AN ORDIEtTGE creating and defining certain lateral Sanitary Sewer District in the
City of Salina, designated as Lateral Sanitary Sewer District No. 208,
so created, providing for the cost thereof and for the levying of
special assessments against the property in said district; for the
payment of such construction; and for the issuing of bonds therefor.
BE IT 'DRDAINED BY THE BOARD OF C0111ISSIONERS OF THE CITY OF SALLA:
Section No. 1. Lateral Sanitary Sewer District No. 208. That there
should be and there is hereby created a lateral Sanitary Sewer District in the
city of Salina, ti-rhich should be designated as Lateral Sanitary Sewer District No.
208, and ehich shall include all of the followin;;described property, to -wit:
Lots Seven (7), Nine (9), Eleven (11;, Thirteen (13),
Fifteen (15), Seventeen (17), Nineteen (19) on 1,in.neapolis
Avenue; Lots Eight (8), Ten (10), Twelve (12), Fourteen (14),
Sixteen (16), Eighteen (18) and Twenty (20) on Ellsworth Avenue;
Lots Twenty-five (25), Twenty-seven (27), Twenty-nine (29), Thirty-one
(31), Thirty-three (33) and Thirty-five (35) on Santa Fe Avenue, all
in the Grounds of Kansas lVesleyan University, an addition to the City
of Salina, In Saline, County, Kansas.
Section No. 2. That it is necessary and is hereby ordered
that an 8" V.C.P. Lateral Sanitary Sewer, with all necessary connections,
manholes, flush tanks and other appurtenances, be constructed and build in to
serve said Lateral Sanitary Sewer District No. 208, beginning at an existing
manhole in the intersection of Santa Fe :venue and the East and eldest alley between
Ellsworth Avenue and Minneapolis rvenuo, thence `rest across the remaining
portion of Santa Fe livenue and continuing Voest in the Said alley between Ellsworth
Avenue and _^_inneapolis Avenue for a distance of 542 feet more or less frog the
place of beginning to a manhole at the end of the sewer.
Section No. 3. That the City Lngineer shall on or before April 1st. 1946,
prepare and file in the office of the City Clerk, plans and specifications for
the construction of the Lateral Sanitary Sewer provided for in the preceding
sections of this Ordinance, which shall be of proper ch,_racter to serve the property
lying within the district within which such sewer is to be constructed and shall
on or before the same date prepare and submit to the board of Commissioners detailed
estimates under oath of the cost thereof. That thereafter, the City Clerk shall
advertise for three consecutive daysin the official city paper for sealed
proposals for the building and construction of such sewer according to such ple s
and specifications, which proposals shall be fixed with the City Clerk on or
before the time fixed in such notice, at Which time the Board of Commissioners may
let a contract for the building and construction of such sewer to the lowest
and best responsible bidder therefor, if there be any ,,chose bid does not exceed
the estimated cost thereof, but said Board shall reserve the ri;ht to reject any
or all such proposals, and if no bid shall be received within such estimate, the
Board of Commissioners shall have the power to do such work and make such
his pror-erty shall not be liable for any assessments for -the cost of such improvements,
and bonds as hereinafter provided for shall be issued for the amount of the cost of
such improvements remaining; unpaid at the end of PXI thirty days from the time such
assessment is fixed.
Section No. 7. For the purpose of payinL for the work and improvements
in this Ordinance provided for, the Board of Commissioners are hereby authorized and
directed to issue improvement bonds of the City of Salina in an amount not to
exceed the cost of such improvements, and to run for a period of 5 years and be payable
in 5 approximately equal annual installments, together with interest not to exceed 5
percent per annum, which bonds shall be issued and payable according to law; and for
the purpose of payinC the principal and interest on said bonds, as they severally
become due and payable, the Board of Commissioners shall apportion and assess against
the lots or pieces of land within the taxing districts of such improvements, special
assessments covering the cost of such improvements, and the apportionment therein
contained shall hold good for all of the installments that are to be collected from
the specific property charJeable with said improvements, such assessment and
apportionment ordinance shall contain the total amount of tax apportioned to each

improvements within the estimated cost thereof as provided by law.
Section No. 4. That for the cost of building and constructing such sewer
special assessments shall be made for the full cost thereof on all lots or pieces

of land within the sewer district within and for which such sewer shall be built,
according to the appraised value thereof, without regard to the improvements or

buildings thereon.

Section P';o. 5. After the passage and publication of this Ordinance, the
Board of CoL-imissioners shall appoint three disinterested appraisers, who after
havin;r taken an oath to make a true and impartial appraisement of all lots or pieces
of land liabl:: to taxation for the cost of tush improvements, shall within five days
after haveing been notified of their appointment proceed to appraise all of the lots
or pieces of lend within such district liable to assessment and taxation as aforesaid,
without rer-ard to the building or improvements thereon, and after making said
appraisements shall -return the same to the Board of Commissioners of said City and
said Board shall designate a time for holding; a special rr_eetin� of said Board
for the purpose of hearing; any complaints that may be made as to the value of any
lot or piece of land appraised as aforesaid, of which special session due notice
shall be given in the official city paper, and at which special session said Board
may alter any valuation of any lot or piece of land, if, in their opinion, the same
had been appraised too high or too low.
Section No. 6. The special assessments herein provided for may be paid
by the person liable therefor in four approximately equal annual installments but
the oviner of any property liable to such assessment may within thirty days from the
date of determining the amount assessed against his property pay the same in full and
his pror-erty shall not be liable for any assessments for -the cost of such improvements,
and bonds as hereinafter provided for shall be issued for the amount of the cost of
such improvements remaining; unpaid at the end of PXI thirty days from the time such
assessment is fixed.
Section No. 7. For the purpose of payinL for the work and improvements

Clerk shall annually, at the same time other taxes are certified, certify to the
County Clerk of Saline County, Kansas, a full list of all property liable for such
work and improvements, together Vrith the respective amounts due on each of said tracts,
pieces or parcels of land, ivhieh amounts shall include the annual installments and
interest on all unpaid balances for one year at the rate of not to exceed four percent
per annum, on such amounts so certified, which shall be collected as other taxes are
collected.
Section No. 8. This Ordinance shall take effect and be in full force from
and after its publication in the official city paper.

ORDINANCE No. 5142
AN ORDINANCE cresting and defining certain Lateral Sanitary Sewer
District in the City of Salina, designated as Lateral Sanitary Sewer District
No. 208, so created, providing for the cost thereof and for the levying of
special assessments against the property in said district; for the payment of
such construction; and for the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina:
SECTION No. 1. Lateral Sanitary Sewer District No. 208. That there
should be and there is hereby created a Lateral Sanitary Sewer District in the
City of Salina, which should be designated as Lateral Sanitary Sewer District
No. 208, and which shall include all of the following described property, to -
wit:
Lots Seven (7), Nine (9), Eleven (11), Thirteen (13),
Fifteen (15), Seventeen (17)0 Nineteen (19) on Minneapolis
Avenue; Lots Eight (8), Ten (10), Twelve (12), Fourteen (14),
Sixteen (16), Eighteen (18) and Twenty (20) on Ellsworth
Avenue; Lots Twenty-five (25), Twenty-seven (27), Twenty-
nine (29), Thirty-one (31), Thirty-three (33) and Thirty-
five (35) on Santa Fe Avenue, all in the Grounds of Kansas
Wesleyan University, an addition to the City of Salina, in
Saline County, Kansas.
SECTION No. 2. That it is necessary and is hereby ordered that an 8"
V.C.P. Latera�ariitary Sewer, with all necessary connections, manholes, flush
tanks and other appurtenances, be constructed and built in to serve said Lat-
eral Sanitary Sewer District No. 208, beginning at an existing manhole in the
intersection of Santa Fe Avenue and the East and Viest alley between Ellsworth
Avenue and Minneapolis Avenue, thence West across the remaining portion of
Santa Fe Avenue and continuing ?gest in the said alley between Ellsworth Avenue
and Zdlinneapolis Avenue for a distance of 542 feet more or less from the place
of beginning to a manhole at the end of the sewer.
SECTION No, 3. That the City Engineer shall on or before Aril

and specifications for the construction of the Lateral Sanitary Sewer provided
for in the preceding sections of this Ordinance, which shall be of proper char-
aoter to serve the property lying within the district within which such sewer
is to be constructed and shall on or before the same date prepare and submit
to the Board of Commissioners detailed estimates under oath of the cost there-
of. That thereafter, the City Clerk shall advertise for three consecutive days
in the official city paper for sealed proposals for the building and construc-
tion of such sewer according to such plans and specifications, which proposals
shall be fixed with the City Clerk on or before the time fixed in such notice,
at which time the Board of Commissioners may let a contract for the building
and construction of such sewer to the lowest and best responsible bidder
therefor, if there be any whose bid does not exceed the estimated cost thereof,
but said Board shall reserve the right to reject any or all such proposals,
and if no bid shall be received within such estimate, the Board of Commission -
ars shall have the power to do such work and make such improvements within the
estimated cost thereof as provided by law.
SECTION 4.. That for the cost of building and constructing such sewer
specie assessments shall be made for the full cost thereof on all lots or
Pieces of land within the sewer district within and for which such sewer
shall be built, according to the appraised value thereof, without regard
to the improvements or buildings thereon.
SECTION 5. After the passage and publication of
Board af�ssioners shall a 'dib Ordinance, the

after having taken an oath to make a true and impartial a

all lots or pieces of land liable to taxation for the cost Of�such nimprove-
ments, shall within five days after having been notified of their appoint-
ment proceed to appraise all of the lots or pieces of land within such
district liable to assessment and taxation as aforesaid, without regard to
the building or improvements thereon, and after making said appraisements
shall return the same to the Board of Commissioners

Board shall designate a time for holding of hearing pedal meeting of said Board
for the
purpose ng any complaints that may be made as to the value
of any lot or piece of land appraised as aforesaid, of which special ses-
sion due notice shall be given in the official city paper, and at which
special session said Board may alter any valuation of any lot or piece of
lands if, in their opinion, the same had been appraised too high or too
low.
SECTION No. 6. The special assessments herein provided for may be
paid by the person liable therefor in four approximately equal annual in-
stallments but the owner of any property liable to such assessment may
within thirty days from the date of determining the amount assessed against
his property pay the same in full and his property shall not be liable for
any assessments for the cost of such improvements, and bonds as hereinafter
provided for shall be issued for the amount of the cost of such improvements
remaining unpaid at the end of thirty days from the time such assessment is
fixed.
SECTION No. 7. For the purpose of paying for the work and improvements
in this "Ordina',nce provided for, the Board of Commissioners are hereby author-
ized and directed to issue improvement bonds of the City of Salina in an
amount not to exceed the cost of such improvements, and to run for a period
of 5 years and be payable in 5 approximately

provements, special assessments covering the cost of such improvements, and
the apportionment therein contained shall hold good for all of the install-
ments that are to be collected from the specific property chargeable with
Said improvements, such assessment and apportionment ordinance shall contain ,
the total amount of tax apportioned to each tract, piece or parcel of land
within the taxing districts and shall state the number of annual installments
in which such tax is to be collected; and thereafter the City Clerk shall
annually, at the same time other taxes are certified, certify to the County
Clerk of Saline County, Kansas, a full list of all property liable for such
work and improvements, together with the respective amounts due on each of
said tracts, pieces or parcels of land, which amounts shall include the an-
nual installments and interest on all unpaid balances for one year at the
rate of not to exceed four per cent per annum, on such amounts so certified,
which shall be collected as other taxes are collected.
SECTION No. 8, This Ordinance shall take effect and be in full force
