AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the
City of Salina, Kansas, in the sum of $11, 343.44, to pay the cost of
constructing certain lateral sanitary sewers in the City of Salina,
Kansas, which bonds shall be designated as Series No. S-135.
WHEREAS, pursuant to proceedings duly had according to law, certain later sanitary
sewers have been constructed in the City of Salina, Kansas in Certain main sewer
distticts, as follows;.
Lateral Sanitary District No. 192, being in Main Sanitary
District "A" as provided for and authorized by Ordinance
No. 5058,
Lateral Sanitary -District No. 201, being in Main Sanitary
Sewer District "E" as provided for and authorized by Ordin-
ance No. 5077.
Lateral Sanitary District No. 202, being in Main Sanitary
Sewer District "A", as provided for and authorized by Ordin-
ance No. 5087,
Lateral Sanitary Sewer District No. 203, being in Main
Sanitary Sewer District "A", as provided for and authorized
by Ordinance No, 5078.
Lateral Sanitary Sewer District No. 2072 being in Main
Sanitary Sewer District "E", as provided for and authorized
by Ordinance No. 5116.
Lateral Sanitary Sewer District No. 208, being in Main Sewer
District "K", as provided for and authorized by Ordinance
No. 5142.
WHEREAS, the total cost of said sewers constructed in and as the sewer districts
above mentioned and to be paid by special assessments levied upon lots and pieces
of ground liable for the payment of said sewers in the sewer district above men-
tioned has been ascertained and is hereby found and determined to be the sum of $12,929.04,
which amount has been heretofore duly assessed and apportioned to the several lots
and pieces of ground liable therefor according to law and as provided for in the
ordinances of the City of Salina relating thereto, of which amount the sum of
$1,585.60 has been paid by the owners of the property liable therefor, leaving a
balance for which bonds will be issued in the sum of $11,343.44; NOW THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.
Section 1. That the foregoing preambles are hereby adopted and made a
part of this ordinance and that for the purpose of providing funds to pay the cost
of the improvements hereinbefore described, there shall be issued and there hereby
are issued Internal Improvement Bonds of the City of Salina, Kansas, in the total
principal sum of $11,343.44, which issue shall consist of twelve bonds numbered from
one to twelve, inclusive, all dated September 1, 1946, which shall bear interest at
the rate of 1-1/4 per cent per annum from and after said date until the respective
maturities of said bonds, payable semi-annually to be evidenced by interest coupons
as herein provided for and said bonds shall become due serially in denominations as

Section 2. Said bonds shall be signed by the Mayor and shall be attested
by the signature of the City Clerk and the corporate seal of the city shall be
affixed thereto, and shall have attached thereto interest coupons representing
the interest thereon, which coupons shall be in the form provided by law and shall
bear the printed or lithographed fac simile signatures of the Mayor and City Clerk
of said city and said bonds and interest coupons shall be registered in the office
of the City Clerk and the State Auditor as required by law.
Section 3. Said bond shall be designated as Series No. 5-135 and shall be
in the form and shall contain recitals substantially as follows, to -wit:

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of
Saline, State of Kansas, acknowledges itself to be indebted and for value received
hereby promises to pay to the bearer the sum of

in lawful money of the United States of America, on the first day o ,
19 , with interest thereon from the date hereof at the rate of 1-174 per cent
per annum, payable semi-annually on the first days of March and September in each
year, on presentation and surrender of the interest coupons hereto annexed as said
coupons se-ferally become due, both principal and interest of this bond being payable
at the office of the State Treasurer of the Stite of Kansas, in the City of Topeka,
Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents
and the full faith, credit and resources of said city are hereby irrevocably pledged
for the payment of said principal and interest at maturity.
This bond is one of a series of twelve bonds of like date and tenor, excepting
denomination and maturity, aggregating the principal sum of $11,343.44, issued by
the City of Salina, Kansas, for the purpose of paying the cost of constructing a
main sanitary sewer and certain lateral sanitary sewers in said city by the authority
of and in full compliance with the provisions, restrictions and limitations of the
constitution and laws of the State of Kansas, including Sections 10-101 to 10-115
and Sections 12-617 to 12-629 and Sections 13-1013 to 13-1018, General Statutes of
Kansas 1935, and such sections as amended, and all other provisions of the laws of
said state applicable thereto, and this bond and all other bonds of this series,
and all interest thereon are to be paid by the City of -Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and things
required to be done and to exist precedent to and in the issuance of this bond have
been properly done and performed and do exist in due and reg..ilar form and manner as
required by the constititon and laws of the State of Kansas, and that the total
indebtedness of said city, including this series of bonds, does not exceed any con-
stitutional or statutory limitation,
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond
by causing it to be signed by its Mayor and its corporate seal to be hereto affixed,
attested by its City Clerk and the coupons hereto attached to be signed with the
fac simile signatures of said officers, and this bond to be dated the first day of
September, 19460

Section 4. The Mayor and City Clerk are hereby authorized and directed to
prepare and execute the bonds hereinbefore described and to advertise and sell the
same in the miner provided by law, and, when duly executed and registered, to de-
liver said bonds to the purchaser or purchasers thereof.
Section 5. The full faith, credit and resources of the City of Salina, Kansas,
shall be, and tie same are hereby irrevocably pledged for the prompt payment of said
bonds and all interest thereon. The Board of Commissioners of the City of Salina,
Kansas, shall annually make provision for the payment of the principal and interest
on said bonds as the same become due by levying taxes and assessments upon the property
liable therefor as provided by law.
Section 6. This ordinance shall take effect and be in force from and after its
publication in tie official city paper.
