AN ORDIA14CE providing for the variation of a portion of a certain alley, subject to
certain limitations, in the City of Salina, Kansas.
trHEREAS, SHELLA BARGER S, a Division of II1r.ILLI:V7G CO:PANY, did petition the
Board of Eorrsnissioners of the City of Salina to vacate a cer ain portion of a public
alley; and,
:'iiEREAS, said petiticn was duly and regularly referred to the City Planning and Zoning
Coi;n,ii s s ion; and
E EAS, said cour.ission inet and duly recommended that said ortion of said allye be
vacated; and,

BE IT ORDAII'= by the Board of Cormmissioners of the City of Salina., Kansas:
Section 1. That that portion of a certain north and south alley lying between
Santa Fe Avenue and Fifth Street and north of the south lines, extended, of Lots 12
and 35, Block 10, in Calkins Addition to the City of Salina, Kansas and south of the
southerly line of the right-of-way of the Union Pacific Railroad Company in said city,
be and the same is hereby vacated as and for a public alley and that said alley shall
revert to and become parts of the lots adjacent thereto in eq -al portions, as provided
by law; Provided, however, that the City of Salina hereby reserves a right-of-way and
easements in portions of said alley for the purpose of laying, constructing, repair-
in- and maintaining sewers and vster lines.
Section 2. This ordinance shall be in force and take effect from and after
its publication once in the official city paper and upon being recorded in the office
of Register of Deeds of Saline County, Kansas.
