5119 Confirm Utility Improvements EMI AdditionORDINANCE N0. 5119 (Published in the Salina Journal 1945) AN ORDINANCE ratifying and confirming contract with The H. J. Taylor Construction Company for the construction of a certain lateral sanitary sewer in Lateral Sanitary Sewer District No. 206, so created, providing for the cost thereof and for the levying of special assessments against the property in said district for the payment of such construction and for the issuance of bonds therefore. BE IT ORDAINED, by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor, o/b/a The H, J. Taylor Construction Company hereinafter referred to as "The Contractor", as submitted to the Board of Commissioners on the Sth day of October, 1945s which is hereby found and determined to be the lowest and best bid for such work and the contract awarded by the Board of Commissioners of said city to said contractor and sighed on behalf of the City by its Mayor on the 8th day of October, 1945, for the construction of said public improvements in the City of aalina, to -wit: A lateral sanitary sewer in a certain benefit disteiet No. 406, being lots 1 to 40 inclusive in Block S. 8, 17 and 40; also Lots 1 to 32 in- clusive in Block 26. All in the Episcopal Military Institute Addition; at and for the unit price for said work contained in said proposal which proposal and construction are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal within estimated cost of said improvements as shown by sworn estimates of City Engineer on file in the office of City Clerk which estimates are hereby referred to and made a part of this ordinance. Section 2. That said improvements shall be built and constructed in accordance with the plans and specifications therefore, prepared by the City Engineer, on file in the office of the City Clerk, and in accordance with the proposals of said eon - tractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes, signed by the Mayor and attested by the City Clerk, be issued from time to t:Lue as the work progresses in the manner and form re- quired by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed five per cent per annum and to mature not later than June 30, 1946, to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time the permanent bonds are issued in lieu thereof.
