BE IT ORDAINED by the Board of Commissioners of the City of Salina: Section 1. Lateral Sanitary Sewer District No. 206. That there should be and there is hereby created a Lateral Sanitary Sewer District in the City of Salina, which should be designated as Lateral Sanitary Sewer District 111o. 206, and which shall include all of the following described property in the City of Salina, to - wit: Lots One to Twenty (1 to 20) inclusive in Block Five, Eight, Seventeen, and Twenty (5-8-17-20); also Lots One to Thirty - Two (1 to 32) inclusive in Block Twenty-six (26) all in the Episcopal Military Institute Addition. Section 2. That it is necessary and is hereby ordered that an 8" V.C.P. i Lateral Sanitary Sewer, with all necessary connections, manholes, flush tanks and other appurtenances, be constructed and built in and to serve said Lateral Sanitary Sewer District No. 206, beginning at an existing manhole in Pacific i Avenue between Third and Fourth Streets; thence north in the alley between Third and Fourth Streets from Pacific Avenue to Euclid Avenue, a distance of 26002, more or less, to a manhole and end of sewer. Section 3. That the City Engineer shall on or before October 1, 1945, pre- pare and file in the office of the City Clerk plans and specifications for the construction of the Lateral Sanitary Sewer provided for in the preceding sections of this ordinance, which shall be of proper character to serve the property lying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners detailed estimates under oath of the cost thereof. That thereafter, the City Clerk shall advertise for three consecutive days in the official city paper for sealed pro- posals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or be- fore the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder therefor, if there be any whose bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Corahiissimaers shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law• Section 4. That for the cost of building and constructing such sewer special assessments shall be made for the full cost thereof on all lots or pieces of land i within the sewer district within and for which such sewer shall be built, according i to the appraised value thereof, without regard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such district liable to assessment and taxa- tion as aforesaid, without regard to the building or improvements thereon, and after khaking said appraisements shall return the same to the Board of Commissioners of said City and said Board shall designate a tine for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same had been appraised too high or too low. Section 6. The special assessments herein provided for may be paid by the person liable therefor in tew approximately equal annual installments but the owner of any property liable to such assessment may within t Urty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Corunissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an w-ount not to ex- ceed the cost of such improvements, and to run for a period of 10 years and be pay- able in 10 approximately equal annual installments, to;_ether with interest not to exceed 5 per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds, as they severally become due and payable, the Board of Conunissioners shall apportion and assess against the lots or pieces of land within tete taxing districts of such im- prove:nents, special assessments covering the cost of such improveiients and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said i-Tprovements, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing districts and shall state the number of annual installments in which such tax is to be collected; 1 1 I- -- ------- and thereafter the City Clerk shall annually, at the same tLae other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed four per cent per annum, on such amounts so certi- fied, which shall be collected as other taxes are collected.
