5137 Grant Permission to Construct RailroadORDINANCE N0. 5137 ` (Published in the Salina Journal January - -- 1946 ) -------_ -- - AN ORDINANCE granting the Missouri Pacific Railroad Company, its successors and assigns, the right to construct, reconstruct and maintain a standard gauge railroad switch or spur track, at grade thereof, over, upon and across North Fifth Street between Lots Twenty --two (42) and Twenty --one (21) on Fifth Street in the Original Tov+m of Salina, Saline County, Kansas, and over, upon and across the North and South alley between Lots Twenty --one (21) on Fifth Street and Twenty-two (G2) on Fourth Street, both in the Original Tovm of Saline, Saline County, Kansas and providing for the maintenance thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansass Section 1. The Missouri Pacific Railroad Company, its successors and assigns, is hereby granted permission to oonstruct, reconstruct, maintain and operate a switch or spur track of standard gauge over, upon and across North Fifth Street in Salina, Kansas, at grade thereof, between Lots Twenty-two (L2) and Twenty-one (21) on Fifth Street in the Original Tom of Salina, Saline County, Kansas and over, upon and across the North and South alley, at grade thereof, between Lots Twenty --one (21) on Fifth Street and Twenty-two (22) on Fourth Street, both in the Original Tov+m of Salina, Saline County, Kansas. Section 2. Said railraod track shall be constructed, maintained and operated in accordance with the laws of the State of Kansas and the ordinances of the City of Salina now in force or hereafter enacted, and all paving, side- walks, crossings and drainage, crossed or affected by such track, or which is now existing or hereafter provided for, which cross or affect such track, shall be constructed, reconstructed and maintained by said gfantee, its successors and assigns, in such manner as may be required by the governing body of said city. Upon failure to comply with any such requirements, the city may at the expense of the grantee, its successors and assigns, proceed to do any such work as may have been required hereunder. Section 3. The exercise of any of the privileges herein granted, shall constitute an acceptance by the grantee, its successors and assigns of all of the conditions of this ordinance. Section 4.
