5266 Use of Public Streets and Highways1 1 1 1 411 115 ORDI-NANCE 710, 5266 (First published in the Salina Journal ��-� � g 1947) AIT ORDINA10E relating to traffic and regulating the use of public streets and highways in the City of Salina; prescribing regulations relative to the park- ing of vehicles upon such ;ublic streets and highways; providing for purchase, leasing, acquiring, installation, operation, maintenance, supervision, regulation and control of the use of parking meters; defining and providing -'or the establish- ment of parking meter zones upon the public streets and highways and providing for the payment thereof; providing for an enforcement and providing penalties for the violation thereof and providing for the repeal of Ordinance No. 5124 aHEREAS, because of traffic conditions that have existed in certain sections of the City of Salina, the free movement of traffic in those sections is, and has been, impeded for a long period of time; and ri3E3EAS, attempts to regulate the traffic and parking in the aforesaid areas have not been as successful as is desirable; NUp'J "_fllRErORE, BE IT :JRDAI'u'ED by the Board of Coiivaissioners of the City of Salina, Kansas: Section 1. The word vehicle as used herein, shall mean any device by w.'iich any person or property may be transported upon a public highway, except those operated upon rails or permanent tracks. Section 2. The term parking meter as used herein, shall mean a mechanical device located upon a public street or side -,alk in a place regularly designated as a parking zone as hereinafter defined, which device shall record a certain number of minutes by the use of a clock mechanism determining t:ie period of t:Uie for wriich parking privileges may be extended to the person so depositing such coin. Section 3. A parking meter zone as used herein, shall mean representing a certain designated and itarked off section of the public street within the marked boundaries where the vehicle may be temporarily parked and allowed to remain for such period of time as the parking meter attached thereto may indicate. Such parking meter zones shall be further designated by a parking meter which shall be located upon t.ie side- walk opposite the marked boundaries of said zone. Sectlen 4. Parking L,.eter zones as hereinadove described are hereby created on the following streets in the City of Salina: On both sides of Santa Fe Avenue from ,iulberry Street to Eli:: Street. On both sides of Seventh Street from iyalnut Street to Ash Street. On both sides of Iron Avenue from Fifth Street to a certain i,orth and south public alley, extended south lying between Seventh and Eighth Street and connecting Iron Avenue and Ash Street and the north side of Iron Avenue from said certain alley to Eighth Street. and from time to tL,e hereafter as traffic conditions require in such other streets and avenues as are selected by resolution of the governing body of the City of aalina for the location of such zones. Section 5. And in said parking meter zones the City manager shall cause meters to be installed and shall cause parking meter spaces to be designated as hereinafter provided, and shall fix the time limitations for legal parking in such zones, and the hours during the day and night when the parking Meter or i.ieters must be used and when the time limitations shall be effective, in compliance with the provisions of tris ordinance; and sna.11 indicate the tine limitations by designating the same on the parking meter or meters or by appropriate signs posted in proximity to said i..eter or ::.eters in said zones. 116 ..gAn+A nn A - City 11anager is hereby directed to provide for the purchase, leasing, acquiring, installation, operation, maintenance, supervision, regulation and use of the parking meters provided for in this ordinance and to maintain the said meters in good workable condition and the City Manager is hereby vested with power and authority to enter into a contract for a six months trial period, after approval of the terms and conditions thereof by the Board of Commissioners of the City of Salina for the leasing and installation of parking meters, the payment for such meters and/or installation to be provided for solely from the receipts, funds and revenues obtained from the operation of aid parking meters without in any manner obligating the city to pay for the same from any other source. And the City Lknager is further authorized and empowered to enter into a contract, after approval of the terms and conditions thereof by the Board of Com- missioners of the City of Salina, for such protection and maintenance of said parking meters as may be necessary to maintain the same in good operating condition and to pay for such parts, protection and maintenance, exclusively from the receipts, funds and revenues received from the operation of said parking meters. Section 7. The parking deters installed in the parking meter zones established as provided in Section 4 hereof shall be placed upnn the curb intnediately adjacent to the individual parking places hereinafter described. Each parking meter shall be placed or set in such manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking Lieter installed shall indicate by a proper legend the legal parking time established by the City and when operated shall indicate on and by its dial and pointer the duration of the period of legal parking, and on the expiration of such period, shall indicate illegal or over parking. Section 8. The City Ii,anager shall have markings painted or placed upon the curb and or upon the street adjacent to each parking meter for the purpose of designating the parking space for which said meter is to be used and each vehicle parking adjacent or next to any parking meter shall park within the lines or markings so established. It shall be unlawful and a violation of this ordinance to park any vehicle across any such line or marking or to park said vehicle in such position that the same shall not be en- tirely within the area so designated by such lines or markirg s. Section 9. ',When a parking space in any parking meter zone is parallel with the ad- jacent curb or sidewalk, any vehicle parked in such parking space shall be parked with the foremost part of such vehicle nearest to such meter. Section 10. dVhen any vesicle shall be parked in any space adjacent to which a park- ing meter is located in accordance with the provisions of this ordinance, the operator, of said vehicle shall, upon entering the said parking space, immediately deposit or cause to be deposited a coin of the United States, in such parking meter, of a denomination or denominations indicated on each of said meters, and put such meter in operation, and failure to deposite such coin or coins and put the meter in operation shall constitute a breach of this ordinance and shall subject such person to the penalty prescribed in Section 16 hereof. Upon the deposit of such coin or coins and placing said meter in .t r Section 14. It shall be unlawful and a violation of the provisions of this ordinance to deposit or cause to be deposited in any parking meter, any slug, device or metallic substance, or any other substitute, for a coin of the United States. Section 15. It shall be the duty of police officer of the City, acting in accordance with instructions issued by the City IV.Anager to report: (a) The number of each parking meter which indicates that the vehicle operat.on, the parking space may be lawfully occupied by such vehicle during the period of parking time which has been prescribed for the part of the street in which i said parking space is located. If said vehicle shall remain parked in any such parking space beyond the parking time limit fixed for such parking space, the parking meter shall by its dial and pointer indicate such illegal parking, and in that event, such venicle shall be considered as parked overth-e and beyond the period of legal parking time and the parking of a vehicle overtime or beyond the period of legal parking shall be a violation of this ordinance and punished as hereafter set out. Section 11. It shall be u#.lawful and a violation of the provisions of this ordinance for any person to cause, allow, permit, or suffer any vehicle registered in the name of, or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described. Section 12. It shall be unlawful knd a violation of the provisions of this ordinance for any person to permit a vehicle to remain or be placed in any parking space adjacent to any parking meter while said meter is displaying a signal indicating that the vehicle occupying such parking space has already parked beyond the period of time prescribed for such parking space. Section 13. It shall be unlawful and a violation of the provisions of this ordinance for any person to deface, injure, tamper with, open or wilfully break, destroy, or impair the usefulness of any parking meter installed under the provisions of this ordinance. Section 14. It shall be unlawful and a violation of the provisions of this ordinance to deposit or cause to be deposited in any parking meter, any slug, device or metallic substance, or any other substitute, for a coin of the United States. Section 15. It shall be the duty of police officer of the City, acting in accordance with instructions issued by the City IV.Anager to report: of the pro -visions of this ordinance. (a) The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been psrkirg in volation of any of the provisions of this ordinance. (b) The State license number of such vehicle. (c) The time during which such vehicle is parking in volation of any of the provisions of this ordinance. (d) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. Each such police officer shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parked in vi6lation of a provision of this ordinance and instructing such owner or operator to report at the police station of the City of dalina in regard to such violation. Each such o-=er or operator, may, within 2. hours of the t :.e when such ,:otice was attached to such vehicle, pay to the Desk Sergeant at the police station as a penalty for and in full satisfaction of such violation, the sum of One Dollar, the failure of such owner or operator to make such payment within said 24 hours, shall render such owner or operator subject to the penalties hereinafter provided, for violation of the pro -visions of this ordinance. 118 Section 16. Any person who shall violate any of the provisions of this ordinance and any person who aids, abets or assists therein, shall upon conviction thereof by the Police Court be subject to a fine of any amount not exceeding $50.00 i for each offense or violation or be imprisoned for a term not exceeding 15 days, I in the city jail or in any place provided by the municipality for the detention of I prisoners or both. Section 17. The coin or coins required to be deposited in parking meters as provided are hereby levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets, improvement of traffic facilities, and the cost of supervision and regulating the parking of veiiicles in the parking meter zones created hereby, and to cover the cost of the purchasing, leasing, acquiring, installation, operation, maintenance, supervision, regulation and control of the parking meters described herein. Section 18. This ordinance shall be deemed to be in addition and supplementary to, and not in conflict with nor a repeal of prior or existing ordinances of this city, but shall be an additional provision for the regulation of traffic and parking in those zones provided for herein. Section 19. If a section, part of section, sentence, clause or phrase of this ordinance shall be held to be unconstitutional or invalid, the remaining provisions hereof shall nevertheless remain in full force and effect. Section 20. That Ordinance No. 5124 be and it is hereby repealed and all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and the same are hereby repealed. this ordinance shall take effect and we in force from and after its passage and publication in the official city paper.
