".;T:EREAS, the City of Salina has by ordinances provided for the construction of a !,,-ain Sanitary Sevier in Main Sewer District "V" for the purpose of disposing of the sewage in such district, and ?'':HEREAS, on account of the elevation of the existing main sewers adjacent to said Sewer District "V", it is impracticable and too expensive to excavate in connecting such ;;lain sewer in Iain Sewer District "V" twith any other main sewer district or main intercepting sewer now existing, so as to disr)ose of the sewage in said Llain Sewer District "V", and prepare and submit to the Board of Colaaissioners under oath detailed estimates of !,,Y.HEREAS, in order to provide an outlet for the sewage of the main sewer to be constructed in lv in Sewer District "V", it is necessary in the judgment of the governing body of the City of Salina to construct a pumping station for the pur- pose of pumping the sewage of such i:Tain .Sewer District "V" into the present existing main sewer located in University Street at the intersection of said street and a north and south public alley next east of Broadivay Boulevard, in order to conduct the se, -age of s,,.id lain Sevier District "V" to a point of outlet; N01Y THEREFORE Salina, Kansas, shall issue i.-provement bonds of said city, in an amount not to BE IT URDAIdED by the Board of Com::issioners of the City of Salina, Kansas: Section 1. That the preambles hereof are hereby incorporated herein. That a pumping station for the purpose of pumping the sewage of I.Ain Selver District "V" and the extensions thereof to the main sewer now existing in University Street at the intersection of said street and a north and south public alley next east of Broadway Bo,-levard, be constructed in the ,Wanner provided by law. Section 2. That the City Engineer of the City of Slina shall on or before the 18th day of August 1947, prepare and file in the of'ice of the City Clerk, plans and specifications for the construction of the pumping station provided for in Section 1 of this ordinance which shall be of the proper character and at the proper location to pump the sewage of said Sewer District "V" into the main sewer at present existing in University Street at the intersection of said street with a north and south public alley next east at Broadway Boulevard, so as to conduct the se age from Iviain Sewer District "V" and extensions thereof to a point of outlet as a part of the sewage disposal system of the City of Salina, Kansas, and shall on or before said date prepare and submit to the Board of Colaaissioners under oath detailed estimates of the cost thereof and that thereafter the City Clerk shalladvertise for three con- secutive days in the official city paper for sealed proposals for the building and constructi:,n of such pumping station according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Comriissioners may let a contract for the building and construction of such pumping station to the lowest and best responsible bidder therefor; provided that such bids shall not exceed the estirtted cost thereof and provided further that said Board shall reserve the ri,ht to reject any and all such proposals and that if no repponsible bids shall be received within said esti-.ated cost said Board may proceed and build such pumping station within such estimated cost. Section 3. Tat for the payment of -the cost of such work the building and constructi^n of said pumping station, the Board of Commissioners of the City of Salina, Kansas, shall issue i.-provement bonds of said city, in an amount not to LiTI exceed the total cost of such work and improvements, to be payable in four approximately equal annual ins-,:ailrnents and to bear interest at not to exceed 5jo per annum from the date of such bonds, and for the purpose of paring such bonds and interest as they severally mature, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of --ki1ina in an amount sufficient to pay the annual installments of such principal and in- terest, and ,ending issue and sale of such bonds, temporary notes shall be issued according to law, to pay the cost cf such work. Section 4. 'That before the pumping station herein provided for shall be constructed, the plans and specifications therefor shall first be submitted to the department of the Board of Health of the State of Kansas and be approved by such department.
