That it is necessary and it is hereby ordered that a Main Serer District, together with all necessary connections, manholes and other appurtenances, be constructed and wilt as Ta_ain Seh,er District "W", along with the following described course -within said district, as follows: M Beginning at an existing mannole at the east end of the alley next north of Beloit Avenue between Santa Fe Avenue and Fourth Street; thence east in the center of said alley north of Beloit Street to a manhole to be constructed in the intersectio- of the center line of twzincy Street and the center line of said alley north of Beloit Avenye extended east; thence south in the center of Quincy Strect 2310 feet, more or less, to the intersection of the center line of said 'iuincy Street and the center line of a certain alley next north of Cloud Avenue extended, to a manhole to be constructed, being the terminus of T,:ain Sower Section 3. That the City Engineer shall on or before the 24th day of November, 1947, prepare and file in the office of the City Clerk plans and specifications for the construction of the Lain Sewer District "'"e" provided for in the preceding section of this ordinance, wriich shall be of the proper character and alonC the proper course and at thep roper grade to serve the property lying within the district v.,itr.in li%hich such sewer is to be constructed, and shall on or before said date, prepare and sub- mit to the Board of Co.ic;:issioners detailed estimates, underoath, of the cost thereof, that thereafter the City Clerk shall advertise for three consecutive days in the city paper for sealed proposals, for the building and construction of such a sewer according to such ~glans and specifications, w-iich propc:,-al shall be filed with the City Clerk on or before the time fixed in such notice at which tine the Board of Cornnissioners :nay let a contract for the buildin - and construction of such a sewe. to the lowest responsible bidder or bidders therefor; provided that the cost thereof shall not exceed the estimated cost thereof and provided that said Board sna11 re- serve the right to refuse any and all such proposals; and that if no responsible bids shall be received within said estin.ated cost, said Board may proceed and bu.ld such sewer within such esti.:iated cost. Section 4. That for the cost of building and constructing such a sewer, special assessments shall be .lade for the full cost thereof, on all lots or pieces of land within tie !,Ain Sewer District vlithin which such main sev.,er shall be built, according to the appraised value thereof, witnout regard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Coi::nissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and ii,,partial appraisement of all lots or pieces of land liable to taxation for the cost of such i.,.provements, shall within five days after having, been notified of thi r appointment proceed to a -,praise all of the lots or pieces of land within such district, liable to assessnient and taxation as aforesaid, without regard to the buildings or improvements thereon, and after :Waking said appraisei.zent sh.Qll return the some to t_ie Board of vOaL_issioners of said city and - said Board shall designate a time for holding a special-noeting of said Board for the purpose of hearing any co.nplaints that :nay be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at -,.hich special session said Board may alter any valuation of any lot or piece of land, if., in t'ieir opinion, the same had been appraised too Nigh or too low. For the purpose of paying for the work and i::provements in this ordin- ance provided for, the Board of Commissioners are hereby aut'aorized and directed to issue il..provement bonds of the City of p.lina in an amount not to exceed the cost of such improvement, and to run for a period of four irears and be payable in four aApproxinatel,y equal annual installments, together with interest not to exceed five per cent per annur-i, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bods as they severally become due and payable, the Board of Coimrissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such i provements, special assessments coverinc- the cost of such improvements and the apportionment therein contained shall hold 7ood for all of the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and apportion- ment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual in- stallments in which such tex is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County "lerk of Saline County, Kansas, a full list of all property liable for such work and im- provements, together iAd th the respective amounts due on each of said tracts, piece or parcels of land, whicha:aounts shall include t.e annual installaents and interest on all unpaid balances for one year at t'e rate of not toexceed five per cent per annum, on such anoints so certified, w_iich sizall be collected as other taxes are collected. That it is necessary and it is hereby ordered that a b;a.in Sewer District, together with all necessary connections, manholes and other appurtenances, be constructed and built as Main Sewer District along the following described course within said district, as follows: Beginning at an existing manhole at the east end of the alley next north of Beloit Avenue between Santa Fe Avenue and Fourth Street; thence east in the center of said alley north of Beloit Street to a manhole to be constructed in the intersection of the center line of Quincy Street and the center line of said alley north of Beloit Avenue extended east; thence south in the center of Quincy Street 2310 feet, more or less, to the intersection of the center line of said Quincy Street and the center line of a certain alley next north of Cloud Avenue extended, to a manhole to be constructed, being the terminus of Main Sewer "W". Section 3, That the City Engineer shall on or before the 24.th. day of 14A -ember 1947; prepare and file in the office of the City Clerk plans and specifications for the construction of the Main Sewer Dis- t trict " provided for in the preceding section of this ordinance, which shall be of the proper character and along the proper course and at the proper grade to serve the property lying within the district within which such sewer is to be constructed, and shall on or before said date, prepare and submit to the Board of Commissioners detailed estimates, under oath, of the cost thereof, that thereafter the City Clerk shall advertise for three consecutive days in the city paper for sealed proposals, for the building and construction of such a sewer according to such plans and specifications, which proposal shall be filed with the City Clerk on or before the time fixed in such notice at which time the Board of Commissioners may let a contract for the building and construction of such a sewer to the lowest responsible bidder or bidders therefor; provided that the cost thereof shall not exceed the estimated cost thereof and provided that said Board shall reserve the right to refuse any and all such proposals; and that if ,po responsible bids shall be received within said estimated cost, said Board may proceed and build such sewer within such estimated cost. Section 4. That for the cost of building and constructing such a sewer, special assessments shall be made for the full cost thereof, on all lots or pieces of land within the Paai.n sewer District within which such main sewer shall be built, according to the appraised value thereof, without re- gard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointment pro- ceed to appraise all of the lots or pieces of land within such district, liable to assessment and taxation as aforesaid, without regard to the build- ings or improvements thereon, and after making said appraisements shall re- turn the same to the Board of Conunissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of vhich special aessio_z due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same had been appraised too high or too low. Section 6. Zhe special assessments herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improvements and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvement, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds ad'they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering the cost of such improve- ments and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property dhargeable with said improvement.
