AN ORDINANCE amending Section 29-126 of Revised Ordinances of the City of Salina
1939, being Section 26 of Ordinance No. 4953, relating to and regulating

traffic and relating to and prohibiting the driving of any vehicle by any
person under the influence of intoxicating liquor or narcotic drugs, and pro-

viding a penalty for the violation of this ordinance.

BE IT ORDAINED by the'card of Commissioners of the City of Salina, Kansas:

Section 1, That Section 29-126 of Revised Ordinances of the City of Salina
a
1939, being Section 26 of Ordinance No. 4953, be and the same is hereby amended
to read as follows:

"(a) It is unlawful and punishable as provided in subdivision (b) of
t
this section for any person who is an habitual user of narcotic drugs
or any person who is under the influence of intoxicating liquor or nar-
cotic drugs to drive any vehicle within this city. (b) Every person who
is convicted of a violation of this section shall be punished by imprison -
meat for not more than one year, or by fine of not less than $100.00 nor more
than $500.00, or by both such fine and imprisonment. On a second or sub-
sequent conviction he shall be punished by imprisonment for not less than
ninety days nor more than one year, and in the discretion of the court, a
fine of not more than $6500.00."
Section 2. Zhat original Section 29-126 of the Revised Ordinances of the City
of Salina 1939, being Section 26 of said Ordinance No. 4953, be and the same is
hereby repealed.
Section 3. This Ordinance shall take effect and be in force from and after
its publication in the official city paper.
