AN ORDINANCE ratifying and confirming a contract with The H. J. Taylor Construction
Company for the construction of a certain Lateral Sanitary Sewer in
Lateral Sanitary Sewer District No. 202, so oreated, providing for the
cost thereof and for the levying of special assessments against the
property in said distfiet for the payment of such construction and
for the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, of the proposal of H. J.
Taylor d/b/a The H. J. Taylor Construction Company, hereinafter referred to as "the
contractor", as submitted to the Board of Commissioners on the 25th day of June, 1945,
which is hereby found and determined to be the lowest and best bid for such work, and
the contract awarded by the Board of Commissioners of said city to said contractor and
signed on behalf of the City by its Mayor on the 2nd day of July, 1945, for the con-
struction of said public improvements in the City of Salina, to -wits
A Lateral Sanitary Seiner in a certain benefit district No. 202, being Lots 1
to 20, inclusive, Block 4; Lots 1 to 20, inclusive, Block 9; Lots 1 to 20,
Block 16; Lots 1 to 20, inclusive, Block 21; Lots 1 to 32, inclusive, Block
25, all in the Episcopal Military Institute Addition; as provided in Ordinance
No. 5087 and beginning at an existing manhold in Pacific Addition at its inter-
section with the alley east of Fifth Street; thence running north a distance
of 2600 feet to end of sewers
at and for the unit price for said work contained in said prposal,which proposal and
construction are hereby referred to and made a part of this ordinance, be and the
same is hereby ratified and confirmed, said proposal being within the estinit ed cost
of said improvements as shown by the sworn estimates of the City Engineer on file in
the office of the City Clerk, which estimates are hereby referred to and made a part
of this Ordinance.
Section 2. That said improvements shall be built and constructed in accordance
with the plans and specifications therefor, prepared by the City Engineer, on file
in the office of the City Clerk, and in accordance with the proposals of said con-
tractor and under the terms of said contract, all of vhich are hereby referred to
and made a part of this ordinanoe.
Section % That temporary notes, signed by the Mayor and attested by the City
Clerk, be issued from time to time as the work progresses in the manner and form re-
quired by law, the total amount thereof not to wcoeed the contract price for such
work, such notes to bear interest not to exceed if per cent per annum and to mature
not later than November 1, 1945, to be issued in such amounts and at such time as
money for the payment of the cost of such work may be required, such notes to be
issued to said contractor and to be redeemed and cancelled at the time the permanent
bonds are issued in lieu thereof,
Section 4. This Ordinance is to take effect and be in force from and after its
publication in the City paper.
