ANCE providing for the curbing, guttering and grading of College Avenue from the south line of Morrison Avenue to the North line ofiTres,ott Avenue; to the established ...ontrose Avenue from the south line of Morrison Avenue to the north line of and thr+.t at Prescott Avenue; Tenth Street from the south line of Wilson Street to the north line of Republic Avenue, and providing for the cost of such improve- of streets and alleys said ments and how the same shall be assessed and the manner of payment therefor. line of _�riHLR6AS, by Resolutions No. 828 and 830, duly adopted on July 14, 1943, and July 19, 1943, respectively, by the hoard of Commissioners of the City of Salina, said Board of Cormniss_oners have declared that they deem it necessary to improve certain portions of certain streets and alleys in the City of Salina to the extent provided for in said resolutions and as hereinafter provided for, and 1vHEREAS, said resolutions were each duly published for six days in the Salina Jc:urnal, a daily (except Sunday) newspaper in said city and the official city paper and no suf- ficient protest, or any protest, against said improvements or any of them have been filed within the time and in the manner provided by law; 21616 Tt.__tEFURF: 3E IT URDA LM by the Board of Com;iissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that College Avenue from the south line of MOrrisor_ Avenue to the north line of Prescott Avenue in said city be curbed and buttered and that such street within such limits be excavated and graded to such extent as .may be necessary for the completion of said work, and that such street between the curb and Futter lines -n each side thereof be -raded to the established pavin- grade of said street within the li,its above defined, and that at the intersection of streets and alleys, said curb and gutter shall be carried back to the lot line of the street so improved, the distance between such curb and rutter on each side of said street to be 28 feet from toe to toe of gutter. Section 2. That it is necessary and it is hereby ordered that Montrose Avenue from the south line of TIorrisdn Avenue to the north line of Prescott Avenue becurbed and buttered and that such street within such limits be excavated and graded to such extent as mar be necessary for the completion of such work, and that said street be graded, between the curb and Eutter lines on each side thereof, to the established paving grade of said street within the limits above defined, and that at the inter- section of streets and alleys said curb and -;utter shall be carried back to the lot line of the street so improved, the distance between such curb and gutter on each side of said street to be 28 feet from toe to toe of gutter. Section 3. That it is necessary and it is hereby ordered that Tenth Street from the south line of hilscn Street to the north line of Republic Avenue in said city be curbed and -uttered and that such street within such limits be excavated and graded to such extent as -hay be necessary for the completion of such work, and that said street be ;-raded, between the curb and Cutter line on e?ch side thereof, to the established paving grade of said street within the limits above defined, and thr+.t at t'�le inter- section of streets and alleys said curb and gutter shall be carried back to the lot line of t_he street so i..:proved, the distance between such curb and gutter on each side of said street to be 28 feet from toe to toe of gutter. Section 4. That for the work and improvements herein provided for in the preceding sections of the Ordinance, the City Engineer shall mare and file with the i City Clerk on or before October 4th, 1943, complete plans and specifications for the 1 improvements to be constructed as provided for in this Ordinance including the excava- tion i lo. and grading as herein provided for with the following materials: Concrete combined curb and gutter, 6 inches in width, 6 inches in height at back, and 24 inch gutter i and such engineer shall on or before the same date submit to the: Board of Commissioners j under oath, detailed estimates of the cost of such work v.,ith such materials. j Secticn 5. That after such plans and specifications shall have been made and i prepared by the City Engineer and filed with the City Clerk as aforesaid, the board of Uomlaissioners may advertise, by advert iseraent published in the official city paper 1 of the City of Salina, Kansas, for three consecutive days for t?..e receipt of sealed proposals for the improving of said streets with the kind of material named and speci- fied in the preceding section hereof, and for the excavating and grading necessary for the completion of such work, and after the receipt of such proposals the Hoard of Com- rmissioners may and are hereby authorized to let contracts for the improving of said 1 streets with the material selected by them to the lowest responsible bidder therefor, as determined by said board of Commissioners, and for such excavating and grading. i I Said Board of Commissioners reserve the right to reject any and all bids. i I Section 6. That for the improving the above mentioned streets, special assess- ments shall be made for the full cost thereof according to law, on all lots and pieces (-f land to the center of the block on either side of the street according to the i appraisers value thereof, without regard to the buildings or improvements thereon for i the distance to be improved. Section 7. After tie passage and -)ublication of this Ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders,who after having taken an oath to make a true and impartial appraisement of all lots and ;,)ieces i of land liable to assessment and taxation for the cost of the improvements herein pro- vided for, shall within five days after having been notified of their appointment pro- j Geed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid as may be designated by the board of Commissioners of said city, without regard to the buildings or improvements thereon, and after makinE; said appraisement shall return the sane to the Board of Commissioners of -said city and said board of Commissioners shall designate a time for holding a special session of such Board for the purpose of hearing any complaints that mai* be made as to the value of any lots or pieces of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session, the hoard of Commissioners 1..'ay alter any valuation of any lot or niece of land if, in their opinion, the same has i been appraised too high or too low. - Section 8. For the purpose of paying for the work and improvements in tnis Ordinance provided for, the Board of Coimaissioners are 'hereby autnorized and directed to issue internal improve.ient bonds of the City of Salina in an amount not to exceed the contract price of such improvements and to run for a period of ten years and be payable in ten approximately equal installments, together with interest not to exceed five per centum (5j.) per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the ;purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Co=iissicners small apportion and assess against the lots and ieces of land within the taxing d'strict of such inprove- rents special assessments covering the cost of such improvements and the apportionment therein contained shall 'hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and a;,portion- :hent ordinance shall contain t=ie total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual in- stallments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable f:r such work and improvements, to -ether .^rith the respective amounts due on each of said tracts, > eces and parcels of lend, •rhich amounts shall inc?.ude the annual installments and interest on all unpaid balances ''or one gear at the rate ofnot to exceed 5% per annum, on s,;.ch a counts so certified v.hich shall be collected as ot.er taxes are collected; PRUY IDED, that for the ->urpose of defraying the cost of improvin` tine intersections and areas formed by t'ne crossing of streets and alleys, as .:ell as where the improve -,rent is thr•ou,h or adjacent to property of the city for ehi.ch t, -:e city would be liable, t:.e asses6_.ient will be .Wade against all taxar)le property of the cit,r and paid by the cit- at large.
