5091 Condemn Easement Pacific Addition1 1 1 ORDINANCE NO. 5091 (Published in the Salina Journal L� 1945) I I i ATt ORDLNANCE providing for the condemning of an easement in the east 15 feet of j Lot 5, Block 19, Pacific Addition, for the purpose of constructing, maintain- ing, repairing and replacing a Lateral Sanitary sewer through Lot 5, Block 19, Pacific Addition. WHEREAS, upon a petition of property owners and the recommendation of the City Manager, the Board of Commissioners have ordered the construction of a Lateral and Eleventh Streets from Lincoln Avenue to Grand Sanitary Sewer between Tenth Avenue; and, VvIIEREAS, by Ordinance No. 5078, duly passed and published, a Lateral Sanitary Serer District No. 203 was created and defined as: Lots Five, Six and Seven (5, 6 and 7) Block 19, Pacific Addition, and Lots One to Eighteen (1 to 18) inclusive, Block 1, Crowther's Addition, the location of the sewer therein as beginning at a new manhole on an existing sewer main in Grand Avenue between Tenth and Eleventh Streets, thence running south through Lot 5, Block 19, Pacific Addition, and in the alley between Tenth and Eleventh Streets, a total distance of 600 feet, more or less, to a cleanout and end of sewer; and VHEREAS, pursuant to a notice published in THE 81LIiNIA JOURNAL, bids were received for construction of Lateral Sanitary Sewer District No. 203 by H. J. Taylor Con- struction Company, and said bid was accepted and the awarding of contract was de- ferred; and WHEREAS, in order to construct said Lateral Sanitary Sewer it is necessary to obtain an easement in a strip of land 15 feet wide, being the east 15 feet of Lot 5, Block 19, Pacific Addition, all for the right of ingress and egress by the City of Salina, its servants, officers, employees and contractors therefor, for the purpose of constructing, maintaining, repairing and replacing said sewer and all connections, manholes, flush tanks and other appurtenances thereto in accordance with plans and specifications now on file in the office of the City Clerk of the City of Salina; and WHEREAS, the owner of said premises will not donate or sell an easement in said real estate for the purposes aforesaid; NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. The following described land is hereby condemned and appropriated for the use of the City of Salina, Kansas, for the purpose of constructing a lateral sanitary sewer betvreen Tenth and Eleventh from Grand Avenue to L_Lncoln Avenue: An easement in - The East 15 feet of Lot 5, Block 19, Pacific Addition all for the right of ingress and egress by the City of Salina, its servants, officers, employees and contractors for the purpose of constructing, main- taining, repairing and replaci.hg said sewer and all connections, manholes, flush tanks and other appurtenances thereto in accordance vrith plans and speci- fications now on file in the office of the City Clerk of Salina. Section 2. The City Attorney of said city is hereby ordered and directed to forthwith prepare and present in the name of the Board of Commissioners a written application to the Judge of the District Court of Saline County, Kansas, i praying for an order of appointment of Commissioners to make appraisement and assessment of damages arising from the appropriation of said real estate and do and perform all things in and about the procuring and recording of said order of appointment required by law. Section 3. It is found that the following property will be benefited: Lots Five and Six and Seven (5, 6 and 7) Block 17, Pacific Addition, and Lots One to Eighteen (I to 18) inclusive, Block 1, Crowther's Addition. Section 4. This Ordinance shall take effect and be in force from and after its passage and publication in The Salina Journal Introduced, June 11, 1945 Passed, June 18, 1945 J. H.
