear interest not to exceed 4 1/2 per cent per annum and
to mature not later than January 15, 1948, and to be issued in such amounts and at
such time as money for the payment of the cost of such notes to be issued to said

contractor and to be redeemed and cancelled at the time that permanent bonds are

issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after
its publication in the official city paper.
