4lIiEREAS, by Resolutions No, 898, 861, 902, 911, 912, 916, 917, 918, 919, 924, 925, 926,
927, 928, 931, 932, 933, duly adopted on March 4, 1946, October 16, 1944, March 25, 1946,
',,lay 13, 1946, June 3, 1946, July 1, 1946, and July 8, 1946, respectively, the .board of
Col.nnissioners of the City of Salina, have declared that they deem it necessary to curb,
gutter and grade each - Frost Street from the west line of Ninth Street to the east line
of Tenth Street; Se.enth Street from tie north line of Grand Avenue to the south line
of Woodland Avenue; Franklin Street from the west line of Merrill to the wrest line of
Hancock Street; Woodlawn Avenue from the .vest line of Ninth Street, thence wrest to the
city limits; Eleventh Street from the south line of Claflin Avenue to the north line of
Cloud Street; the North side of Cloud Street from the wrest line of Ninth Street, thence
west to the city limits; the Tiest side of South. Court Place fro:: the south line of

from the existing curb at the west line of Tenth Street -thence viest to the east line of

daily newspaper published in said city, and being the official city paper, and the
majority of the resident property ovmers owning a majority in square feet of the lots
or real estate liable to taxation for the cost of said improvei:e.nts did not within twenty
days from the date of the last publication thereof file with the city clerk a sufficient
protest, in writing, against the making of said improvements, no protests of any kind
having been filed; ITOW THEREFORE,
BE IT ORDAI;IED by the Board of Com:ii.ssioners of the City of Salina, Kansas:
Section 1. That it is necessary and it is hereby ordered that Frost Street from
the west line of Ninth Street to the east line of Tenth Street in said city be curbed
and guttered (with excavation necessary therefor) and graded to the established paving
grade to each side thereof, as may be necessary for the completion of said work.

the north line of Grand Avenue to the south line of Woodland Avenue in said city be
curbed and guttered (with excavation necessary therefor) and graded to the established
paving grade to each side thereof, as may be necessary for the completion of said work.
Section 3. That it is necessary and it is hereby ordered that Franklin Street from
the west line of LTerrill Street to the west line of Hancock Street in said city be
curbed and guttered (with excavation necessary therefor) and graded to the established
paving grade to each side thereof, as may be necessary for the completion of said work.
Section 4. That it is necessary and it is hereby ordered that Vloodlavm A-enue from
the west line of Ninth Street in said city thence west to the city limits be curbed and
guttered (with excavation necessary therefor) and graded to the established paving grade
to each side thereof, as may be necessary for the completion of said work.
Section 5. That it is necessary and it is hereby ordered that Eleventh Street from
the south line of Claflin Avenue thence south to the north line of Cloud Street in said
city be curbed and guttered (with excavation necessary therefor) and graded to the es-
tablished paving grade to each side thereof, as may be necessary for the completion of
said work.
Section 6. That it is necessary and it is hereby ordered that the north side of
Cloud Street from the west line of Ninth Street in said city thence west to the city
limits be curbed and guttered (with excavation necessary therefor) and that said street
between the said gutter line and the city lL.-ii.ts on the south line of Section Twenty-
three (23) Township Fourteen (14) South, Range Three (3) West of the 6th P. PSI., Saline
County, Kansas, being the extremity of the city limits at said place, be graded to the
established pavin`; grade within the limits above defined, as may be necessary for the
completion of said work.
Section 7. That it is necessary and it is hereby ordered that the west side of
South Court Place from the south line of Ellsworth Avenue thence southeasterly to the
,north line of Jewell Avenue in said city be curbed and guttered (with excavation nec-
essary therefor) and that said street be graded to the established paving grade to each
side thereof, as may be necessary for the completion, of said work.
Section 8. That it is necessary and it is hereby ordered that Wilson Street from
the existing curb at the west line of Tenth Street thence west to the east line of
Eleventh Street in said city be curbed and guttered (with excavation necessary there-
for) and graded to the established paving grade to each side thereof, as may be nee-
essary for the comple„ion of said work.
Section 9. That it is necessary and it is hereby ordered that Penn Avenue from
the north l Lie of Smoky Hill Drive thence north to the south line of Gypsum Avenue in
said city be curbed and guttered (with excavation necessary therefor) and graded to
the established paving `rade to each side thereof, as may be necessary for the coTnpletion
of said wo rk.

Section 11. That it is necessary and it is hereby ordered that Illinois Street
from the west line of Sherman Street to the cast line of Sheridan Street in said city
be curbed and guttered (vrith excavation, necessary therefor) and graded to the established
paving grade to each side thereof, as may be necessary for the completion of said vrork.
Section 12. That it is necessary and it is hereby ordered that 1Vorth Street from
the wrest line of Second to the vrest line of Front Street in said city be curbed and
guttered (with excavation necessary therefor) and graded to the: established paring
grade to each side thereof, as may be necessary for the completion of said work.
Section 13. That it is necessary and it is hereby ordered that Third Street
iron the south line of Pacific A -venue to the north line of Forest Avenue in said

of said work.
Section 14. That it is necessary and it is hereby ordered that Twelfth Street

city be curbed and guttered (with excavation necessary therefor) and graded to the
established paving grade to each side thereof, as may be necessary for the co_pletion
of said work.

Section 15. That it is necessary and it is hereby ordered that Lincoln Avenue
from the east line of Twelfth Street to the tivest line of Thirteenth Street in said
city be curbed and guttered (with excavation necessary therefor) and graded to the
established paving grade to each side thereof, as may be necessary for the corlpletion
of said work.
Sectt-on 16. Zhat it is necessary and it is hereby ordered that Tenth Street from
the south line of Harsh Street to the south line of Hamilton Arenue in said city be
curbed and guttered (with excavation necessary therefor) and graded to the established
paving grade to each side thereof, as may be necessary for the co-1-oletion of said work.
Sect_on 17. Tnat it is necessary and it is hereby ordered that Funston Avenue
from the south line of Ells:,orth Avenue to the north line of Jewell Avenue in said
city be curbed and guttered (with excavation necessary therefor) and graded to the

Section 18. That it is necessary and it is hereby ordered that North Street from
the east line of Fourth Street to the west line of Second Street in said city be curbed
and guttered (with excavation necessary theeefor) and graded to the established paving
grade to each side thereof, as may be necessary for the completion of said work.
Section 19. That it is necessary and it is hereby ordered that Eighth Street from
the south line of Otis Avenue to the north line of Antrim Avenue in said city be
curbed and guttered (tirith excavation necessary therefor) and graded to the established
paving grade to each side thereof, as may be necessary for the completion of said i^tire:.
Section 20. For the cork and improvements herein provided for, the City Engineer
shall rake and file i° th the City Clerk on or before the 26th day of. August, 1946,
complete plans and specifications for the curbir_ , guttering and grading (with excava-
tion nece,:sary therefor) of each of the streets or portions thereof described in
Sections 1 to 19, both inclusive, of this ordinance, with the following type of irn-
proveiient:
Conc •ete combined curb and gutter on each side -thereof (except the
streets described in Sections 6, 7 and 10 of this ordinance which
are to be curbed and gutteredon only one side), 30 inches 1,ide from
back of curb to paving line, curb 12 inches deep at back; gutter 6
inches deep; and the necessary grading of each to the established
paving grade between the curb and gutter lines on each side there-
of and ti;ithin the limits of said streets herir before described;
and said Engineer shall on or before the same date, submit to the board of Co:Lrissioners,
under oath, detailed estimated of the cost of such worl: for such improvements.
Section 21. That after such plans and specifications shall have been rude and
prepared by the City Dagineer and filed with the City Clerk as aforesaid, the Board
of Comfiiissi.oners may advertise by advertisement published in the o_ -''ficial city
paper of the Cite of Salina, Kansas, for three consecutive days for the receipt of
sealed proposals for the improving of said streets with the kind of material named
and specified in the preceding sections hereof, aa -id for the excavati.�g and grading
necessary for the completion of such work, and after the receipt of such proposals
the said Board of Cor:�,,:lissioners may and are hereby authorized to let contracts for
the improving of said streets with the .aerial selected by diem to the lowest re-
sponsible bi:'.der or bidders tl.erefor, as determined by said3oard of Coms.i:ssioners,
and for such excavating and grading. said Eoard of Cor:Lnissioners reserve the right
to reject any and all bids.
Section 22. That for the i :provi.ng of the above mentioned streets such asse s-
ments shall be made for the full costs thereof according to law, on all lots and
pieces of land to the center of the block on either side of the streets to be im-
proved according to the appraiser's valuation thereof -vd-Unout regard -to the 1 uild-
ings or irc:provements thereon for the distance to be improved.
Section 23.
After the passage
and pu"..lication of this ordinance, the

and taxation as aforesaid, as may be designated by the Board of Coru:issioners of
said city, tivithout regard to the buildings or-unprovements thereon and after making
said appraisement shall return the sale to the Board of Comriissioners of said city
and said Board of CorLmissicners shall designate a time and place for the hearing of
any complaints that may be made as to the value of any lots or pieces of land appraised

as aforesaid, of vrmich due notice shall be given in the official city paper, at -vnich
hearing theBoard of CoyiLmissi.oners may alter any valuation of any lot or piece of land,
if, in their opinion, the some has been appraised too high or too lot, -r.
Section 24. That for the purpose of payirL; the cost of the �vork and iriprove;.ents
in this ordinance provided for, the Board of Coneiissioners are hereby authorized and
directed to issue internal improvement bonds of the City of Salina in an mount not
to exceed the contract price or cost of such improvements dnd to run for a period of
four years and be payable in four equal installments, together vrith interest :got to
exceed 5o per annum, v,,hich bonds shall be made payable at the Fiscal Agency of the

Sta-i,e of Kansas; and for the purpose of pa ting principal and interest on said 'coeds
as they severally become due and payable, the Board of Con-missioners shall apportion
and assess against the lots and pieces of land va thin the taxing district of such
improvements, special assessments covering the cost of such improvements and the
apportionment herein contained shall hold food for all the insta-llr.ents that are to
be collected from the specific property chargeable tiri.th said i.: proveriients. Such
assessment and apportionment ordinance shall contain the total amount of tax apportioned
I_ each tract, piece and parcel of land within the taxing district %Id shall Suate
the number of annual installments in tiv'iich such tax is to be collected; and thereafter,
the City Clerk shall armually, at the same time other taxes are certified, certify
to the County Clerk of Saline County, Kansas, a full list of all property liable for
such i-rork and improvements, together with the respective amounts due on each of said
tracts, pieces and parcels of land, which amounts shall include the annual installments
and interest on all unpaid balances for one year at the rate of not to exceed 5;' per
arrrzum, on such amounts so certified i,Aiich shall "oe collected as other taxes are col-
lected; PRO'iIDED, that for the purpose of defraying the cost of improving the inter-
sections and areas formed by the crossing of streets and alleys, and for the grading
of said street where the same is provided for in this ordinance as well as rhere the
ir:.pro,i-ement is through or adjacent to property of the city for which the city would
be liable, the assessment vri.11 be made against all taxable property of the city and
paid by the city at large.
Section 25. This ordinance shall take effect and be in force from and after its
puulication in the official city paper.

SECTION 10. That it is necessary and it is hereby ordered that the
north side of Franklin Avenue from the west line of Eleventh Street thence r:es
to the east line of Sherman Street in said city be curbed and buttered (z°rith
excavation necessar- therefor) and graded to the established paving; grade to
each side thereof, as may be necessary for the completion of said Vork.
SECTION 11. That it is necessary and it is hereby ordered that Illinois
Street from the unrest line of Sherman Street to the east line of Sheridan
Street in said city be curbed and guttered (with excavation necessary there-
for) and graded -,o the established paving grade to each side thereof, as may
be necessary .for -the completion of said work.
SECTION 12. That it is necessary and it is hereby ordered that North
Street from tine west line of Second to the west line of Front Street in said
city be curbed and guttered (witiI excavation necessary therefor) and graded
to the established paving grade to each side thereof, as, may be necessary
for ' he completion of said. work.
SECTION 13. That it is necessary and it is hereby ordered that Third
Street from the south line of Pacific Avenue to the north line of Forest Ave-
nue in said city be curbed and guttered (with excavation necessary therefor)
and traded to the established paving grade to each side thereof', as may be
necessary for the completion of said work.
SECTION 14. That it is necessary and it is hereby ordered that Twelfth
Street from the south line of Lincoln Avenue to the north line of Grand Ave-
nue :in said city be curbed and guttered (with excavation necessary therefor)
and graded to the established paving grade to each side thereof, as may be
necessary for the completion of said work.
SECTION 15. That it is necessary and it is hereby ordered that Lincoln
Avemae from the east line of Twelfth Street to the westy line of Thirteenth
Street in said city be curbed and guttered (with excavation necessary there-
for) and graded to the established paving grade to each side -thereof, as may
be necessary for -the completion of said work.
SECTION 16. That it is necessary= and it is hereby ordered that Tenth
Street from the south line of iarsh Street to the south line of Hamilton
Avenue in said city be curbed and ;uttered (with excavation necessary there-
for) and graded to the established paving grade to each side thereof, as may
be necessary for the completion of said work.

SECTION 20. For the work and improvements herein provided for, the
City Engineer shall make and file with the City Clerk on or before the ',264*_
day of August , 1949, complete plans and specifications for the
curbing, guttering and grading (with excavation necessary therefor) of each
of the streets or portions thereof described in Sections 1 to 1.9, both in -
elusive, of this ordinance, with the follotitii-ing type of improvements

SECT1ION 21. That after such plans and specifications shall have been

aforesaid, the Loa -rd of Commissioners may advertise by advertisement pub -
paper in the Of 1Ci l Clty paper Of the City of Salina, Kansas, for three
consecutive days for the receipt of sealed proposals for the improving of
said streets vrith the kind of material named and specified in the preceding
sectior_s hereof, �.nd for the excavating and grading- necessary for t he com-
pletion of such v,ork, and after the receipt of such proposals the said Board
of Co_r:n:issioners may and are hereby authorized to let contracts for the im-
proving of said streets i^ -th the material selected by them to `I- e lowest re-
sponsible bidder or bidders therefor, as determined by said loard of Comeis-
si onors, and for such excavating and grading. Said Board of Conuni ssioners
reserve the right to reject any and all bids.
�Cl'IOT? 22. That for the improving of the above mentioned streets
such assessments shall be made for the full costs thereof accordin, to la:T,
or_ all lots and pieces of land to the center of the bloc: on either side of
the streets to be improved according; to the appraisers' valuation thereof
v;ithoiA regard to the buildings or improvements thereon .for the distance to
be im-proved.
CECTION 23. After the passage and publication of this ordinance, the
,card of Commissioners shall appoint three disinterested appraisers, house-
holde:-s, vi -ho after having taken an oath to ma le a true and impar tial a -
praisenrent for all lots s.nd pieces of land liable to assessment and taxation
for the cost of tie improvements herein provided for, she 11 rritlin five days
after having been notified of their appointment, proceed to appraise said d
lots and pieces of land liable to assessment and taxation as aforesaid, as
ma be designated by the Board of Conuaissioners of said city, without regard K;
to the buildings or improvements thereon and after rrakin� said appraisement
shall return the same to the Board of Commissioners of said city and said
Board of Comrrd. ssioners shall designate a time and place for the hearing of
any c on, pla.nts that may be made as to the value of any lots or pieces of
lard appraised as aforesaid, of which due notice shall be given in the offi-
cial city paper, at which hearing the Hoard of Commilssioners may alter any
valuation of any lot or piece of land, if, in their opinion, the same has
been appraised too high or too lour.

SECTION 24. That for t he purpose of paying the cost of the ,Trork and
improvements in this ordinance provided for, the Board of Commissioners are
hereby authorized and directed to issue internal improvement bonds of the
City of Salina in an amount not to exceed the contract price or cost of
such improvements and to run for a. period offbun years and be payable in
fourequal installments, together with interest not to exceed 5`;, per annum,
wi,ich bonds shall be made payable at t he Fiscal Ate one ;r of the S �I-a-te of

the,* severally become due and payable, the Board of C=m dssi overs s'iall
apportion and assess against the lots and pieces of land' zsithin the taxin-

improvements and the apportionment herein. contained shall hold good for all
the installments that. are to be collected from the specific property charge-
able i7ith said improvements. Such assessment and apportioruient ordinance
shall contain the total amount of tax apportioned to each tract, piece and
parcel 'of land r;ithin the taxing district and shall state the number of
annual installments in which such tax is to be collected; and thereafter,
the City Clerk shall annually, at t Ile same time other taxes are certified,
certify to the County Clerk of Saline County, Kansas, a full list of all
property liable for such Work and improvements, together ,^;ith the respect-
ive amounts due on each of said tracts, pieces and parcels of land, r�rhich
amounts shall include the annual installments and intorest on all unpaid
balances for one year at the rate of not to exceed 5,'u per annum, on;.such
amo-unts so certified Alich shall be collected as other taxes are coiActed;
PROVIDED, that for the purpose of defraying t he cost- of improving the',in-
tersections and areas fo:~aned by the crossinf- of streets and alleys, and
for the gradin, of said street ahere the sa=e is provided for in this ordin-
ance: as well as ,-� ere the improvement is through or ad4acent to property of
,he city for which the city would be liable, the assessment will be :~lade
against all taxable property of the city and paid by the citi, at large.
