5265 Utility Improvements Grounds of Kansas Wesleyan University112 ORDINANCE N0. 5265 (Published in the Salina Journal -- �� ✓ vo 1947) AN ORDINANCE creating and defining certain Lateral Sanitary Sewer Districts in the City of Salina designated as Lateral Sanitary Sewer Districts No. 218 and 219, and providing for the construction of Lateral Sanitary Sewers in said Lateral Sanitary Sewer Districts Number 218 and 219 so created, and providing for the payment of the cost thereof and for the levying of special assessmdnts against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sani ary Sewer District Number 218. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be and it is hereby d esignated as Lateral Sanitary Sewer District Number 218 and which district shall include all the following described property in the City of Salina, to -wit: The odd numbered Lots 41 to 79, both inclusive on Claflin Avenue and the even numbered lots 42 to 80, both inclusive, on Russell Avenue, all of said lots being, lying and situated in the Addition to the Grounds of Kansas '.,9esleyan University, an Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 218 as created by Section 1 of this ordinance along the following course, to-lwit: Beginning at a manhole to be constructed in the center of the intersection of Quincy Street and a certain east and west public alley, extended west, lying next north of Russell Avenue, thence east in the center of said east and west public alley to a manhole to be constructed at the intersection of the center line of .said alley and the west line of Roach Street, being the terminus of said sewer. Section 3. Lateral Sanitary Sewer District Number 219. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be and it is hereby designated as Lateral Sanitary Sewer Listrict Number 219 and which district shall include all the following described property in the City of Salina, to -wit: The odd numbered Lots 41 to 79, both inclusive on Cloud Avenue and the even numbered Lots 42 to 80, both inclusive, on Russell Avenue, all of said lots being, lying and situated in the Addition to the Grounds of Kansas Wesleyan University, an Addition to the City of Salina, Ali ,.e County, Kansas. Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 219 as created by Section 3 of this ordinance along the following course, to -wit: Beginning at a manhole to be constructed in the center of the inter- section of ',Zuincy Street and a certain east and west public alley, extended west, lying next north of Cloud Avenue, thence east in the center of said east and west public alley to a manhole to be con- structed at the intersection of the center line of said alley and the ;rest li e of Roach Street, being the terminus of said se -we-. Section 5. That the City -Engineer shall on or before December 15th, 1947, prepare and file in the office of the City Clerk, separate plans and specifications for the construction of each of the lateral sanitary sewers provided for in the pre- ceding sectio s of this ordinance which shall be of proper character to serve the propert,r lying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Hoard of Commissioners detailed esti:_,ates under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before 113 on or before the time fixed in such notice, at which time the Board of Com- missioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidders or bidder therefor, if there be any whose built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 7. After the passage and publication of this ordinance, theBoard of Co::missioners shall apponnt three disinterested appraisers, who after having taken an oath to make a true andimpartial appraisement of all lots and pieces of land to taxation for the cost of such improvements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such district buildings or improvements thereon, and after making such appraisements shall return to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said -oard may alter any valuati n of any lot or pieces of land, if, in their opinion, the same has been appraised too high or too low. Section S. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days fron the date of determin- ing the amount assessed against the property pay the same in full and his property shall not be liable for any assessments for the cost of such i provements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assess- ment if fixed. Section 9. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvements, and to run for a period for four years and be payable in four approximately equal annual installments, together with interest not toe xceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such Estimate, the Board of commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 6. That for the cost of building and constructing each of such sewers, special assessments shall be made for the full cost thereof on all lots or pieces of land within the sewer district within and for which each of such sewers shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 7. Section 5. That the City Engineer shall on or before December 15th 19 47 , prepare and file in.the office of the Cit7, Clerk, separate plans and specifications for the construction of each of the lateral sanitary sewers provided for in the preceding; sections of this ordinance which shall be of proper character to serve the property lying vrithin the dis- trict vrithin which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners detailed estimates under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewers accord- ing to such plans and specifications, which proposals shall be filed vi th the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and con- struction of such sewer to the lowest and best responsible bidders or bidder therefor, if ther be any whose bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the pourer to do such work and make such improvements within the estimated cost thereof as provided by law. Section 6. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such improvements, shall within five days after having been notified of their appointment pro- ceed to appraise all of the lots or pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraisements shall return to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the pur- pose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or pieces of land, if, in their opinion, the same has been appraised too high or too lour. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners are hereby auth- orized and directed to issue improvement b ends of the City of Salina in an amount not to exceed the cost of such improvements, and to run for a period of four ,years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent par annum, which bonds shall be issued and payable according to law; and for the pur- pose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property charge- able with said improvements, such assessment and apportionma t ordinance shall contain the total amount of tax apportioned 'to each tract, pieces or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the Citir Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected.
