Taylor Construction Company for the construction of certain curbing, guttering and grading improve- j ments on certain streets in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor, d/b/a The H. J. Taylor Construction Company, hereinafter referred to as the "contractor", as submitted to the Board of Commissioners on the 8th day of November, 1943, which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Comraissioners of said city to said contractor and signed on behalf of the City by its Mayor on November 8, 1903, for the construction of certain public improvements in the City of -Salina, to -wit: Curbing and guttering and grading of College Avenue from the south line of Morrison Avenue to the north line of Prescott Avenue, as pro- vided in Ordinance No. 5036. Curbing and guttering and grading of Montrose Avenue from the south line of Morrison Avenue to the north line of Prescott Avenue, as pro- vided by Ordinance No. 5036. Curbing and guttering and grading of Tenth Street from the south line of Wilson Street to the north line of Republic Avenue, as provided for by Ordinance No. 5036, at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this Ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said con- tractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary noAs signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4� per annum and to mature not later than April 1, 1944, and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4.
