G j* 1946 ) I AN ORDINANCE providing for the construction of a certain storm sewer in the City of Salina, to be designated as storm sewer No. 24, and providing for the letting of contract for such construction and for the payment of the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that a storm sewer (described as a main sewer and certain laterals for convenience only), which is here- by designated as Storm Sewer No. 24, together with all necessary inlets, inlet con- nections, manholes, connecting lines, sluice gates and other appurtenances, be con- structed in the City of Salina along the following course, to -wit: The Woodland Avenue Storm Sewer includes the main sewer running from Dry Creek east in Woodland Avenue and terminating at Second Street and all laterals which drain into the Woodland Avenue Sevier, being Laterals No. 1, 2, 3, 4, 50 6 and 7, all being a part of Storm Sewer No. 24, more particularly described as follows: WOODLAND AVENUE MAIN. Beginning at a point at the east bank of the channel of Dry Creek and 30 feet south of the north line of Woodland Avenue extended west; thence east with a 48 -inch sewer pipe 1225 feet to a point in the inter- section of Woodland Avenue and Eleventh Street; thence continuing east in Wood- land Avenue with a 42 -inch sewer pipe 1280 feet to a point in the intersection of Woodland Avenue and Seventh Street; thence continuing east in Woodland Avenue with a 36 -inch sewer pipe 680 feet to a point in the intersection of Woodland Avenue and Fifth Street; thence continuing east in Woodland Avenue with a 30 - inch sewer pipe 332 feet to a point in the intersection of lbodland Avenue and Fourth Street; thence continuing east in Woodland Avenue with a 24 -inch. sewer pipe 333 feet to a point in the intersection of Woodland Avenue and Third Street; thence continuing east in Woodland Avenue with an l& -inch sewer pipe 291 feet to a point in the intersection of Woodland Avenue and Second Street where main terminates, and LATERAL N0. 1. Beginning at said described main sewer in the intersection of lloodland avenue and Eleventh Street; thence south in Eleventh Street with a 30 -inch sewer pipe 740 feet to a point in the intersection of Eleventh Street and Grand Avenue; thence east in Grand Avenue with a 30 -inch sewer pipe 960 feet to a point in the intersection of Grand Avenue and Eighth Street; thence continuing east in Grand Avenue with an 18 -inch sewer pipe 296 feet to a point in the intersection of Grand Avenue and Seventh Street; thence continiting east in Grand Avenue with a 15 -inch sewer pipe 312 feet, more or less, to the west line of Santa Fe Avenue, being the terminus of Lateral No. 1, and, LATERAL NO. 2. Beginning at said described Lateral No. 1 in the intersection of Grand Avenue and Eighth Street; thence south in Eighth Street with an 18 - inch sewer pipe 338 feet to a point in the intersection of Eighth Street and Decatur Avenue with a 15 -inch sewer pipe 260 feet, more or less, to the west line of Ninth Street, being the terminus of Lateral No. 2. LATERAL NO. 3. Beginning at said described Lateral No. 2 in the intersection of Decatur Avenue and Eighth Street thence east in Decatur Avenue with a 15 - inch sewer pipe 510 feet, being the terminus of Lateral No. 3. LATERAL NO. 4. Beginning at said described main sewer in the intersection of oodland Avenue and Tenth Street; thence south in Tenth Street with a 12 -inch sewer pipe, a distance of 124 feet, being the terminus of Lateral No, 4. LATERAL N0. 5. Beginning at a point in Fifth Street 250 feet north of the north line o oodland Avenue; thence running south in Fifth Street with a 12-inoh sewer pipe intersecting the described main sewer at the intersection of Woodland Avenue and Fifth Street; thence running south in Fifth Street with a 21 -inch sewer pipe 425 feet; thence south in Fifth Street with a 15 - inch sewer pipe 640 feet to a point in the intersection of Fifth Street and Decatur Avenue; thence west in Decatur Avenue with a 12-inoh sewer pipe 185 feet, being the terminus of Lateral No. 5. 1 1 1 1 1 LATERAL NO. 6• Beginning at a point in Fourth Street which is 1'45of et north of the north line of Woodland Avenue; thence south in Fourth Street with a 12 -inch sewer pipe to the point of intersection of the described Woodland Avenue storm sewer main at the intersection of Woodland Avenue and Fourth Street; thence south in Fourth Street with a 15 -inch sewer pipe 250 feet; thence south in Fourth Street with a 12 -inch sewer pipe 325 feet, being the terminus of Lateral No. 6• LATERAL NO. 7. Beginning at a point in the intersection of acific Avenue and Front Street; thence west in Pacific Avenue with a 12 -inch sewer pipe 544 feet; thence south in Third Street with a 15 -inch sewer pipe 530 feet to the point of intersection of the described Woodland Avenue main storm sewer in the inter- section of Woodland Avenue and Third Street; thence south in Third Street with a 15 -inch sewer pipe 590 feet to a point in the intersection of Forest Avenue and Third Street, being the terminus of Lateral No. 7. Section 2. That on or before the 20th day of May, 1946, the City Engineer i shall prepare and file in the office of the City Clerk detailed plans and speci- fications for the construction of the storm sewers provided for in Section 1 of this Ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such types of sewer pipe and on or before the same date shall prepare and file in the office of the City Clerk, under oath, detailed estimates of cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by ad- vertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewers i and at the time and place mentioned, the Board of Commissioners may contract with t the lowest and best responsible bidder therefor for the building and construction t of such storm sewers, but the right to reject any and ail bids shall be and is i hereby reserved; and provided further that if no responsible person shall propose 1 to enter into a contract at a price not exceeding the estimated cost, then the Board of Commissioners may proceed to construct said improvements within the es- timated cost thereof and shall purchase the necessary tools, apparatus and materWb and employ the necessary labor for the purpose of constructing the same* Section 3• That for the payment of the cost of such work, the Board of Com- missioners shall issue Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, except as herein pro- vided, to be payable in four approximately equal annual installments and to bear interest at not to exceed 5% per annum from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature, the Board of i Conmissioners shall annually levy a tax upon all real and person property in the City of Salina in an mount sufficient to pay the annual installments of such principal and interest, and that pending the issue of such bonds, temporary notes shall be issued according to law, to pay the cost of such work. i Section 40 This ordinance shall take effect and be in force from and after j its publication in the official paper.
