5172 Confirm Alley ImprovementsORDINANCE NO. 5172 (First published in the Salina Journal _Y y 1946) I , AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Construction Company, Inc., for the paving of certain public alleys in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pend- ing the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, of the proposalof Brown and Brown Construction Company, Inc., hereinafter referred to as the "contractor's as submitted to the Board of Com,iissioners on July 15, 1946, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by its Lhyor on July 17, 1946, for the construction of certain public improvements in the City of Salina, to -wit: Paving of a certain public alley from the North line of Iron Avenue to the south line of Ash Street and the paving of a certain public alley from the north line of Walnut Street to the south line of a certain east and west public alley connecting Seventh Street and Eighth Street, all as provided by Ordinance No. 5164, at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance yr th the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said con- tractor and under the terms of said contract, all of tivhich are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Llayor and attested by the City Clerk be issued from tiie to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract, price for such work, such notes to bear interest not to exceed per cent per annum and to mature not later than December 15, 1946, and be issued to such amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
