BE IT ORDAINED by the Board of Commissioners of the Citir of Salina, Kansas: 11 Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor Construction Company, hereinafter referred to as the "contractor", as submitted to the Board of Coimaissioners on June 24, 1946, vfti ch is hereby found -to be the lowest and best bid for such work, and the contract awarded by the Board of Cormissione._-s of said City to said contractor and signed on behalf of the City by its Mayor on June 24, 1946, for the construction of certain public improvements in the City of Salina, to -wit: Construction of Storm Sewer No. 24, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances and is hereby denominated the Woodland Avenue Storm Sewer, which includes the main sewer running from Dry Creek east in Woodland Avenue and terminating at Second Street and all laterals which drain into the Woodland Avenue Storm Sewer, being described as laterals, for convenience only, numbered 1, 2, 3, 4, 5, 6 and 7, all being part of said storm sewer No. 24, more particularly described as follows: WOODLAND AMUUTE 1,AIN. LATERAL NO. 6 Beginning at a point in Fourth Street which is 145 feet north of the north line ofl�loodland Avenue; thence south in Fourth Street with a 12 -inch sewer pipe to the point of intersection of the described Woodland Avenue storm sewer main at the intersection of Woodland Avenue and Fourth Street; thence south in Fourth Street with a 15 -inch sewer pipe 250 feet; thence south in Fourth Street with a 12 -inch sewer pipe 325 feet, being the terminus of Lateral No. 6. LATERAL NO. 7. Beginning at a point in the intersection of Pacific Avenue and Front Street; thence west in Pacific Avenue with a 12 -inch sewer pipe 544 feet; thence south in Third Street with a 15 -inch sewer pipe 530 feet to the point of intersection of the described Woodland Avenue main storm sewer in the intersection of Woodland Avenue and Third Street; thence south in Third Street with a 15 -inch sewer pipe 590 feet to a point in the intersection of Forest Avenue and Tnird Street, being the terminus of Lateral No. 7, i at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being zhrithin the estimated cost of said improvements as shov+m by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordin- ance, Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance .°.rith the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and :lade parts of this ordinance. Section 3. That temporary notes signed by the ifTayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4 1/2 percent per annum and to mature not later than November 1, 19460 and to be issued in such amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. SECTION 2. Said improvements shall be built and constructed in with the plans and specifications therefore prepared by the City ineer on file in the office of the City Clerk and in accordance with the oposal of said contractor and under the terms of said contract, all of ch are hereby referred to and made parts of this ordinance. SECTION 3. That temporary notes signed by the Mayor and attested the City Clerk be issued from time to time as the work progresses in the r and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4 1 /2 per cent per annum and to mature not later than November 1p 1946- s 944; and to be issued in such amounts and at such time as money for the of the cost of such notes to be issued to said contractor and to be deemed and cancelled at the time that permanent bonds are issued in lieu reof.
