AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction
Ca?apa?y, for the construction of certain paving and grading improvements on
Park Street in the City of Salina, Kansas and providing for the issuance of
temporary notes to pay the cost thereof pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, of the proposal of H. J.
Taylor, d/b/a/ H. J. Taylor Construction Company, hereinafter referred to as
"contractor" as submitted to the Board of Co xrd ssioners on the 16th day of January
19452 which is hereby found and determining to be the lowest and best bid for such
work and the contract awarded by the Board of Commissioners, of said city to said
contractor and signed on behalf of the city by its mayor on January 16, 1945, for
the construction of certain public improvements in the City of Salina, to -wit:
Paving and grading of Park Street from the Missouri -Pacific Railroad
tracks, east approximately 45 feet to join the existing brick pavement
as provided in Ordinance No. 5073 at and for the unit price for said work contained
in said proposal, which proposal and contract are hereby referred to and made a part
of the Ordinance, be and the same is hereby ratified and confirmed, said proposal
being within the estimate cost of the said improvements as shown by the sworn estimates
of the City Engineer on file in the office of the City Clerk, which estih-a.tes are hereby
referred to and made a part of this ordinance.
Section 2. The improvements shall be built and constructed according to the plans
and specifications therefor prepared by the City Engineer on file in the office of the
City Clerk and in accordance with the proposal of said contractor and under the term
of said contract, all of which are hereby referred to and made parts of this ordinance.
Section 3. That temporary notes signed by the mayor and attested by the City
Clerk, be issued from time to time as the work progresses in the manner and form as
required by law, the total amount thereof not to exceed the contract price for such
work, such notes to bear interest not to exceed five percent per annum and to mature
not later than April 1, 1945, and to be issued in such amounts and at such tine as
money for the payment of the cost of such work may be required, such notes to be
issued to said contractor and to be redeemed and cancelled at the time that permanent
bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after its
publication in the official city paper.
