AN ORDIN,kNCE creating and defining a certain Lateral Sanitary Sewer District in
the City of Salina designated as Lateral Sanitary Sewer District Number 225, and
providing for the construction of a Lateral Sanitary Sewer in said Lateral Sani-
tary Sewer District Number 225, so created, and providing for the payment of
the cost thereof and for the levying of special assessments against the property in
said district for the payment of the cost of such construction and for the issuing; ofl
bonds to pay the cost thereof.

BE IT CRMI12D by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 225.
That there be and there is hereby' created Lateral Sanitary Sewer District in
the City of Salina, Kansas, which shall be and it is hereby designated as
Lateral Sanitary Sewer District Number 225 and which district shall include
all the following described property in the City of Salina, Kansas, to wit:
Lots 11 to 20, Inclusive, in Block 1
and Lots 11 to 20, Inclusive in Block j
2 in Calkins Addition to the City of
Salina, Saline County, Kansas
Section 2. That it is necessary and it is hereby ordered that an eight
inch V.C.P. lateral Sanitary Sewer with all necessary co nnec-
:ions, manholes,
flushing tanks and other appurtenances be constructed and built in and to
said Lateral Sanitary Sewer District Number 225 as created by Section 1 of
this Ordinance along the following course, to -wit:

Beginning at an existing manhole in
the intersection of Lincoln Avenue
and Eighth Street, thence north in
the center of Eighth Street a dis-
tar..ce of 600 feet to a manhole to be
constructed in said Eighth Street
being the terminus of said sewer.
Section 3. That the City Engineer shall on or before May 24th
1948, prepare and file in the office of the City Cle r]F, p6lans and specifications
for the construction of the lateral sanitary sewer provided for in the pre-
ceding sections of this ordinance which shall be of proper character to serve
the property lying within the district within which such sewer is to be con-
structed and shall on or before the same date prepare and submit to the Board
of Conurissioners a detailed estimate under oath of the cost thereof. That
thereafter the City Clerk shall advertise for three consecutive days in the
official City paper for sealed proposals for the building and construction of
such sewer according to such plans and specifications, which proposals shall
be filed with the City Clerk on or bedore the time fixed in such notice, at
which time the Board of Commissioners may let a contract for the buildinE and
construction of such sewerto the lowest and best responsible bidder or bidders
thereof, but said Board shall ]reserve the right to reject any or all such pro-
posals, and if no bid shall be received with such estimate, the Board of
Commissioners shall have the power to do such viork and make such improvements
within the estimated cost thereof as provided by law.
Section 4. That for the cost of building and construction of such sewers
special assessments shall be made for the full cost thereof on all lots and
pieces of land within the sewer district and for such sewer shall be built,

aocording to the appraised value thereof, without regard to the improvements
or buildings thereon#
Section 5. After the passage and Publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, who after having
taken an oath to make a true and impartial appraisement of all lots and pieces
of land to taxation for the cost of such improvements, shall within five days

after having been notified of their appointment proceed to appraise all of the
lots or pieces of land within such district liable to assessment and taxation
as aforesaid, without regard to the buildings or improvements thereon, and after
making such appraisement shall return bb the Board of Commissioners of said
City and said Board shall designate a time for holding a special meeting of
said Board for the purpose of hearing any complaints that may be made as to the
value of any lot or piece of land appraised as aforesaid, of which special

session due notice shall be given in the official citypaper, and at which
special session said Board may alter any valuation of any lot or piece of

land, if, in their opinion, the same has been appraised too high of too low.
Section 6. The special assessment herein provid6d for may be paid by the
person liable therefor in four approximately equal annual installments or the
owner of any property liable to such assessment may wu thin thirty days from the
date of Inst the determining amount assessed a his

and his property shall not be liable for any assessments f or the cost of such
improvement, and bonds as hereinafter provided for shall be issued in the amount
of the cost of such improvements remain§ng unpaid at the end of thirty days from
the time such assessment is fixed.
Section 7. For the purpose of paying for the work and improvements in th is

ordinance provided for, the Board of Commissioners are hereby authorized and
directed to issue improvement bonds of the City of Salina in an amount not to
exceed the cost of such improvement, and to run for a period of four yeEr s and
be payable in four approximately equal installments, together with interest not
to exceed five per cent per annum, which bonds, shall be issued and payable
according to law; and for the purpose of paying the principal and interest on
said bonds as they severally become due and payable, the Board of Commissioners
shall apportion and assess against the lots or pieces of land within the taxing
and shall state the number of annual installments in which swh tax is to be
collected; and thereafter the City Clerk shall annually, at the same time other
taxes are certified, certify to the County Clerk of Saline County, Kansas, a
full list of all property liable for such work and improvements, together
sith the respective a.mo�nts due on each of said tracts, pieces or parcels of
land, which amounts shall include the annual installments and interest on all
unpaid balances for one year at the rate of not to exceed fivep,�

annum, on such amounts so certified, which shall be collected as other taxes
are collected,

Section 8. This ordinance shall take effect and be in full force from
and after its Publication in the official city Paper.
