Taylor Construction Company for the construction of certain lateral sanitary sewers in the City of Salina, heretofore designated as Lateral Sanitary Sewer Districts Number 216 and 217, and for the construction of a certain Main Sewer in Main Sewer District "V", heretofore created, and for the construction of a pumping sta- tion for the purpose of pumpir_g the sewage of Main Sewer District "V" and extensions thereof, and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of CoLT issioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of tale proposal of H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as submitted to the Board of Co.(,snissioners on September 3, 1947, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the Citfa by its Mayor on September 29, 1947, for the construction of certain public improvements in the City of Salina, to -wit: (1) A lateral sanitary sewer in a certain benefit Distfict, being Lateral Sanitary Sewer Number 216, as hereto'ore provided by Ordinance No. 5239, as follows: Construction of an 8" V.C.P. Lateral Sanitary Sewer, with allnecessary connectins, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed in the intersection of University Place and the alley next east of Broadway Boulevard; thence north in said alley to the south line of State Street with an 8" clay pipe sewer terminating at a manhole to be constructed at that loca- tion as provided by Ordinance Number 5239; at and for the unit prices for said work contained in said proposal, which proposal 0 (2) A late -al sanitary sewer in a certain Benefit District, being Lateral Sanitary Sewer Number 217, as heretofore provided by Ordinance Number 5239, as follows: Construction of an 8" V.C.P. lateral sanitary sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed in the intersection of University Place and Broadway Boulevard; thence north in Broadway Boulevard to the south line of State Street with an 8" clay pipe sewer terminating at a man- hole to be constructed at that location as provided by Ordinance Number 5239. (3) A main sewer in a certain benefit district, being liain 'ewer District "V", as heretofore provided for by Ordinance Number 5240, as follows: Construction of a Main Sewer District, to- gether with all necessary connections, manholes and other appurtenances, be constructed and b7.zilt along the following described course within said district, beginning at a sewage lift station to be constructed in the northeast corner of Park Number 3, Leavenworth Addition, City of Salina, Kansas, with a one 10 inch outlet line of clay pipe sewer extending in a north- easterly direction 88 feet, more or less, to a manhole to be built on existing 10 inch sewer line in the center of University Place; and an inlet No. 1 described as follows: Beginning at said sewage lift station; thence in a northwesterly direction with an 8 inch clay pipe sewer 150 feet to the w es1- parking of Broadway Boulevard to a manhole to be constructed on Lateral Sanitary Sewer 217 as provided by Ordinance Number 5239 and inlet Number 2 described as follows: Beginning at said sewage lift station thence in a northeasterly direction with an 8 inch clay pipe sewer 105 feet to the alley east of Broadway Boulevard to a man- hole to be constructed on Lateral a'a.ni-,ary Sewer 216 as provided by Ordinance Number 5239; to be constructed at that location as provided by Ordinance No. 5240. (4) 1`4HEHEAS, in order to provide an outlet for the sewage of the main to be constructed in Main Sewer District "V", it is necess°, ry sewer in the judgment of the governing body of the City of Salina to con- struct a pumping statio. for the purpose o' pumping the sewage of such main .'fewer District "V" into the present existing main sewer located in University Street at the intersection of said street and a north and south public alley next east of Broadway Boulevard in order to conduct the sewage of said main sewer District "V" to a point of outlet as provided by Ordinance No. 5241. at and for the unit prices for said work contained in said proposal, which proposal 0 50 _I and contract are hereby referred to and .bade parts of tnis ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor _:,prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That Temporary Notes signed by the Iiayor and attested by the City Clerk be issued from tine to tir..e as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 4z per cent per annum and to mature not later than November 1, 1943 and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in force from and after its publication in the official city paper. (3) A main sewer in a certain benefit district, beim; Main Sewer District "V", as heretofore provided for by Ordinance Number 5240, as follows: Con- struction of a Main Sewer District, together with all necessary connections, manholes and other appurtenances, be constructed and built along the following ddscribed course within said district, beginning at a sewage lift sta- tion to be constructed in the northeast corner of Park Number 3, Leavenworth Addition, City of Salim , Kansas, with a one 10 inch outlet line of clay pipe seiner extending in a north- easterly direction 88 feet, more or less, to a manhole to be built on. existing 10 inch sewer line in the center of Tiniversity Place; and an inlet No. 1 described as follows: Beginning at said sewage lift station; thence in a north- westerly direction with an 8 inch clay pipe sewer 150 feet to the west parking of Broadway Boulevard to a manhole to be constructed on Lateral Sanitary Sewer 217 as provided by Ordinance Number 5239 and inlyet Number 2 described as follows: Beginning at said sewage lift station - thence in a northeasterly direction with an 8 inch clay pipe sewer 105 feet to the alley east of Broadway Boulevard to a manhole to be constr- ucted on Lateral Sanitary Sewer 216 ps provided by Ordinance Number 5239; to be constructed at that location as provided by Ordinance No. 5240. (4) YEAS, in order to provided an outlet for the sewage of the main sewer to be constructed in 1,&in Sewer District "V", it is necessary in the judgement of the governing; body of the City of Salina to construct a pumping station for the purpose of pumping the sewage of such Main Severer District "V" into the present existing main sewer located in Universit,,r Street at the intersection of said street and a north and south public alley next east of Broadway Boulevard in order to conduct the sewage of said main Sewer District "V" to a point of outleto as provided by Ordinance No. 52411. at and for the unit ^rices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. SECTION 2. Said improvements shall be built and constructed in accord- ance with the plans and specifications therefore preparXed by theCity Eng- ineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are herby referred to and made parts of this ordinance. SECTION 3. That Temporary Notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amoutn thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 42 per cent per annum and to mature not later than November 1, 1948 and to be issued in such amounts and at such time as mone7r for the aayment of the cost of such work may be required, such note s to be issued to said vontractor and to be redeemed and cancelled at the tire, that permanent bonds are issued in lieu thereof.
