5328 Utility Improvements Grounds of Kansas Welseyan UniversityORDR1d CE NIJm:a% 5328 ___(Published in the Salina Journal 1948 ) AN ORDIIW2,CE creating and defining a certain lateral Sanitary Sewer District in the Cit* of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 232, and providing for the construction of a Lateral Sanitary Sewer in said Lat- eral Sanitary Sewer District Number 232, so created, and providing for the pay - went of the cost thereof and for the levying of special assessments against the j property in said district for the payment of the cost of such construction and j for the issuing of bonds to pay the cost thereof. BE IT ORDA1 'ED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer Number 232. That there be and there is hereby created Lateral Sanitary Sevier District in the City of Salina, Kansas, which shall be and it is hdreby designated as I'ateral Sanitary Sevier District number 232, and which district shall include all the followinE described property in the City of Salina, Kansas, to -wit: Lots 22, 24, 26, 28, 30, 32, 34, 36, 38 and 40 on Ellsworth Avenue and Lots 21, 23, 25, 27, 29, 31, 33, 35, 37 and 39 on Minneapolis Avenue, all in the Addition to the Grounds of Kansas Wesleyan University, an Addition to the City of Salina, Saline County, Kansas i Section 2. It is necessary and it is hereby* ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lat- eral Sanitary Sewer District Number 232 as created by Section 1 of this Ordinance along the followinm course, to-viit: Beginning at a manhole in Quincy Street which I is in the center line of an alley, Mended west c3text' north.,, 0-" Ellsworth _'. re_ ie and 3u feet west of the east line of said Quincy Street; thence west in the center line of said alley as an 8 inch V.C.P. sewer 510 feet to a man- hole to be constructed in said alley, being the terminus of said sewer. Section 3. That the City Engineer shall on or before August 16th , 1948, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for .n the preceding sections of this ordinance which shall be of proper character to serve the prop- erty lying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof,. That thereafter the City* Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building~ and construction of such sewer to the loviest and best responsible bidder or bidders therefor, if there be any whose bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received -kvith such estimate, the Board of Commissioners shall have the Dower to do such work and make such improve- ments within the e ti -:sated cost thereof as provided by law. Section 4. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within the sewer district within and for which such sewer shall be built, according to the aper aised value thereof, without regard to the imrprovements or 0 u i buildings thereon. Section 5. After the passage and publication_ of this ordinance, the '3osrd of Commissioners shall appoint three disinterested appraisers, whb after having I � taken an oath to make a true and impartial appraisement of all lots and pieces of land to taxa.t-,.on for the cost of such improvements, shall within five days after I� having been notified of their appointment proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improvemehts thereon, and after making such appraisements shall return to the Board of Commissioners of said city and said Board shall designate a time for holdinm a special meeting of said Boord for the purpose of hearing any complaints that may be made as to the value of any lot or i piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may i - alter anv valuation of anv lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. The special assessment herein provided for may be paid b... the person liable therefor in four approximately equal annual installments by the owner of any property liable to such assessment may within thirty days from the I date of determining the amount assessed aginst the property pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7.
