5084 Issue GO Bonds, Series P-132ORDINANCE N0. 5084 (Published in the Salina Journal - 1945) --- _ . -- - - - — -- ---- - - - .. - --- --- AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, Kansas in the sum of $5714.98, to pay the cost of iluprovirg certain streets in said city to be designated as Series P-132. WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following streets improvements in the City of Salina, Kansas, to -wit: Curbing, guttering and grading of Claflin Avenue from the west line of Ninth Street west approximately 1016 eet to the west line of Lot 13, Block 1, Evergreen Park Addition; Curbing, guttering and grading of Merrill Street from the south line of Wilson Street to the north line of Republ'ic71venue; Curbing, guttering and grading of Pershing Street from the south line of Jewell Avenue to the north line of Ki n A4enue; Curbing, guttering and grading North side of Republic Avenue, from the west line of Sheridan Street to the east line R Hancoc Street; Curbing, guttering and grading of Spruce Street from the west line of College Avenue to the east line oft7e—Ussos Pacific Railroad right- of-way; Curbing, guttering and grading of Spruce Street from the east line of College Avenue to the w est line o Phillips Street; all as provided in Ordinance No. 5051; and WHEREAS, the total cost of said improvements has been ascertained and the portion thereof in the amount of $892.71 to be paid by general taxes to be levied upon all the taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city for which the city is liable, and for which the city is paying cash; and WHEREAS, the total cost of said curbing and guttering and grading of said streets which are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering and grading in said streets has been ascertained and has been hereby found and determined to be the sum of $7446.18, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law provided for in the ordinance of the City of Salina, Kansas, relating thereto, duly passed and approved, of which amount the sum of $1731.20 has been paid by the property owners liable therefore, leaving a balance of $5714.98 for which bonds are to be issued. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby authorized as a part of this ordinance and that for the purpose of providing funds to pay the cost of the improvements herein above referred to and described in the Ordinances and Resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, iii the total principal sum of $5714.98, which shall consist of 12 bonds numbered from 1 to 12 inclusive, all dated April 1st, 1945, which shall bear interest at the rate of One (1%) per cent per annum from and after saiddate until the respective maturities of said bonds, payable semi-annually on October 1st and April 1st of each year, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as follows; No. 1 for $214.98 and Nos. 2 and 3, $500.00 each, due April 1, 1946 Nos. 4, 5 and 6 for $500.00 each, due April 10 1947 Nos. 7, 8 and 9 for $500.00 each, due April 1, 1948 Nos. 10, 11 and 12 for $500.00 each, due April 1, 1949 Section 2. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed I I or lithographed facsimile signature of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State, as required by law. Section 3. Said bonds shall be designated as Series P-132 and shall be in the form and shall contain recitals required by law and as provided by Resolution 878 duly adopted. i Section 4. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and when duly executed and registered to deliver said bonds to the purchaser or purchasers thereof. i Section 5. The full faith, credit and resources of the City of Salina, w Kansas, shall be, and the same are hereby irtrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provision for the payment of the principal and interest on said bonds as the same b eco:_:e due by levying taxes i and assessments upon the property liable therefore as provided by law.
