5238 Confirm Utility ImprovementsORDI_ANCE HO. 5238 j AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Con- struction Company for the construction of certain lateral sanitary sewers in the City of Salina, heretofore designated as Lateral Sanitary Sewers District No. 214 and No. 215, and providing for the issuance of temporary notes to nay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor Cor-Istruction Company, hereinafter referred to as the "contractor" as submitted to the Board of Commissioners on July 21, 1947, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by its Itayor on July 21, 1947, for the construction of certain public improvements in the City of Salina, to -wit: (1) Construction of an 8" V. C. P. lateral Sanitary Sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginninC at a manhole in V!ilson Street which is 33 feet, more or less, west of the west line of Third Street thence east in lKilson Street 680 feet, more or less, to a man- hole to be constructed 25 feet west of the west line of Front Street, being the terminus. (2) Construction of an 8" V. C. P. Lateral Sanitary Sewer, with nec- essary connections manholes, flush tanks and other appurtenances, beginning at a manhole in the intersection of Elm and Front Streets thence in a hdrthwesterly direction 50 feet, more or less, to the north parking of Elm Street thence east in the said north parking of Elm Street 450 feet, more or less, to a manhole to be constructed in the north parking of Elm Street, '_)eing the terminus, at and for the unit prices for said vrork contained in said proposal, which proposal and contract are hereb-r referred to and made parts of this ordinance, be and the same is hereb.; ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are here- by referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specificatio:;s therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of s_.id contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary _cotes signed by the i,aror and attested by the City Clerk be issued from time to ti..e as the work progresses in the manner and form as re -,u red b- law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 4 1/2 per cent ner annum and to mature not later than October 1, 1948, and to be issued in such amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that ;)er- manent bonds are issued in lieu thereof. 22 Section 4. Lateral Sanitary Server, with nec- essary connections, manholes, flush tanks and other appurtenances, beginning at a manhole in the intersection of Elm and Front Streets thence in a northwesterly direction 50 feet, more or less, to the north parking of Elm Street thence east in the said north parking of Elm Street 450 feet, more or less, to a manhole to be constructed in the north parking of Elm Street, being the terminus, at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are here- by referred to and made a part of this ordinance.
