AN ORDINANCE ratifying and confirming a contract with The H. J. Taylor Construction
Company for the construction of a certain Lateral Sanitary Sewer in Lateral
Sanitary Sewer District No. 204, so created, and for the construction of a
certain Main Sewer in Main Sewer District "S", so created; providing for the
cost thereof and for the levying of special assessments against the property
in said district for the payment of such construction and for the issuance of
bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina of the proposal of H. J.
Taylor, d/b/a The H. J. Taylor Construction Company hereinafter referred to as "'The
Contractor", as submitted to the Board of Commissioners on the 8th day of October 1945,
which is hereby found and determined to be the lowest and best bid for such work and
the contract awarded by the Board of Commissioners of said city to the said contractor
and signed on behalf of the city by its Mayor on the 8th day of October 1945, for the
construction of said public improvements, in the City of Salina, Kansas, to -wits
A Lateral Sanitary Sewer in a certain benefit district No. 2040 and a
a certain main sewer in a certain benefit district "S", said benefit
districts being:
Lots I to 28, inclusive, in Block #9
Lots 1 to 22, inclusive, and Lot 24 in Block 10
Lots 1 to 8, inclusive, and Lots 10, 12 and 14 in Block 11
Lots 1 to 14, inclusive, and Lots 16, 18 and 20 in Block 14
Lots 1 to 28, inclusive, in Block #15
Lots 1 to 28, inclusive, in Block 16
Lots 5 to 28, inclusive, in Block 17
Lots 13 to 28, inclusive, in Block 18, all in Morris Addition to the City of Salina
Lots 4 to 15, inclusive, in Walker's Addition t8 Salina and Lot 12, Surveyors's
Plat "G"
at and for the unit price for said work contained in said proposal which proposal and
construction are hereby referred to and made a part of this ordinance, be and the same
is hereby ratified and confirmed, said proposal being within the estimated costs of said
i:.provements as shown by the sworn estimates of the City Engineer on file in the office
of the City Clerk, which estimates are hereby referred to and made a part of this ordin-
ance.
Section 2. That said improvements shall be built and constructed in accordance
with the plans and specifications therefore, prepared by the City Engineer, on file in
the office of the City Clerk, and in accordance with the proposals of said contractor
and under the terms of said contract, all of which are hereby referred to and made a
part of this ordinance.
Section 3. That temporary notes, signed by the Mayor and attested by the City
Clerk, be issued from ti!:e to time as the work progresses in the manner and form re-
quired by law, the total amount thereof not to exceed the contract price for such work,
such notes to bear interest not to exceed five per cent per annum and to mature not
later than June 30, 1946, to be issued in such amounts and at such time as money for
the payment of the cost of such work may be required, such notes to be issued to said
contractor and to be redeemed and cancelled at the time the permanent bonds are issued
in lieu thereof.
Section 4. This ordinance is to take effect and be in force from and after its
publication in city paper.
