AN ORDINANCE creating and defining certain Lateral Sanitary Sewer Listrict in
the City of Salina, designated as Lateral Sanitary Sewer District

No. 207, so created, providing for the cost thereof and for the levy-
ing of special assessments against the property in said district; for
the payment of such construction; and for the issuing of bonds there-
fore.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District No, 207. That there should
be and there is hereby created a Lateral Sanitary Sewer District in the City of
Salina, which should be designated as Lateral Sanitary Sewer District No. 207,
and which shall include all of the following described property, to -wit:
All of Lots Twenty-five (25) Surveyor's Plat tGt; Lots One
to Seven (1 to 7) inclusive in Block One (1), Oakdale Addi-
tion; and part of Lot One (1) Surveyorts Plat 12.

Section 2. That it is necessary and is hereby ordered that an 8" V.C.P.
}
Lateral Sanitary Sewer, with all necessary connections, manholes, flush tanks,
and other appurtenances, be constructed and built in to serve said Lateral Sanitary
Sewer District No. 207, beginning at an existing manhole in the intersection of
Kansas Avenue and Johnstown Avenue; thence running east in Johnstown Avenue as an
8" V. C. P. sewer, a distance of 5001 more or less, to a manhole and end of sewer.
Section 3. That the City Engineer shall on or before November 5, 1945,
prepare and file in the office of the City Clerk plans and specifications for the
construction of the Lateral Sanitary Sewer provided for inthe preceding sections of
this Ordinance, which shall be of proper character to serve the property lying with-
in the district within which such sewer is to be constructed and shall on or before
the same date prepare and submit to the Board of Commissioners detailed estimates
under oath of the cost thereof. That thereafter, the City Clerk shall advertise
for three consecutive days in the official city paper for sealed proposals for the
building and constructing of such sewer according to such plans and specifications,
which proposals shall be filed with the City Clerk on or before the time fixed in
such Notice, at which time the Board of Counnissioners may let a contract for the
building and construction of such sewer to the lowest and best responsible bidder
therefor, if there be any whose bid does not exceed the estimated cost thereof,
but said Board shall reserve the right to reject any or all such proposals, and if
no bid shall be received within such estimate, the Board of Coiun_ssioners shall have
the power to do such work and make such improvements within the estimated cost there-
of as provided by law.
Section 4. That for the cost of building and constructing such sewer
special assessments shall be made for the full cost thereof on all lots or pieces
of land within the sewer district within and for which such sewer shall be built,
according to the appraised value thereof, without regard to the improvements or
buildings thereon.
Section 5. After the passage and publication of this ordinance, the Board
of Cornnissioners shall appoint three disinterested appraisers, who after having
taken an oath to make a true and impartial appraisement of all lots or pieces of
land liable to taxation for the cost of such improvements, shall within five days
after having been notified of their appointment proceed to a -praise all of the lots
or pieces of land within such district liable to assessment and taxation as aforewaid,
without regard to the building or improvements thereon, and after making said appraise-
ments shall return the same to the Board of Commissioners of said city and said Board
shall designate a time for holding a special meeting of said Board for the purpose
of hearing any complaints that may be made as to the value of any lot or piece of
land appraised as aforesaid, of which special session due notice shall be given in
the official city paper, and at which special session said Board may alter any valua-
tion of any lot or piece of land, if, in their opinion, the same had been appraised
too high or too low*
Section 6. The special assessments herein provided for may be paid by the
person liable therefor in four approximately equal annual installments but the
owner of any property liable to such assessment may within thirty days from the
date of determining the amount assessed against his property pay the same in full
and his property shall not be liable for any assessments for the cost of such im-
provements, and bonds as hereinafter provided for shall be issued for the amount
of the cost of such improvements remaining unpaid at the end of thirty days from
the time such assessment is fixed.
Section 7. For the purpose of paying for the work and improvements in this
Ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue improvement bonds of the City of Salina in an amount not to exceed the
cost of such improvements, and to run for a period of four years and be payable in
four approximately equal annual installments, together with interest not to exceed
five per cent per annum, which bonds shall be issued and payable acoording to law;
and for the purpose of paying the principal and interest on said bonds, as they
severally become due and payable, the Board of Commissioners shall apportion and
assess against the lots or pieces of land within the taxing districts of such ins
provements, special assessments covering the cost of such improvements and the
apportionment therein contained shall hold good for all of the installments that
are to be collected from the specific property chargeable with said improvements,
such assessment and apportionment ordinance shall contain the total amo#nt of tax
apportioned to each tract, piece or parcel of land within the taxing districts and
shall state the number of annual installments in which such tax is to be collected;
and thereafter the City Clerk shall annually, at the same time other taxes are
certified to the Coimty Clerk of Saline County, Kansas, a full list of all property
liable for such work and improvements, together with the respective amounts due on

each of said tracts# pieces or parcels of land, mhieh amounts shall include
the annual installments and interest on all unpaid balances for one year at
the rate of not to exceed four per cent per annum, on such amounts so certified,
which shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and bin full force from
and after its publication in the official city paper.
