5042 Occupational LicensesOrdinance No. 5042 (Published in the Salina Journal December 31, 1943) AN ORDINANCE providing for the levying of an occupational and license tax upon, and the regulation of certain callings, trades, professions, businesses and occupations hereinafter specified, which are conducted, pursued, carried on and operated with- in the City of Salina; providing penalties for the violation of its terms and re- pealing Ordinances No. 2640, 1668, 1688, 2366, 1741, 5022, 5027, 2226, 2504, 3225, 3313, 3651, 4075, 3425, and 3139. BE IT ORDAINED by the board of Commissioners of the City of Salina, Kansas: Section 1. Licenses required. That from and after the passage and publication of this ordinance, it shall be unlawful for any person, firm, or corporation, either as principal, officer, agent, servant or employees: (a) To conduct, pursue, carry on and operate in the City of Salina, Kansas, any of the callings,trades, professions, businesses or occupations hereinafter specified without having first paid to the City treasurer an occupation and license tax as herein- after prescribed, and having procured a license to engage in and carry on such calling, trace, profession, business or occupation. (b) To fail to comply with all of the regulations as provided hereinl Section 2. Amount of License. That the license tax hereby imposed and levied shall be in the following amounts and upon each of the following callin8s, trades, professions, businesses, or occupations conducted, pursued, carried on or operated by any person, firm, partnership or corporation, whether as principal, agent, lessee, licensee, owner, or in any other capacity within the city limits of the City of Salina, Kansas. (1) Auctioneers. Auctioneers, not including the proprietors or managers of auction rooms, $25.00 per annum. (2) Auction Rooms. Operators of Auction rooms, $500.00 per annum (3) Auction Sales. Any person conducting auction sales, $50.00 for each thirty (30) days. (As regulated by Ordinance No. 4951) (4) Bowling Alleys, For the operation of bowling alleys, the license shall be $7.50 per alley, for each sic (6) months. (5) Canvassers. Itinerant or transient canvasser_, or b, -k, map or picture agents, or salesnen, $10.00 per week. (6) Circuses, Carnivals and Tent *bows. (a) For every day upon which any circus is operated within the City of Salina, the sum of $75.00: (b) For every day upon which any carnival is operated within the City of Salina, the sum of $25.00; Provided, that if only riding devices are operated in connection with such carnival, the license tax shall be $10.00 per day; (c) For every day upon which any tent show is operated within the City of Salina, the sum of $25.00; Provided, that the license tax for one or more weeks shall be $60.00 per week. (as regulated and defined by Ordinance No. 4421) (7) Corn Doctors. Corn doctors, or chiropodists, not residents of Salina, $1.00 per day, $5.00 per week. (8) Dances, public. For one (1) year $100.00. six (6) months, $50.00; for a single night $3.00. (as regulted and defined by ordinance No. 4563 and No. 2414.) (9) Doctors, Dentists, Oculists and Opticians. Itinerant or transient doctors, dentists, oculists, opticians or surgeons practicing such profession or occupation, 010.00 per day. i i (10) Express Copa:.ies. The sum of 420.00 per year on tree business and occupation of express companies, corporations or agencies, in receiving packages i i in this city from persons in the city and transmitting the same by express from ithis city within this state to persons and places within the State of Kansas; and receiving in this city packages by express transmitted within this state from persons and places in this state to persons within the city and delivering the same to persons in this city; excepting the receipt, transmission and delivery i of any such packages to and from any department agency, or agent of the United States, and excepting the receipt, transmission and delivery of any such packages ,^rnich are interstate commerce; the business and occupation of receiving, trans- iA ting and delivering of the packages herein excepted is net taxed hereby. r (11) Fortune Tellers, Astrolcgists, Palmists and similar professionalists; Any person occupied for any time as a fortune teller, clairvoyant, mind reader, phrenologist, palmist, astrologist, or advertising as any ofsuch, 0-25.00 per day. (12) Goods on Streets. Soliciting business or exhibiting goods, wares and merchandise, or samples of the same on the streets or adjacent thereto or in any public place in the City of Salina, or selling or offering to sell gcods in con- nection with such exhibition, by any transient or itinerant proprietor, agent or vendor, $25.00 per week. (13) Insurance Companies: Insurance companies, agents or agencies, surety bonding companies, agents or agencies handling and writing in the City of Salina, any kind or manner of insurance or surety bonds, $10.00 per annum for each in- surance company or bonding company so represented, excepting however, that no insurance company or agent or agencies representing the same, and engaged solely in writing fire, lightning, or torando insurance either separately or combined, shall be obliged to pay any license fee whatsoever and provided further that no insurance company organized and existing under the laws of the State of Kansas, and having its principal office or place of business at the City of Salina therein, shall be obligated to obtain any license for the transaction of its business or to pay license fee in regard to the transaction thereof. (14) Itinerant vendors of patent or proprietary medicines or nostrums: Itinerant or transient vendors of any patent medicine or proprietary medicine, nostrums, or other articles, $25.00 per week. Provided that no license shall be issued to any person to sell or peddle drugs or medicines within the City until such person shall have furnished satisfactory proof that he has complied with the pharmacy laws of the State of Kansas. (15) hMseums. Museums, for the exhibition of paintings, works of art, or scientific, literary, or other curiosities, for pay, 42.00 per day, $84100 per week. (16) Nickelodeons or Music Machines: Gn any person owning, leasing, or operating a nickelodeon, music playing machine or any similar device, 07.50 each six (6) months for each machine. (17) Opera Houses, Theatres: On each opera house or theatre, (a) with an avail- able seating capacity of 550 or less, $75.00 per annum; (b) with an available seating capacity of 551 to 750, both inclusive, #100.00 per annum; (c) with an available seating capacity of 751 or more, $125.00 per annum. (18) Orders, future delivery. Itinerant or transient persons soliciting or can- vassing for orders for future delivery of goods, wares, or merchandise by themselves or by others, from stock not carried in the City of Salina, j25.00 per week. (19) Pawnbrokers. Paunbrokers, or loaners of money on pledged security or property, or purchases of personal property granting options of re -purchase, a tax in the sum of Five Hundred Dollars ($p500.00) per annum. (20) Peddlers of Clothing, Textile Fabrics, Shoes and Home Furnishings. Itinerant or transient peddlers or vendors of ready-made clothing, textile fabrics, boots or shoes or home furnishing goods of any kind, 425.00 per week when sold from a wagon or vehicle of any kind, $$3.00 per day, 315.00 per week, when carried by the person selling the same. No license shall be issued to anyone to sell any such articles from a stand upon any street in the city. (21) Peddlers, transient or itinerant. Transient or itinerant peddlers, hawkers, or vendors of any goods, wares, or merchandise or solicitors or canvassers for the sale of the same, not otherwise provided for in this ordinance, 425.00 per week. (22) Pin Ball game, marble table game, marble game, amusement devices and similar games and devices. For the operation of any pin ball game, marble table game, marble game, amusement devices, and similar games and devices, whether operated in whole or in part by hand or by sight or by photo -electric cell, $75.00 per annum on each machine operated for any length of time each annum. (23) Photographers. Itinerant or transient photographers soliciting business or taking pictures and selling the same in the city 015.00 per week. (23-a) Pool or Billiard Table. On each pool or billiard table, the license tax shall be $7.50 for each six (6) months. (24) Retail and Wholesale Hucksters; Peddlers. A retail huckster is defined for the purpose of this ordinance as a person, firm or corporation driving or going from residence to residence selling at retail, vegetables, fruit or garden truck of any kind which he has previously bought for the purpose of selling in such manner, and the license tax therefor shall be $$1.00 per day or $20.00 per year if on foot or by push cart; $2.00 per day or $$40.00 per year if by motor vehicle. 1 C I A wholesale huckster is defined for the purpose of this ordinance as a person, firm or corporation that drives or goes from place to place and sells to merchants, retail hucksters, or other persons, at wholesale, vegetables, fruit or garden truck and the license tax therefor shall be $25.00 per day or 4200.00 per year. i t A peddler is defined for the purpose of this ordinance as a p p p person, firm or i corporation that drives or goes from residence to residence or from place to place selling retail goods, wares or merchandise other than vegetables, fruits or garden truck and who does not come within the provisions of any other ordinance now in effect, or any solicitor or canvasser for the sale of the same and the license tax therefor shall be $25.00 per year or one-half thereof if a new business started after July 1st of any year. (25) Street or Sidewalk stands; On offering for sale upon any public street, sidewalk or alley any goods, wares, merchandise or foods $30.00 per year for each place of such offering for sale. (26) Sales; bankrupt; fire; receivers; and similar sales: Persons selling i or offering. for sale goods, wares or merchandise known as or advertised or designated i to be goods, wares or merchandise bought at fire sales, auction sales, manufacturer's loss sales, wreckage sales, sheriff's,creditor's assignee's, consignee's, bankrupt, special bargain or damaged goods' sales, or advertised in any manner for the purpose s of inducing customers or people to believe that such goods, wares or merchandise will be sold for a price or prices not exceeding the cost of production, or bankrupt or damaged stock of Coods not otherwise taxed, ,25.00 per day, payable in advance. This section shall apply to all stocks or goods that are not assessed or taxed in the City of Salina: Provided that this section shall not apply to goods, wares, or merchandise which are actually under the control of the sheriff, or an assignee or trustee in bankruptcy, or to goods, wares or merchandise which have been damaged in the City of Salina, and which are being disposed of in good faith to close out the same. (27) Sale of Clothing by sample. The occupation or business of taking orders for the delivery of tailor made or ready made clothing, from sauples displayed in said city, where a deposit of money is required when the order is taken and the balance of the price is to be collected when the merchandise is delivered C.C. D. by the United states Post Office Departnent or by any express company, or otherwise, shall pay a license tax of $25.00 per day. (28) Skating rinks. Skating rinks, $50.00 per annum; and no license shall be issued for less than one year. (29) Shooting gallery. The operation of a shooting gallery, an occupation tax as follows: $3.00 per day, 425.00 per month, or 450.00 per year. (30) Street Parades. All street parades and all persons walking or driving over the.streets of the City, advertising by means of printed banners, signs or streamers or by ringing bells, loud calling or announcements intended to attract the attention of people and for the ;�urpose of advertising any entertainment not otherwise named in this ordinance, $3.00 for each parade or advertising "stunt". (31) Street Vendors. Any street vendor for articles of merchandise, notions and the like, not otherwise mentioned in this ordinance, 45.00 per day. (32) Taxicabs and operators thereof. For each taxicab $30.00 per year and for an operator's license therefor, 01.00 per year. (As regulated and defined by ordinances numbered 1552; 1616; 1665; 1911; 3088; 4505; 4952; 5030; 5008; 5017; 5026.) Section 3, Applications. Any person, firm or coporation engaging in any of the trades, occupations or callings upon which the foregoing sections of this ordinance levies a license tax shall file an application with the City Clerk of the City of Salina, Kansas on or before January 2, 1944, for a license to carry on such trade, calling or occupation and that such application shall state the following facts: (1) The name and address of the applicant. (2)' The nature and location of the business. (3) If an amusement machine, a specific description thereof, and the location of the machine to be licensed. (4) If the applicant is not the owner thereof, the name of the owner must be stated. (5) That funds acco;iLpany the application to pay such license tax in full. Section 4. When taxes due. All license taxes by this ordinance im osed on certain trades, ca_lings and occupations on an annual basis, shall be payable on or before January second of each calendar year and such licenses shall be deemed to expire on December thirty-first of each calendar year. All license taxes herein provided for on a six-month bases shall be paid on or before January second and July first of each year. All license taxes herein provided for on a monthly basis shall be paid on the first day of each calendar month. All license taxes provided for in this ordinance on a weekly basis, shall be payable on Monday, the first business day of each week. Section 5. New businesses. Any person, firm or corporation entering into an occupation or trade or calling between license paying dates, shall immediately apply, pay for, and obtain a license on the same basis as though such person, firm or corpc.ra- tion was engaged in such business on such license paying dates. Section 6. Delinquencies. All licenses not paid within 30 days after date of ex- piration shall pay a penalty of 10% of the amount of the license fee and 10i� of the amount of the license fee shall be added for each additional 30 days form date of expiration. Section 7. License to be exhibited. Each license shall be posted in a conspicuous place where such business or occupation is carried on and the holder of such license shall immediately show such license to the license inspector or collector or his deputy or any police officer of the city upon being so requested by such inspector, deputy or officer to do so, provided that when #usic or amusement machines are licensed hereunder that such licenses shall be displayed on the licensed machine. 11 1 Section 8. Inspection. All such trades, professions, businesses and occupations, herein licensed shall be open and subject to inspection at all reasonable times, by the proper officers of the City of Salina, under its police powers, in order for i such officers to ascertain that persons conducting said trades, professions, businesses f i and occupations are complying with all of the police and 'health regulations of the f City of Salina. Section 9. Inspection of a License. All licensed persons, including their employees, not having a permanent location, shall carry their license with them and every person shall present his license for inspection when requested to do so by any I i officer of theCity of Salina. i Section 10. Payment. On and after the taking effect of this ordinance, any i person engaged in, or intending to engage in any calling, trade Profession, business or occupation upon which a license tax is levied by this ordinance shall pay the tax to the City Treasurer, who shall give a receipt therefor, stating the amount paid, the nature of the license desired, for Khat time and to whom to be issued, and if possible the exact location of office or headquarters, where such calling, trade, profession, business, or occupation is to be carried on. i Section 11. Not Transferable - No Refund. No license issued hereunder shall be transferable or assignable, and no refund shall be granted, The licensed trade, calling, occupation or machine shall not be transferred from place to place without the consent of the Board of Commissioners of the City of Salina, Kansas. j i Section 12. Separate License. A separate license shall be obtained for each j place of business conducted, operated, maintained or carried on by each person, firm I I or oorporation engaged in any occupation, calling or trade for Ahich a license is I required by this ordinance. i Section 13. Prosecution Now Pending. No prosecution now pending and no offense heretofore comm4-tted under ordinances heretofore enacted shall be affected 'in anyway by provisions of this ordinance but all such prosecution shall be conducted to final I judgment and all such offenses shall be prosecuted in the same manner as if this ordinance had not been enacted. j Section 14. Forfeiture of License. That any trade, business, profession, or occuption pursued, carried on or operated in the City of Salina, shall at all tunes be subject to such regulations as the Board of Commissioners shall from time to i time adopt; and any failure by any person, persons, company or c;,rporations to I observe such regulations shall without further action or proceedings of any kind whatsoever, forfeit the license of the person, persons, company or corporations failing to observe such regulations. Section 15. Penalty. Any person, firm or corporation which shall conduct, pursue j or carry on, or operate within the limits of the City of Salina, any calling, trade, i profession or occupation for which a license or the payment of a license tax is re- quired by the ordinance or shall assist directly or indirectly in so doing in any I l manner or any extent, either as owner or proprietor or as any officer of any corpora- tion, or as manager, superintendent, agent, servant, or employee of any person, firm or corporation, after a licens tax should have been paid, or a license obtained to conduct, pursue, carry on or operate such calling, trade, profession or occupation, shall be deemed to do so unlawfully,; and for such violation of this ordinance shall be deemed guilty of a misd-emeanor, and upon conviction shall be fined in any sum not less than Twenty Five Dollars (425.00), or not more than One Hundred Dollars (6100.00). Each days's violation shall be considered a separate offense. Any person, firm or corporation whether as principal or as agent which shall violate any other provisions of this ordinance than those Lmediately above enumerated, shall be gu-lty of a misdemeanor, and upon conviction, shall be fined in any sum not less than Twenty Five Dollars ($25.00), nor more than One Hundred Dollars (0100.00); and each day's violation will be considered a separate offense. Section 16. Penalty. In addition to the penalty described in Section 15 of triis ordinance, the City of Salina may recover in civil action in any court of conipetent jurisdiction the amount of the license tax by this ordinance imposed, and no property of such debtor shall be exempt from forced sale under any process of law for each indebtedness except such exemptions as are allowed by the Constit-tion of this State. Section 17. Saving Clause. That if any provision, term or requirement of this ordinance shall be determined to be unreasonable, illegal, unconstitztional or void, the same shall in no manner be held to eliminate, alter, annul, or restrict such provisions of this ordinance, as may be legal, constitutional, reasonable and valid. Section 18. Repealing Clause. That ordinance numbers 2640, 1668, 1688, 2366, 1741, 5022, 5027, 2226, 2504, 3043, 3225, 3313, 3651, 4075, 3425 and 3139, be, and they are hereby repealed. Section 19. Effective Date. This ordinance shall take effect and be in force from and after its passage and publication once in the official city pgper. Attest: Chas. E. Provided that no license shall be issued to any person to sell or peddle drugs or medicines within the City until such person shall have furnished satisfactory proof that he has complied with the pharmacy laws of the State of Kansas. (15) Museums, Museums, for the exhibition of paintings, works of art, or scientific, literary, or other curiosities, for pay, $2.00 per day, $8.00 per week. A retail huckster is defined for the purpose of this ordinance as a person, firth or corporation driving or going from residence to residence selling at retail, vegetables, fruit or garden truck of any kind -which he has previously bought for the pur- p+se of selling in such manner, and the license tax therefor shall be $1.00 per day or $20.00 per year if on foot or by push cart; $2.00 per day or $40.00 per year if by motor vehicle. - 4 - A wholesale huckster is defined for the purpose of this ordinance as a person, firm or corporation that drives or goes from place to place and sells to merchants, retail hucksters, or other persons, at wholesale, vege- tables, fruit or garden truck and the license tax therefor shall be $25.00 per Oay.or $200.00 per year. A peddler is defined for the purpose of this ordinance as a person, firm or corporation that drives or goes from residence to residence or from place to place selling retail goods, wares or merchandise other than vege- tables, fruits or garden truck and who does not come within the provisions of any other ordinance now in effect, or any solicitor or canvasser for the sale of the same and the license tax therefor shall be $25.00 per year orone-half thereof if a new business started after July lst of any year. (25) Street or Sidewalk stands: On offering for sale upon any public street, sidewalk or alley any goods, wares, merchandise or foods $30.00 per year for each place of such offering for sale. (26) Sales; bankrupt; firs; receivers; and similar sales: Persons selling or offering for sale goods, wares or merchandise known as or adver- tised or designated to be goods, wares or merchandise bought at fire sales, auction sales, manufacturer's loss sales, wreckage sales, sheriff'e,creditor's assignee's, consignee's, b?.ukrupt, special bargain or damaged goods' sales, or advertised in any manner for the purpose of inducing customers or people to be- lieve that such,'goods, wares or merchandise will be sold for a price or prices not exceeding the cost of production, or bankrupt or damaged stock of goods i f not otherwise taxed, $25.00 per day, payable in advance. This section shall apply to all stocks of goods that are not assessed or taxed in the City of Salina; Provided that this section shall not apply to goods, wares, or mer- chandise which are actually under the control of the sheriff, or an assignee or trustee in bankruptcy, or to goods, wares or merchandise which have been damaged in the City of Salina, and which are being disposed of in good faith to close out the same. (27) Sale of Clothing by sample. The occupation or business of taking orders for the delivery of tailor made or ready made clothing, from eamples displayed in said city, where a deposit of money is required when the order is taken and the balance of the price is tis be collected when the merchandise is delivered C.O.D. by the United States Post Office Department or by any express company, or otherwise, shall pay a license tax of $25.00 per day. - 5 - (28) Skating rinks. Skating rinks, $50.00 per annum; and no license &hall be issued for less th«,n one year. (29) Shooting gallery. The operation of a shooting gallery, e_n occupa- tion tax as follows: $5.00 per day, $25.00 per month, or $50.00 per year. (30) Street Parades. All street parades and all persons walking or driving over the streets of the City, advertising by means of printed banners, signs or streamers or by ringing bells, loud calling or announcements intended to attract the attention of people and for the purpose of advertising any entertain - *Amt not otherwise named in this ordinance, w3.40:) for each parade or advertising *,stunt". (31) Street Vendors. Auy street vendor for articles of merchandise, notions and the like, not otherwise mentioned in this ordinance, $5.00 per day. (32) Taxicabs and operators thereof. For each taxicab P30.00 per year amd ;for an operator's license therefor, 11.00 per year. All license taxes by this or - imposed an certain trades, callings and occupations on an annual basis# shall be payable on or before January* second of each calendar year and :such licenses shall be deemed to expire on D000aber thirty-first of each calendar yesar. All license taxes hereinn provided for on a six—month basis shall be paid on or before January second sad July first of each year. All license taxes herein provided for ora a monthly basis sW1 be paid on the first day of each calendar month. All license taxes provided for in this ordinance on a weekly basis# shall be payable on Monday# the first business ddy of each week. SEC TI ON 5. Now businesses. Any person, fires or corpors- tion entering, into an occupation or trade or calling between license paying mattes# shall imaaeediately apply# pay for, and obtain a license can the same basis as though such person, firm or corporation was onpaged in such business an such license paying dates. SECTION 6. D eliaa uenoies. All lisenses not paid within 30 days after date of expiration shall pay a penalty of 14% of the amount of the license fee and 10% of the amount of the license fee shall be added for each additional 30 days from dates of expiration. SEC TION T. License to be exhibitted. All such trades, professions, busi- assets and occupations, herein licensed shall be open and subject to inspection at all reasonable times, by the proper officers of the City of Salina, under Its police powers, in order for such officers to ascertain that persons con - dusting said trades, professions, businesses and occupations are complying with all of the police and health regulations of the City of Salina. SEC TION 9. INSPECTION OF A LICENSE. All licensed persons, iaoluding their employees, not having a permanent location, shall carry their license with them and every person shall present his license for inspection schen requested to do so by any officer of the City of Salina. :SEC Ti ON 10, PAYWENT. SAVITdG CLAUSE. That if any provision, term or requirement of this Ordinance shall be determi.ed to be unreasonable, illegal, unconstitutional or void, the same shall in no manner be held to eliminate, alter, annul, or restrict such provisions of this Ordinance, as may be legal, constitutional, reasonable and valid.
