5055 Issue GO Bonds, Series P-129ORDINANCE NO. 5055

AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the
City of Salina, Kansas, in the sum of $6,197.19 to pay the cost of improving
certain streets in said city to be designated as Series P-129.
WHEREAS, pursuant to proceedings duly and according to law contracts have been let
and performed for the construction of the following street improvements in the City
of -�ialina, Kansas, to -wit:
Curbing and guttering and grading of College Avenue from the south line of
Morrison Avenue to the North line of Prescott Avenue as provided in Ordinance '5036;
Curbing and guttering and grading of Montrose Avenue froia the sout# line of
Morrison Avenue to the north line of Prescott Avenue as provided for by Ordinance
#5036;
Curbing and guttering and grading of Tenth Street from the south line of Wilson
Street to the north line of Republic Avenue as provided for by Ordinanoe #5056; and
WHEREAS, the total cost of said improvements has been ascertained and the total
portion thereof to be paid by general taxes to be levied upon all the taxable
property within said city for the is=,provement of squares and areas formed by the
crossing of streets and alleys and for the improvement of any of said streets where
the same is through or adjacent to property of the city .for which the City is liable,
and for which bonds shall be issued as hereinafter provided; has been ascertained
and is hereby determined and found to be the sum of $929.88; and,
WHEREAS, the total cost of said curbing and guttering and grading of said streets
which are to be paid by special assessments and to be levied upon lots and pieces
of ground liable for the payment of said curbing and guttering and grading in said
streets has been ascertained and has been hereby found and determined to be the sum
of #6,256.53, which amount has been heretofore duly assessed and apportioned to the
several lots and pieces of ground liable therefore according to law provided for in
the Ordinances of the City of Salina, Kansas, relating thereto, duly passed and
approved, of which amount the sum of $59.34 has been paid by the property owners
liable therefore, leaving a balance of $6,197.19 for which bonds are to be issued
in the sum of $6,197.19; NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles be and they are hereby authorised as a
part of this Ordinance and t.zat for the purpose of providing funds to pay the cost
of the improvements herein above referred to and described in the Ordinances and
Resolutions hereinbefore referred to, there shall be issued Internal Improvement
Bonds of the City of Salina, Kansas, in the total principal sum of $6,197.19 which
shall consist of four bonds nixabered from one to four, inclusive, all dated May 1,
1944, which shall bear interest at the rate of one and one-quarter (14%) per cent
per annum from and after said date until the respective maturities of said bonds,
payable semi-annually on Novanber 1st and May 1st of each year, said interest to
be evidenced by interest ooupins as herein provided for and said bonds shall become
due as followas
Bond No. 1 for $1697.19 due May 1, 1945
Bond No. 2 for $1500.00 due May 1, 1946
Bond No. 3 for $1500.00 due May 1, 1947
Bond No. 4 for $1500.00 due May 1, 1948
Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
signatures of the City Clerk and corporate seal of the City shall be affixed thereto
and said bonds shall have attached thereto interest coupons representing the interest
thereon, which coupons shall be in the form provided by law and shall bear the printed
or lighographed facsimile signature of the Mayor and City Clerk of said City and said
bonds and interest coupons shall be registered in the office of the City Clerk and in
the office of the Auditor of State, as required by law.
Section 3. Said bonds shall be designated as Series P-129 and shall be in
the form and shall contain recitals required by law and as provided by Resolution
1
#847 duly adopted.
Section 4. The Mayor and City Clerk are hereby authorised and directed to
j prepare and execute the bonds hereinbefore described and to advertise and sell
the same in the manner provided by law, and when duly executed and registered to
deliver said bonds to the purchaser or purchasers thereof.

Section 5. The full faith, credit and resources of the City of Salina, Kansas,
shall be, and the same are hereby irrevocably pledged for the prompt payment of

said bonds and all interest thereon. The Board of Commissinners of the City of
Salina, Kansas, shall annually make provision for the payment of the principal

and interest on said bonds as the same become due by levying taxes and assessments
upon the property liable therefor as provided by law.
Section 6. This ordinance shall take effect and be in force from and after
its publication in the official city paper.
