5140 Grant Permission to Construct RailroadORDINAECE NO. 5140 Published in the Salina Journal rTarch 1946 An ORDINANCE granting the Missouri Pacific Railroad Company, its successors and assigns, the right to construct, reconstruct and maintain a standard guage railroad switch or spur track, at grade thereof, over, upon and across North Seventh Street, in the Original Town of Salina, Saline County, Kansas and providing for the maintenance thereof. The Missouri Pacific Railroad Company, its successors and assigns, is hereby ,ranted permission to construct, reconstruct, maintain and operate a switch or spur track of standard guage over, upon and across North Seventh Street in Salina, Kansas, at Grade thereof, and that the north line of the switch or spur track to intersect the east line of Seventh Street at a point sixty five (65) feet south, more or less, of the point of intersection of the east line of Seventh Street and the south line of Pine Street, all in said city. Section 2. Said railroad track shall be constructed, maintained and operated in accordance with the laws of the State of Kansas and the ordinances of the City of Salina now in force or hereafter enacted, and all paving, side- walks, crossins,and drainage, crossed or affected by such track, or which as now existing or hereafter provided for, which cross or affect such track, shall be constructed, reconstructed and maintained by said •rantee, its successors and assigns, in such manner as may be required by the governing body of said city. Upon failure to comply with any such requirements, the city may at the expense of the -rantee, its successors and assiEns, proceed to do any such work as may have been required hereunder. Section 3. The exercise of any of the privileges herein granted, shall constitute an acceptance by the grantee, its successors and assigns of all of the conditions of this ordinance. Section 4.
