All ORDINANCE creating and defining a benefit district in or near a commercial
or industrial district of the City of Salina for the purpose of acquiring
by purchase, gift or condemnation, lands for three (3) public parking stations
in or near said commercial or industrial district and providing for the im-
proving, installing and constructing of (3) public parking stations within
the created benefit district, on lands so acquired, and providing that the
means and apportionment of payment therefor shall be hereafter determined as
provided by law, and providing that no further proceedings shall be had re-
lating hereto unless a good and sufficient petition signed by fifty-6ne per
centum (51/'o) of the resident property owners of the lands within the dis-
trict, as provided by law, is filed within sixty (60) days from the date
hereof with the City Clerk of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Public Parking Station Benefit District: That there should be
and there is hereby created a public parking station benefit district, in or near
the commercial or industrial district, in the City of Salina, Kansas, which shall
include all of the following described real property, to -wit:
All lots numbered, (which includes only lot numbers ending with the odd
numbers 1, 3, 5, 7 and 9) 49 to 137, inclusive, on Eighth Street; all
lots numbered, (which includes only lot numbers ending with the odd
numbers 1, 3, 5, 7 and 9) 19 to 47, inclusive on Seventh Street; all
lots numbered (consecutively) 49 to 138, inclusive, on Seventh Street;
all lots numbered (consecutively 19 to 168, inclusive, on Santa Fe Avenue;
all lots numbered (consecutively)19 to 142, inclusive, on Fifth Street;
all lots numbered (which includes only lot numbers ending with the even
numbers 0, 2, 4, 6 or 8) 20 to 114, inclusive on Fourth Street and all
lots numbered (consecutively) 115 to 138, inclusive, on Fourth Street
each and every one of said lots being in the Original Town of Salina,
Saline County, Kansas. Said benefit district being described by metes
and bounds as follows, to -wit:
Commencing at the intersection of the west line of Seventh Street and
the north line of Elm Street thence west on the north line of Elm Street
to the point of intersection with the west line of Eighth Street thence
south on the west line of Eighth Street to the point of intersection with
the south line of Walnut Street thence east on the south line of Walnut
Street to the point of intersection with the west line of a certain north
and south alley connecting Walnut Street and Mulberry Street and between
Santa Fe Avenue and Seventh Street thence south on said west line of said
alley, extended south, to the point of intersection with the south line of
Mulberry Street, thence east on the south line of Mulberry Street to the
point of intersection with the east line, extended south, or a certain
north and south alley connecting Mulberry Street and Walnut Street and
between Santa Fe Avenue and Fifth Street, thence north on the east line
of said alley to the point of intersection with the south line of Lot
142, extended west, on Fifth Street in the Original Town of Salina, thence
east on the south line of Lot 142 and directly east across Fifth Street,
thence continuing east on the south line, extended east, of Lot 141 on
Fifth Street in the Original Town of Salina to the point of intersection
with the east line of a certain north and south alley connecting Walnut
Street and Mulberry Street and between Fifth Street and Fourth Street,
thence north on the east line of said alley to the point of intersection
with the south line of Walnut Street, thence east on the south line of
Walnut Street to the point of intersection with the east line, extended
south, of a certain north and south alley north of the north line of
Walnut Street and between Fourth Street and Third Street thence north
on the east line of said alley to the edge of the Smoky Hill River thence
northwesterly down the edge of the Smoky Fill River to the point of inter-
section with the east line extended, of Fourth Street, as though it con-
tinued,
ontinued, undeviated, in a north and south direction thence north on the
east line of Fourth Street, as extended, to the point of intersection
with the south line of the right-of-way of the Missouri Pacific Railroad
Company, thence west on the south line of the right-of-way of said rail-
road to the point of intersection of the west line of Seventh Street,
thence south on the west line of Seventh Street to the place of beginning.
Section 2. That the purpose of creating said public parking station benefit
district is to acqu:..re lands by gift, purchase or condemnation upon which to
establish three (3) public parking stations within the designated and created
benefit district and to improve said lands and to construct and install three
(3) public parking stations within the said benefit district upon lands so ac-
quired.

Section 3. That in the event a good and sufficient petition by the
resident owners of real estate owning not less than fifty-one per cent of the
front feet of the real estate fronting or abutting upon any street included

within the limits of the benefit district created by Section 1. #ereof, is not

filed with the City Clerk of the City of Salina, Kansas, within sixty days from
and after the passage hereof, no further proceedings shall be had herein.
Section 4, That it is necessary and is hereby ordered that three (3)
public parking stations, within the designated and created benefit district,
as defined in Section 1, hereof, be provided for and that sufficient land be
obtained by the Board of Commissioners therefor by gift, purchase or condemna-
tion and that all necessary improvem nts, markings, surfacing, supervising

quarters and installations be installed, constructed and built, upon said lands

so acquired to serve the public for said purposes.
j Section 5. That in the event a good and sufficient petition as provided

in Section 3, hereof, is duly filed, that thereupon the Board of Commissioners
of the City of Salina shall proeeed as provided by law to provide for the ac-
quisition of the lands and improvements necessary therefor, to provide for the

apportionment and payment of the cost thereof and do all other things necessary

and proper to accomplish the purposes hereof, all as provided by law.

Section 6. This ordinance shall take effect and be in full force from and
after it adoption and publication in the official city paper.

Section 3. That in the event a good and sufficient petition by

district, as defined in Section 1, hereof, be provided for and that
sufficient land be obtained by the Board of CormAssior_ers therefor
by gift, purchase or condemnation and that all necessary improvemen-4
markings, surfacing, supervising quarters and installations be
installed, constructed and buildt, upon said lands so acquired. to
serve the public for said purposes.
Section_ 5. That in the event a good and sufficient petition as
provided. in section 3, hereof, is duly filed, that thereupon the
Board of Commissioners of the City of Salina shall proceed as
provided by law to provide for the acquisition of the lands and
improvements necessary therefor, to provide for the apportionment
and payment of the cost thereof and do all other things necessary
and proper to accomplish the purposes hereof, all as provided by
law.
Section 6. This ordinance shall take, effect and be in full force
from and after is adoption and publication in the official city paper.
