5179 Issue GO Bonds Series P-136ORDINANCE NO. 5,179 _(Published in the Sarna Journal 30 1946— --- -------__-- AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $28,934.70, to pay the cost of improving certain streets in Chid city to be designated as Series No, P-136. WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in the City of Salina, Kansas, to -wit: Repaving of a certain public alley from the north line of Ash Street to the south line of Elm Street and lying between Seventh Street and Santa Fe Ave- nue as provided for in Resolution No. 851 and Ordinance No, 5065. Paving of Spruce Street from the east line of College Avenue to the west line of Phillips Avenue, as provided for by Resolution No. 876 and Ordinance No. 5086. Paving of Clark Street from the south line of Walnut Street to the north line of Spruce Street, asprovided for by Resolution No. 856 and Ordinance No. 5107. Paving of Sheridan Street from the north line of Republic Avenue to thesouth line of #ilson Street as provided for by Resolution No. 863 and Ordinance No. 5107. Curbing, guttering, paving and grading of Hancock Street from the north line of Illinois Street to the north line of Venango Street, as provided for by Resolution No. 867 and Ordinance No. 5107. Curbing, guttering, paving and grading of Spruce Street from the west line of Clark Street to the east line of the Missouri Pacific Railroad right-of-way, as provided for by Resolution No. 874 and Ordinance No. 5107. Paving of Spruce Street from the west line of College ' Avenue to the west line of Clark Street, as provided for by Resolution No. 874 and Ordinance No. 5107. Paving of Twelfth Street from the north line of North Street to the south line of Lincoln Avenue as provided for by Resolution No. 875 and Ordinance No, 5107. Paving of Tenth Street from the north line of North Street to the north line of Grand Avenue, as provided for by Resolution No. 888 and Ordinance No. 5118# Curbing, guttering, paving and grading of Tenth Street from the north line of North Street to the north line of Lincoln Avenue as provided for by Resolution No. 889 and Ordinance No, 5118. WHEREAS, the total cost of said improvements has been ascertained and the portion thereof in the amount of $70074.84 to be paid by general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city for which the city is liable, and for which the city is paying cash; and WHEREAS, the total cost of said curbing and guttering, paving and grading of said streets, mhich are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, grading and paving in said streets has been ascertained and has been hereby found and determined to be the sum of $42,647.21, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law provided for in the ordinance of the City of Salina, Kansas, relating thereto, duly passes and approved, of which amount the sum of.$13,712.51 has been paid by the property owners liable therefore, leaving a balance of $28,934.70, for which bonds are to be issued. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby authorized as a part of this ordinance and that for the purpose of providing funds to pay the cost of the improvements herein above referred to and described in the Urdi.nances and Resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $28,934.70, which shall consist of twenty-nine bonds numbered 1 to 299 inclusive, all dated September 1, 1946, which shall bear interest at the rete of 14 per cent per annum from and after said date until the respective maturities of said bonds, payable semi-annually on March 1, and September 1, of each year, said interest to be evidences by interest coupons as herein provided for and said bonds shall become due as follows: Bond No. 1 for $934.70 due September 1, 1947 Bond Nos. 2 and 3, for $1000.00 each due September 1, 1947 Bond Nos. 4 and 5 and 6 for $1000.00 each due September 1, 1948 Bond Nos. 7, 8 and 9 for $1000.00 each due September 1, 1949 Bond Nos. 10, 11 and 12 for $1000.00 each due September 1, 1950 Bond Nos. 13, 14 and 15 for $1000.00 each due September 1, 1951 Bond Nos. 16, 17 and 18 for $1000.00 each due September 1, 1952 Bond Nos. 19, 20 and 21 for $1000.00 each due September 1, 1953 Bond Nos. 22, 23 and 24 for $1000.00 each due September 1, 1954 Bond Nos. 25, 26 and 27 for $1000.00 each due September 1, 1955 Bond Nos. 28 and 29 for $1000.00 each due September 1, 1956 Section 2. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signature of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State, as required by law. Section 3. Said bonds shall be designated as Series P-136 and shall be in the form and Mall contain recitals substantially as follows, to -wit: 1 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALIN; CITY OF SALINA Series P-136 No. KNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itself to be indmbted and for value re- ceived hereby promises to pay to the bearer the sum of DOLLARS in lawful #cney of the United-St'ates of America, on the first day of , 19 , with interest thereon fromthe date hereof at the rate of one an one fount per cent per annum, payable semi-annually on the first days of March 1 and September 1 in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 29 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $28,934.70, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain curbing and guttering and paving and grading improvements in said city by the authority of and in full compliance with the provisions, rest;-ietions and limitations of the constitution and laws of the State of Kansas, including See - tions 10-101, to 10-115, 12-601 to 12-6080 and 13-1011 and 1011-A, General Statutes of Kansas 1935, and such sections as amended, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that e the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by itsCity Clerk and the coupons hereto attached to be signed with the fac simile signatures of said officers, and this bond to be dated the first day of September, 1946. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shallems, and same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salinas Kansas, shall annually make provision for the payment of the principal and interest on said bonds as the same become due by levying taxes and assessments upon the property liable therefore as provided by law.
