AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds
of the City of Salina, Kansas, in the sum of $17,046.61, to pay the cost
of improving certain streets in said City to be designated as Series Number
P-139.
WHEREAS, pursuant to proceedings duly had according to law, contracts have been
let and performed for the construction of the following street improvements in the
City of Salina, Kansas, to -:pit:
Paving of a certain north and south public alley
lying between Seventh Street and Eighth Street,
from the north line of Walnut Street, thence
north to the south line of a certain east and
west public alley running between Seventh Street
and Eighth Street, as provided in Resolution Number
909 and Ordinance Number 5164.
Paving of a certain public alley, lying between
Seventh Street and Eighth Street from the north
line of Iron Avenue, thence north to the south
line of Ash Street, as provided for in Resolution
Number 908 and Ordinance Number 5164.
Curbing, guttering and grading of Eighth Street
from the north line of Hamilton Street to the
south line of Antrim Avenue, as provided for in
Resolution Number 858 and Ordinance Number 5144.
Curbing, guttering and grading of Seventh Street
from the south line of Hamilton Avenue to the
north line of Otis Avenue, as provided by Resolution
Number 865 and Ordinance Number 5144.
Curbing, gutte ring and grading of Charles Street
from the west line of Twelfth Street to the east
line of Phillips Street, as provided by Resolution
Number 872 and Ordinance Number 5144.
Curbing, guttering and grading of Arthur Avenue

vided by Resolution Number 938 and Ordinance Number
5184.
:'WHEREAS, the total cost of said improvements has been ascertained and the portion
thereof in the amount of $7,717.22 to be paid by general taxes to be levied upon
all taxable property within said city for the improvement of squares and areas
formed by the crossing of streets and alleys and for the improvement of any of
said streets where the same is through or adjacent to property of the city for
which the city is liable, and for which the city is paying cash; and
kHEREAS, the total cost of said curbing, guttering, paving and grading of said
streets, which are to be paid by special assessments and to be levied upon lots
and pieces of ground liable for the payment of said curbing, guttering, grading
and paving; in said streets has been ascertained and has been hereby, found and
determined to be the sum of $29,553.93, which amount has been heretofore duly
assessed and apportioned to the several lots and pieces of ground liable there-
fore according to law provided for in the ordinance of the City of Salina, Kansas,
relating thereto, duly passed and approved, of which amount the sum of $12,607.32
has been paid by the property ovm ers liable therefore, leaving a balance of 417,046.61
for which bonds are to be issued.
BE IT ORDAINED by the Board of Commissiac,ners of the City of Salina, Kansas:
Section 1. That the foregoing preambles be and they are hereby authorized
as a part of this ordinance and that for the purpose of providing funds to pay the
cost of the imp -m vements herein above referred to and described in the Ordinances
and Resolutions hereinbefore referred to, there shall be issued Internal Improve-
ments Bonds of the City of Salina, Kansas, in the total principal sum of $17,046.61,
which shall consist of twenty bonds numbered 1 to 20, inclusive, all dated November
1, 1947, which shall bear interest at the rate of 1.2 per cent per annum from and
after said date until the respective maturities of said bonds, payable semi-annually
on May 1, and November 1, of each year, said interest to be evidenced by interest
coupons as herein provided for and said bonds shall become due as follows:

Section 2. Said bonds shall be signed by the Mayor and shall be attested
by the signature of the City Clerk and corporate seal of the city shall be affixed
thereto and said bonds shall have attached thereto interest coupons representing
the interest thereon, which coupons shall be in theform provided by law and shall
bear the printed or lithographed facsimile signature of the Mayor and City Clerk
of said city and said bonds and interest coupons shall be registered in the office
of the City Clerk and in the office of the Auditor of State, as reuired by law.
Section 3. Said bonds shall be designated as Series P-139 and shall be in
the form and shall contain recitals substantially as follows: to -wit:

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of
Saline, Stab of Kansas, acknowledges itself to be indebted and for value received
hereby promises to pay to the bearer the sum of:
DOLLARS
in lawful money of the United States of America, on the first day of

at the rate of one and one-half per cent per annum, payable semi-annually on the
first day of and
in each year, on presentation and surrender of the interest coupons hereto annexed
as said coupons severally become due, both principal and interest of this bond being
payable at the office of the State Treasurer of the State of Kansas, in the City of
Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these
presents and the full faith, credit and resources of said city are hereby irrevocably
pledged for the payment of said principal and interest at maturity.
This bond is one of a series of bonds of like date and tenor, excepting
denomination and maturity, aggregating the principal sum of 417,046.61, issued by
the City of Salina, Kansas, for the purpose of paying the cost of constructing cer-
tain curbing, guttering, paving and,grading improvements in said city by the authority
of an in full compliance with the provisions, restrictions and limitations of the
constitution and laws of the State of Kansas, including Sections 10-101 to 10-115,
12-601 to 12-608 and 13-1011 and 13-1011A, all in the General Statutes of Kansas
1935, and such sections as amended, and all other provisions of the laws of said state
applicable thereto, and this bond and all other bonds of this series, and all interest
thereon are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions, and things
required to be done and to exist precedent to and in the issuance of this bond have
been properly done and performed and do exist in due and regular form and manner as
required by the constitution and laws of the State of Kansas, and that the total
indebtedness of said city, including this series of bonds, does not exceed any con-
stitutional or statutory limitation.
IN VVITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by
causing it to be signed by its Mayor and its corporate seal to be hereto affixed,
attested by its City Clerk and the coupons hereto attached to be signed with the
facsimile signatures of said officers, and this bond to be dated the first day of
November 1947.

Section 4. The Mayor and City Clerk are hereby authorized and directed
to prepare and execute the bonds hereinbefore described and to advertise and
sell the same in the manner provided by law, and when duly executed and registered
to deliver said bonds to the purchaser or purchasers thereof.
Sect__on 5. The full faith, credit and resources of the City of Salina,
Kansas, shall be, and the same are hereby irrevocably pledged for the prompt
payment of said bonds and all interest thereon. The Board of Comtilissioners of
the City of Salina, Kansas, shall annually make provision for the payment of
the principal and interest on said bonds as the same become due by levying
taxes and assessments upon the property liable therefore as provided by law.
Section 6. This ordinance shall take effect and be in force from and
after its pu.>lication in the official city paper.
