5075 Confirm Utility Imp Southern Heights AddP ORDINANCE N0. 5075 (Published in the Salina Journal January_20, 1945)__ AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction CoL-Vany, for the construction of a certain lateral sanitary sewer in lateral sanitary sewer district No. 199, in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds: BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section le That the acceptance by the City of Salina, of the proposal of He J. Taylor, d/b/a The H. J. Taylor Construction Company, hereinafter referred to as the "contractor",has submitted to the Board of Commissioners on the 8th day of January 1945, which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by its Mayor on January 8, 1945, for the construction of certain public improvements in the City of Salina, to -wit: A lateral sanitary sewer in a certain benefit district No. 199, being Lots 1-8 inclusive, Block 15; Lots 9-16 inclusive, Block 14; Lots 1-11 inclusive, Block 16; Lots 12-22 inclusive, Block 17; Lots 13-24 inclusive, Block 23 and Lots 1-12 inclusive, Block 24, all in Southern Heights Addition in the City of Salina, Saline County, Kansas, as provided in Ordinance No. 5072 and beginning at an existing sanitary sewer manhole in the intersection of Venango and Hancock Streets; thence continuing south in Hancock Street as a 8" sanitary sewer to a manhole at the intersection of the north property line of Republic and Hancock Streets, which is the end of the sewer; at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this Ordinance, be and the sane is hereby ratified and confirmed, said proposal be within the estimated -..Dost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, vj.ich a stizates are hereby referred to and made a part of this ordinance. Section 2. Said impfovements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and iiade parts of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk, be issued from time to time as the work progresses in the manner and form as required by law, the tonal amount thereof not to exceed the contract price for such work, such notes to bear inter-st not to exceed five per cent per annum and to mature not later than April 1, 1945, are to be issued in such amounts and at such time as money for the payment of the cost of such vmork may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This Ordinance shall take effect and be in force from and after its publication in the official city paper. Introduced January 8, 1945 Passed, January 16, 1945 Attest: Chas. E.
