5088 Confirm Street ImprovementsORDINANCE N0. 5088 (First published in the Salina Journal 1945) _ ------ . _- AN AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction Company for construction of certain curbing and guttering improvements on West Place from Park to Elm; Kansas Avenue from Ash to Elm; Kansas Avenue from a point 500 feet north of Elm to Riverside Drive; Franklin enue from Sheridan to Custer; Franklin Avenue from Sheridan to Merrill; Front Street from Ash to Elm; and Venango t��ree� from Sheridan to Merrill; and pr vid ni g for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of J. H. Taylor, d/b/a The H. J. Taylor Construction Company, hereinafter referred to as "the contractor" was submitted to the Board of Commissioners on the 28th day of May, 1945, for the construction of said public improvements in the City of Salina, to -wit; Curbing and guttering improvements on West Place from Park to Elm; Park Avenue from Ash to Elm; Kansas A enue from a point 500 feet north of Elm to Riverside Drive; Franklin Avenue from Sheridan to Custer; Franklin Avenue from Sheridan to Merrill; Front Street from Ash to Elm; and Venango Street from Sheridan to Merrill, as provided in Ordinance No. 5081, at and for the unit price for sa d work contained in said proposal, which proposal and contract are hereby referred to and made a part of the Ordinance, be and the swne is hereby ratified and confirmed, said proposal being within the estimated cost of the said Lp rove- ments as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which esti ates are hereby referred to and made a part of this ordinance. Section 2. The improvements shall be built and constructed according to the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of tivhich are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the mayor and attested by the City Clerk, be issued from time to tune as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed five per cent per annum and to mature not later than September 1, 1945, and to be issued in such amounts and at such ti::e as money for the payment of the cost of such work may be re- quired, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in force from and aftee its publication in the official city paper. Introduced, June 4, 1945 Passed, June 11, 1945. J. H.
