AN C71DI"111MCE creating and defining Lateral Sanitary Sewer Districts in the City of
Salina designated as Lateral Sanitary Sewer Districts Numbered 227, 228 and
229, and providing for the construction of Lateral Sanitary Sewers in said
Lateral Sanitary Sewer Districts numbered 227, 228 and 229, so created, and
providing for the payment of the cost thereof and for the levying of special
assessments against the property in said districts and for the payment of the
cost of such construction and for the issuing of bonds to pay the cost there-
of.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 227. That there be and
there is hereby created Lateral Sanitary Sewer District in the City of Salina which

shall be and it is hereby designated as Lateral Sanitary Sewer District Number 227

and which district shall include all the following described property in the City
j of Salina, to -Twit:

Lots 54 to 64, both inclusive, on Front
Street, in the Original Town (now City)
of Salina, Kansas,
Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flush tanks and other
appurtenances be constructed and built in and to serve Lateral Sanitary Sewer District
Number 227 as created by Section 1 of this ordinance along the following course, to -
wit:
Beginning at a manhole to be constructed
at an existing 15 inch V.C.P. sever in Iron
Avenue at its intersection with a north and
south public alley, extended north, which
alley is between Second Street and Front
Street; thence south in the center line of
said alley as.an 8 inch V.C.P. sewer a dis-
tance of 560 feet to a manhole to be con-
structed, being the terminus thereof.
Section 3. Lateral Sanitary Sewer District Number 228. That there be and
there is hereby created a Lateral Sanitary Sewer District in the City of Salina
which shall be and it is hereby designated as Lateral Sanitary Sewer District Number
228 and which district shall include all the following. described property in the
City of Salina, to -wit:
Lots 1, 3, 5, 7, 9 and 11, Block 6, in
College View Addition, Lots 7, 8, 9, and
10 in the Replat of Blocks 4 and 5 in
College View Addition, all in the City of
Salina, Saline County, Kansas.
Section 4. It is necessary and it is hereby ordered that a V.C.P. lateral
sanitary sewer with all necessary connections, manholes, flush tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District Number 228 as created by Section 3 of this ordinance along the following
course, to -wit:
Beginning at an existing manhole in the
intersection of Republic Avenue and Third
Street; thence north along the center line
of Third Street 290 feet as an 8 inch
V.C.P. sewer to a manhole to be constructed
in said alley being the/ terminus thereof.

Section 5. Lateral Sanitary Sewer District Number 229. That there be and there

is hereby created Lateral Sanitary Sewer District in the City of Salina which shall
be and it is hereby designated as Sanitary Lateral Sewer District Number 229 and
which district shall include all the following described property in the City of
Salina, to -wit: �

Lots 22, 24, 26, 28, 30, 32, 34, 36, 38 and
40 on Claflin Avenue and Lots 21, 23, 25,
27, 29, 31, 33, 35, 37 and 39 on Kiriuin Ave-
nue all in the Addition to thc. Grounds of Kansas Wesleyan
University, as addition to the City of Salina, Saline Cotnty, Kansas
Section 6. It is necessary and it is hereby ordered that a V.C.P. lateral
sanitary sewer with all necessary connections, manholes, flush tanks and other appur-
tenances be constructed and built in and to serve said Lateral Sanitary Sewer Dis-
trict Number 229 as created by Section 5 of this ordinance along the following course
to -wit:
Beginning at an existing manhole in Quincy
Street which is 50 feet east of the w4st
line of Quincy Street and on center line
of east and west public alley north of Claf-
lin Avenue; thence west in the center line
of said alley 505 feet as an 8 inch V.C..
sewer to a manhole to be constructed in said
allOIT being V -ie terminus thereof.
Section 7. That the City Engineer shall on or before July 12, 1918
prepare and file in the office of the City Clerk, plans and specifications for the
construction of the lateral sanitary sewers provided for in the preceding sections
of this ordinance which shall be of proper character to serve the property lying
within, the respective districts within which such sewer is to be constructed and
shall on or before the same date prepare and submit to the Board of Commissioners
a detailed estimate under oath of the cost thereof. That thereafter the City Clerk
shall advertise for three consecutive days in the official city paper for sealed
proposals for the building and construction of such sewers according to such plans
and specificiations, which proposals shall be filed with the City Clerk on or before
the tine fixed in such notice, at which time the Board of Commissioners may let a
contract for the building and construction of such sewers to the lowest and best
responsible bidders or bidder therefor, if there be any vuY:ose bid does not exceed
theX estimated cost thereof, but said Board shall reserve the right to reject any
or all such proposals, and if no bid shall be received within such estimate, the Board
of Commissioners shall have the power to do such work and make such improvements
within the estimateicost thereof as provided by law.
Section 8. That for the cost of building and constructing such sewers special
assessments shall be made for the full cost thereof on all lots or pieces of land
within the respective sewer districts within and for such sewer shall be built,
according to the appraised value thereof, without regard to the improvers ents or
buildin:s thereon.
Section D. After the passage and publication of this ordinance, the Board of

Commissioners shall appoint three disinterested appraisers, who after having taken
an oath to make a true and impartial appraisement of all lots and pieces of land to
taxation for the cost of such improvements, shall within five days after having been
notified of such appointments proceed to appraise all of the lots and pieces of land
within such districts liable to assessment and taxation as aforesaid, without regard

to the buildings or improvements thereon, and after making such appraisements shall
return to the Hoard of Commissioners of said city and said Board shall designate a
jtime for holding a special meeting of said Board for the purpose of hearing any

complaints that may be made as to the value of any lot or piece of land appraised
as aforesaid, of which special session due notice shall beiv

city paper, and at which special session said Board may alter any valuation of any
lot or pieces of land, if, in their opinion, the same has been appraised too high
or too law.
Section 10. The special assessment herein provided for may be paid by the
person liable therefor in four approximately equal annual installments but the owner
of any property liable to such assessment may within thirty days from the date of
determining the amount assessed against his property pay the same in full and his
property shall not bd liable for any assessment s for the cost of such improvements,

and bonds an hereinafter provided for shall be issued in theamound of the cost of
such improvements remaining unpaid at the end of thirty days from the time such
assessment is fixed.
Sectidn 11. For the purpose of paying for the work and improvements in this
ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue improvement bonds of the City of Salina in an amount not to exceed the cost
of such improvements, and to run for a period of four years and be payable in four
approximately equal annual installments, together with interest not to exceed five
per cent per annum, which bonds shall be issued and payable according to law; and
for the purpose of paying the principal and interest on said bonds as they severally
become due and payable, the Board of Commissioners shall ap_,ortion and assess against
the lots or pieces of land within the taxing district of such improvements, special
assessments covering the cost of such improvement and the apportionment therein con-
tained shall hold good for all of the installments that are to be collected from
the specific property charteable with said improvements, such assessment and a.por-
tionment ordinance shall contain the sum total amount of tax apportioned to each
tract, piece or parcel of land within the taxing district and shall state the number
of annual installments in which such tax is to be collected; and thereafter the
City Clerk shall annually, at the same time the other taxes are certified to the
County Clerk of Saline County� Kansas, a full list of all property liable for such
work and improvem n ts, together with the respective amounts due on each of said
tracts, pieces of parcels of land, which amounts shall include the annual install-

manta and interest on all unpaid balances for one year at the rate of not to axoeed
rin five per cant per annum, on such amounts so certified, which shall be collected

as other taxes are collected.

Section 12. That this ordinance shall take effect and be in full force from
