5147 Construct Storm SewerORDINANCE NO. 5147 _ (Published in the- _641ina Jaumal _ // _ 1946) ALIT ORDINANCE providing for the construction of a certain storm sewer in the City of Salina, to be designated as storm sewer No. 420, and providing for the letting of contract for such construction and for the payment of the cost thereof. BE IT ORDAINED by the Board of Coirarissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby- ordered that a storm sewer, which is hereby designated as Storm Sewer No. 2G0, together with all necessary inlets, inlet connections, manholes, connecting lines and other appurtenances, be constructed in the City of Salina along the following course, to -wit: No. 42¢, beginning at an existing manhole in the intersection of North and Second Streets, thence east in North Street vrith an 18" sewer 699 feet to a manhole to be constructed at the intersection of North Street and Grant Avenue; thence north in Grant Avenue with a 15" sewer a distance of 430 feet to a manhole to be constructed in the intersection of Grant Avenue and Lincoln Avenue; thence east in Lincoln Avenue with a 15" server a distance of 650 feet to a manhole to be constructed in the intersection of Lincoln Avenue and Arthur Avenue. Section ?,. That on or before the ?.;Md day of April 1946, the City Engineer shall prepare and file in the office of the City Clerk detailed plans and specifications for the construction of the storm sewers provided for in Section 1 of this ordinance with vitrified and/or concrete sewer pipe or any combination of such types of sewer pipe and on or before the same date shall prepare and file in the office of the City Clerk, under oath, detailed estimates of cost thereof. After such plans and speci- fications and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least theeeconsecutive days for sealed proposals for the building and construction of such storm sewers and at the time and place mentioned, the Board of Commissioners may contract with the for loviest and best responsible bidder therefor/the building and construction of such storm sewers, but the ri,-ht to reject any and all bids shall be and is hereby reserved; and provided farther that if no rgsonsible person shall pnpose to enter into a contfact at a price not exceeding the estimated cost the Board of Commissioners may proceed to construct said improvements within the estimated cost thereof and shall purchase the necessary tools, apparatus and is terials and employ the necessary labor for the purpose of constructing the same. Section 3. That for the payment of the cost of such work, the Board of Com- missioners ommissioners shall issue Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, except as herein provided, to be payable in five approximately equal annual installments and to bear interest at not to exceed 5% per annum from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issue of such bonds, temporary notes shall be issued according to law, to pay the cost of such -v:rork.
