AN ORDINANCE ratifying and confirming a contract with Brown and Brown Construction
Company, Inc. for the repaving of a certain public alley in the City of
Salina, and providing for the issuance of temporary notes to pay the cost
thereof pending issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas=
Section 1. That the acceptance by the City of Salina, of the proposal of
Brown and Brovm Construction Company, Inc., hereinafter referred to as the "con-
tractor" as submitted to the Board of Commissioners on April 29, 1946, which is
hereby found to be the lowest and best bid for such work, and the contract awarded
by the Board of Commissioners of said city to said contractor and signed on behalf
of the city by its Mayor on April 29, 1946, for the construction of certain public
improvements in the City of Salina, to -wit:
Paving of a certain public alley from the northiline of Ash Street to
the south line of Elm Street, as provided by Ordinance No. 5065,
at and for the u# it prices for said work contained in said proposal, which proposal
and contract are hereby referred to and made parts of this ordinance, be and the same
is herebyratified and confirmed, said proposal being within the estimates of the
City Engineer on file in the office of the City Clerk, which estimates are hereby
referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance
with the plans and specifications therefor prepared by the City Engineer on file
in the office of the City Clerk and in accordance with the proposal of said con-
tractor and under the terms of Laid contract, all of which are hereby referred to
and made parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the
City Clerk be issued from time to time as the work progresses in the manner and
form as required by law, the total amount thereof not to exceed the contract
price for such work, such notes to bear interest not to exceed 4-2 per cent per
annum and to mature not later than September 1, 1946, and be issued in such amounts
and at such time as money for the payment of the cost of such notes to be issued
to said contractor and to be redeemed and cancelled at the time that permanent
bonds are issued in lieu thereof.
Secti n 4. This ordinance shall take effect and be inforce from and after
its publication in the official city paper.

Section 4. This ordinance shall take effect and be in force from and
after its publication to the official city paper.
