AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction
Company for the construction of certain paving and grading improvements on
certain streets in the City of Salina and providing for the issuance of
temporary notes to pay the cost thereof pending the issuance and sale of
bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas=
Section 1. That the acceptance by the City of Salina of the proposal of
H. J. Taylor, d/b/a the H. J. Taylor Construction Company, hereinafter referred to as
the "contractor" as submitted to the Board of Commissioners on the second day of October
1944, which is hereby found and determined to be the lowest and best bid for such work,
and the contract awarded by the Board of Commissioners of said city to said contractor
and signed on behalf of the City by its Nhyor on October 2, 1944, for the construction
of certain public improvements in the City of Salina, to -wits
Paving and grading of Highland Circle from the north line of Beloit Avenue
to the south line of Republic Avenue, as provided in Ordinance No. 5063.
Paving and grading of Republic Avenue from the west line of Sherman Avenue
to the west line of Eleventh Street, as provided in Ordinance No. 5063, at and for
the unit price for said work contained in said proposal, which proposal and contract
are hereby referred to and made a part of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improve-
ments as shown by the sworn estimates of the City ngineer on file in the office of the
City Clerk, which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance
with the plans and specifications therefor prepared by the City %gineer on file in
the office of the City Clerk and in accordance with the proposal of said contractor
and under the terms of said contract, all of which are hereby referred to and made
parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk
be issued from time to time as the work progresses in the manner and form as required by
law, the total amount thereof not to exceed the contract price for such work, such notes
to bear interest not to exceed 1% per annum and to mature not later than December 18th
1944, and to be issued in such amounts and at such time as money for the payment of the
cost of such work may be required, such notes to be issued to said contractor and to be
redemmed and cancelled at the time that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after
its publication in the official city paper.
