5153 Confirm Utility Improvements Grounds of Kansas Wesleyan UniversityORDII,UIRCE NO. 5153 (Published in the Salina Journal. 1946) AN ORDINMOCE ratifying and confirming contract vrith the H. J. Taylor Construction Coi;ipany for the construction of a certain lateral Sanitary Sewer in Lateral Sanitary Sewer District No. 208 in the City of Salina, and providing for the issuance of temporary notes to pay the cost therefor, pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor, d/b/a The H. J. Taylor Construction Company, hereinafter referred to as "The Contractor", as submitted to the Board of Commissioners on the 8th day of April, 1946, which is hereby found and determined to be the lowest and best bid for such work and the contract awarded by the Board of Cominissioners of said city to said contractor and signed on behalf of the City by its Mayor on the 8th day of April, 1946, for the con- struction of said public improvements in the City of Salina, to -writ: A lateral sanitary sewer in a certain benefit district No. 408, being Lots Seven (7), Nine (9), Eleven (11), Thirteen (13), Fifteen (15), Seventeen (17) Nineteen (19) on Minneapolis Avenue; Lots Eight (8), Ten (10) Twelve (12), Fourteen (14) Sixteen (16), Eighteen (18) and Twenty (20) on Ellsworth Avenue; Lots Twenty --five (25), Twenty-seven (27), Twenty-nine (29), Thirty-one (31), Thirty-three (33) and Thirty-five (35) on Santa Fe Avenue, all in the Grounds of Kansas Wesleyan University, an addition to the City of Salina, in Saline County, Kansas: at and for the unit price for said work contained in said proposal which proposal and construction are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal within esti!..ated cost of said ii..prove- ments as shown by sworn estimates of City _ngineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section z. That said improvements shall be built and constructed in accordance with the plans and specifications taerefor, prepared by the City Engineer, on file in the office of the City Clerk, and in accordance with the proposals of said contractor and under the terms of said contract, all of which ire hereby referred to and made a part of this ordinance. Section 3. That temporary notes, signed by the Mayor and attested by the City Clerk, be issued from time to tine as the work progresses in the manner and form re- quired by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed five (5) per cent Der annum and to :nature not later than August 1, 1946, to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time the permanent bonds are issued in lieu thereof.
