5096 Utility Improvements Morris AdditionORDINANCE NO. 5096 (Published in the Salina Journal F4 u9 : r s i 1945) AN ORDINANCE creating and defining certain Main Sewer Distfiet in the City of Salina, designated as Main Sewer District "Fs providing for the cost thereof and for the levying of special assessments against the property in such district for the payment of such cost, and for the issuing of bonds therefor. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section le Main Server District "S". That there be and there is hereby created a Main Sewer District in the City of Salina, which shall be designated as Main Sewer District "S", which shall include all of the following described property in said city, to -wit: Lots 1 to 28 inclusive, in Block 9 Lots 1 to 22, inclusive, and Lot 24 in Block 10. Lots 1 to 8, inclusive, and Lots 10, 12 and 14 in Block 11 Lots 1 to 14, inclusive, and Lots I6, 18 and 20 in Block 14 Lots 1 to 28, inclusive, in Block 15 Lots 1 to 28, inclusive, in Block 16 Lots 5 to 28, inclusive, in Block 17 Lots 13 to 280 inclusive, in Block 18, all in Morris Addition to the City of Salina; Lots 4 to 15, inclusive in Walker's Addition to Salina and Lot 12, Surveyorts Plat "G". Section 4 That it is necessary and it is hereby ordered that a Main Sewer Dis- trict together with all necessary connections, manholes, and other appurtenances, be constructed and built as Main Sewer District "S% along the following described course within said district, as follows: Beginning at a new manhole over an existing 24" Sanitary Sewer in Front Street with an 8" V. C. P. Sewer; thence East in North Street, a distance of 1000 ft, more or less; thence northeast along the north side of the Missouri Pacific Railroad a distance of 700 ft. more or less, to a manhole to be constructed in Chester Avenue and end of sewer. Section 3. That the City Engineer shall on or before the tenth day of September 1945, prepare and file in the office of the City Clerk plans and specifications for the construction of the Main Sewer District "S" provided for in the preceding section of this ordinance, which shall be of the proper character and along the proper course and at the proper grade to serve the property lying within the district within which such sewer is to be construoted, and shall on or before said date, prepare and sub- mit to the Board of Commissioners detailed estimates, under oath, of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the city paper for sealed proposals, for the building and construction of such a sewer according to such plans and specifications, which proposal shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such a sewer to the lowest responsible bidder or bidders therefor; provided that such bidders shall not exceed the estimated cost thereof and provided further that said Board shall reserve the right to refuse any and all such proposals; and that if no responsible bids shall be received within said estimated cost, said Board may proceed and build such sewer within such estisaated cost. I i Section 4. That for the cost of building and constructing such a sewer, special assessments shall be made for the full cost thereof, on all lots or pieces i i of land within the Main Sewer District within which such main sewer shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 5. After the passage and publication of this Ordinance, the Board of Commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such iwprovements, shall within five days i after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such district, liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the Board of Commissioners of said City and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session t due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, i the same had been appraised too high or too low. Section 6. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual installments but the o pp Y q caner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improvements, and bonds as hereinafter provided for, and shall not be liable for any assessment for the cost of such improvements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such i !provements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and iap rovements in this Ordinance provided for, the Board of Commissioners are hereby authorised and directed to issue improvement bonds of the City of Salina in the amount not to exceed the cost of such improvement, and to run for a period of ten years and be payable in ten approximately equal annual installments, together with interest not to exceed 5 per cent per annum, which bonds shall be issued and payable according to law; and for i the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such i_.provemients, special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and apportion- ment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual in- stallments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk of Saline County Kansas, a full list of all property liable for such work and improvements$ together with the respective amounts due on each of said tracts, piece or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5 per cent per annum, on such amounts so certified, which shall be collected as other tastes are collected.
