5161 Confirm Utility ImprovementsORDINANCE NO,, 5161 First published In the Salina Journal_ re zD 1946) AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction Company for the construction of a certain storm sewer in the City of Salina, heretofore designated as Stora Sewer No. 220, and providing for the issuance of temporary notes to pay the cost i thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, of the proposal of H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as submitted to the Board of Commissioners on May 6, 1946, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by its Mayor on May 6, 1946, for the construction of cer- tain public improverientu in the City of Salina, to -wit: Construction of Storm Sewer No. 220, beginning at an existing manhole in the intersection of North and Second Streets, thence east in North Street with an 18" sewer 699 feet to a manhole to be constructed at the intersection of North Street and Grant Avenue; thence north in Grant Avenue with a 15" sewer a distance of 430 feet to a manhole to be constructed in the intersection of Grant Avenue and Lincoln Avenue; thence east in Lincoln Avenue with a 15" sewer distance of 650 feet to a manhole to be constructed in the intersection of Lincoln Avenue and Arthur Avenue, at and for the unit prices for said work contained in said proposal, which pro- posal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby re- ferred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract# all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the P.Iayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the con- tract price for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not layer than September lst, 1946, and to be issued in such; amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
