AN ORDINANCE granting to Union Pacific Railroad Company, its successors and
assigns, the right to extend, construct, maintain and operate certain
switch tracks in Fourth Street, and across Walnut Street, in the City
of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That Union Pacific Railroad Corj.pany, its successors and assigns,
be and it is hereby granted the right to extend and construct a switch track, and
to maintain and operate the same, and to run its cars, engines and trains thereon,
from the south end of the present switch track which runs in and along the west
side of Fourth Street in said city between Iron Avenue and Walnut Street, thence
south in Fourth Street, in and along the west side thereof, and across Walnut
Street, to a point 350 feet south of the south line of Walnut Street, and west of
the present curb line along the west side of Fourth Street, in the space now occupied
by the par1nmy and sidewalk.
Section 2. The grant given by Section 1 of this ordinance is upon condition
that said tracks shall be constructed, maintained and operated in accordance with
the Laws of the State of Kansas and the ordinances of the City of Salina, now in
force or hereafter adopted, and at a grade to be fixed or approved by the City
Engineer of said city, and that where such tracks cross Walnut Street all paving,
sitrmlks, crossings and drainage affected by said track, or which as now existing
or hereafter provided for affect such track, shall be constructed and maintained by
said grantee and its successors and assigns in such manlier as may be reouired by
the governing body of said city.
Section 3. The exercise by grantee of any of the rights granted by this
ordinance shall constitute an acceptance by said grantee, its successors and
assigns, of all of the conditions and provisions of this ordinance.
