AN ORDINANCE creating and defining certain Lateral Sanitary Sewer Districts in the City
of Salina designated as Lateral Sanitary Sewer Districts No. 196 and 197 so created,
and providing for the cost thereof and for the levying of special assessments
against the property in said district for the payment of such oonstructiot and for
the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District No. 196. That there be and there is
hereby created a lateral sanitary sewer district in the City of Salina which shall be
designated as Lateral Sanitary Sewer District No. 196, and which shall include all of
the following described property in the City of Salina, to -wit:
Lots 1 to 10 inclusive, 13 and 14, and 18 to 21 inclusive of Block 1,
Evergreen Park Addition.
Lots 1 to 11 inclusive of Block 1, Evergreen Park Addition Replat Lots 1 to
4 inclusive, Block 4, Evergreen Park Addition. all in the City of Salina,
Saline County, Kansas.
Section 2. That it is necessary and it is hereby ordered that a lateral sanitary
sewer with all necessary connections, manholes, flush tanks and other appurtenances be
constructed and built in and to serve said Lateral Sanitary Sewer District No. 196,
beginning at an existing manhole in the alley between Claflin and Kirwin approximately
106 feet east of property line of Pershing and 3 feet east of the lot line of;Lot 2,

Beverly Manor Addition; thence south parallel to and 3 feet east of Lots 2, 3 and 4
Beverly 4nor Addition as an 8" sewer a distance of 165 feet, more or less, to a manhole
in Claflin Avenue; thence east along Claflin ,(venue 118 feet, more or less, to a manhole
at the intersection of Claflin and Eleventh; thence south in Eleventh Street 169 feet,
more or less, to a manhole at the alley between Claflin and Woodlawn thence east 727 feet
to a manhole at the intersection of alleys between Claflin and "oodlawn and Ninth and
Eleventh; thence north and south in alley 68 feet, more or less, each direction as a 6"
sewer to dead ends.
Section 3, Lateral Sanitary Sewer District No. 197. That there be and there is
hereby created a lateral sanitary sewer district in the City of Salina which shall be
designated as Lateral Sanitary Sewer District No. 197, and which shall include the
following described property in the City of Salina, to -wit:
Lots 5, 6, 13 and 14, Block 2, Evergreen Park Addition
Lots 1 to 26 inclusive, Block 2, Evergreen Addition Replat Lots 1 to 4 inclusive,
Block 3 Evergreen Park Addition. All in the City of Salina, Saline aunty,
Kansas.
Section 4. That it is necessary and it is hereby ordered that a lateral sanitary
sewer with all necessary connections, manholes, flush tanks and other appurtenances be
constructed and built in and to serve said Lateral Sanitary Sewer District No. 197
beginning at a manhole at the intersection of Eleventh Street and alley between Claflin
Avenue and Woodlawn on lateral sanitary sewer No. 196; thence south in Eleventh Street
as an 8" sewer 330 feet, more or less, to a manhole at the intersection of alley south of
Woodlawn; thence east in alley 727 feet, more or less, to a manhole at the intersection
of alleys north and south and east and west; thence north and south in alley 68 feet,
more or less, each direction as a 6" sewer to dead ends.
Section 5. That theCity Engineer shall on or before October 9th 1944, prepare
and file in the office of the City Clerk plans and specifications for the constfuetion
of the Lateral Sanitary Sewer provided for in the preceding sections of this ordinance
which shall be of proper character to serve the property lying within the district
within which such sewer is to be constructed and shall on or before the same date
prepare and submit to the Board of Commissioners detailed estimates under oath of the
cost thereof. That thereafter the City Clerk shall advertise for three consecutive
days in the official city paper for sealed proposals for the building and construction
of such sewer according to such plans and specifications, which proposals shall be
filed with the City Clerk on or before the time fixed in such notice, at which time
the Board of Commissioners may let a contract for the building and construction of
such sewer to the lowest and best responsible bidder therefor, if there be any w#ose
bid does not exceed the estimated cost thereof, but said Board will reserve the right
to reject any or all such proposals, and if no bid shall be received within such es-
timate, the Board of Commissioners shall have the power to do such work and make such
improvements within the estimated cost thereof as provided by law.
Section 6. That for the cost of building and constructing such sewers special
assessments shall be made for the full cost thereof en All lots or pieces of land with-
in the sewer district within and for which such sewer shall be built, according to the
appraised value thereof, without regard to the improvements or buildings thereon.
Section 7. After the passage and publication of this ordinance, the Board
of Commissioners shall appoint three disinterested appraisers, who after having taken
an oath to make a true and impartial appraisement of all lots or pieces of land liable
to taxation for the cost of such improvements, shall within five days after having been
notified of their appointment proceed to appraise all of the lots or pieces of land
within such district liable to assessment and taxation as aforesaid, without regard to

the building or improvements thereon, and after making said appraisements shall re-
turn the same to the Board of Commissioners of said city and said Board shall designate
a tine for holding a special meeting of said Board for the purpose of hearing any
complaints that may be made as to the value of any lot or piece of land appraised as
aforesaid, of which special session due notice shall be given in the official city
paper, and at which special session said Board may alter any valuation of any lot or
piece of land, if, in their opinion, the same had been appraised too high or too low.
Section 6. The special assessments herein provided for may be paid by the
person liable therefor in four approximately equal annual instalments but the owner
of any property liable to such assessment may within thirty days from the date of
determining the amount assessed against his property pay the same in full and his
property shall not be liable for any assessments for the cost of such improvements,
and bonds as hereinafter provided for shall be issued for the amount of the cost of
such improvements remaining unpaid at the end of thirty days from the title such assess-
ment is fixed.
Section 9. For the purpose of paying for the work and Laprovements in this ordin-
anee provided for, the Board of Commissioners are hereby authorised and directed to issue
improvement bonds of the City of Salina in an amount not to exceed the cost of such
improvements, and to run for a period of four years and be payable in four approximately
equal annual instalments, together with interest not to exceed four per cent per annum
which bonds shall be issued and payable according to law; and for the purpose of paying
the principal and interest on said bonds as they severally become due and payable, the
Board of Commissioners shall apportion and assess against the lots or pieces of land with-
in the taxing distridts of such improvements, special assessnmts covering the cost of such
improvements and the apportionment therein contained shall hold good for all of the instal•
ments that are to be collected from the specific property chargeable with said improvements,
such assessment and apportionment ordinance shall contain the total amount of tax appor-
tionedto each tract, piece or parcel of land within the taxing districts and shall state
the number of annual instalments in which such tax is to be collected; and thereafter the
City Clerk shall annually, at the same time other taxes are certified, certify to the
County Clerk of .Salina County, Kansas, a full list of all property liable for such work
and improvements, together with the respective amounts due on each of said tracts, pieces
or parcels of land, which amounts shall include the annual instalments and interest on all
unpaid balances for one year at the rate of not to exceed four per cent per annum, on
such amounts so certified, which shall be collected as other taxes are collected.
Section 10. This ordinance shall take effect and be in full force From and after
its publication in the official city paper.

Section 5. That the City Engineer shall on or before October 9th
